【摘要】：公眾共用物本身無所謂悲劇或喜劇,由人類推動的公眾共用物運(yùn)動好比人類演出的一幕戲劇,有時表現(xiàn)為悲劇,有時表現(xiàn)為喜劇,有時表現(xiàn)為悲喜劇,而關(guān)鍵是我們?nèi)祟悓λ膽B(tài)度和行為方式。公眾共用物治理的單一模式是:針對第一種公眾共用物悲劇問題,依據(jù)第一種公眾共用物悲劇產(chǎn)生的機(jī)理,建構(gòu)防治第一種公眾共用物悲劇的理論,采取將具有非排他性的公眾共用物轉(zhuǎn)變?yōu)榫哂信潘缘奈餀?quán)或財產(chǎn)權(quán)的客體的經(jīng)典方法,通過將公眾共用物私有財產(chǎn)化或國有財產(chǎn)化的途徑,或運(yùn)用市場調(diào)整機(jī)制,或運(yùn)用行政調(diào)整機(jī)制解決第一類公眾共用物悲劇。公眾共用物治理的綜合模式是:從公眾共用物的狀況、人的各種需求和兩種公眾共用物悲劇等實際情況出發(fā),依據(jù)公眾共用物的特點及兩種公眾共用物悲劇產(chǎn)生的機(jī)理,建構(gòu)公眾共用物可持續(xù)利用和防治兩種公眾共用物悲劇的理論,對不同狀況的公眾共用物,分別采取或維持公眾共用物性質(zhì)不變或?qū)⒐姽灿梦镛D(zhuǎn)變?yōu)榫哂信潘缘漠a(chǎn)權(quán)或物權(quán)客體等方法,綜合運(yùn)用三只手(三種調(diào)整機(jī)制)或多元調(diào)整機(jī)制和調(diào)整方法,防治兩種公眾共用物悲劇和反公眾共用物悲劇,實現(xiàn)公眾共用物的功能、作用和喜劇,促進(jìn)公眾共用物的可持續(xù)供給與利用。
[Abstract]:There is no tragedy or comedy in the public Commons itself, and the public communion movement promoted by human beings is like a play performed by human beings, sometimes in tragedy, sometimes in comedy, sometimes in tragicomedy, sometimes in tragicomedy. But the key is our human attitude and behavior towards it. The single mode of public common object governance is to construct the theory of prevention and cure of the first kind of public common thing tragedy according to the mechanism of the first kind of public common thing tragedy, aiming at the first kind of tragedy of public common thing. Adopting the classical method of transforming non-exclusive public common objects into exclusive real rights or objects of property rights, through the way of private property or state-owned property of public common property, or by using the market adjustment mechanism, Or the use of administrative adjustment mechanism to solve the first category of public common objects tragedy. The comprehensive mode of public common object governance is: based on the actual situation of public common object, human needs and the tragedy of two kinds of public common object, and according to the characteristics of public common object and the mechanism of the two kinds of public common object tragedy, To construct the theory of sustainable use of public Commons and to prevent and cure the tragedies of two kinds of public common objects. To adopt or maintain the same nature of public common objects or to transform public common objects into exclusive property rights or objects of real right respectively, and to use three hands (three kinds of adjustment mechanisms) or multi-element adjustment mechanisms and methods of adjustment, respectively. To prevent and cure the tragedy of two kinds of public common objects, to realize the function, function and comedy of public common objects, and to promote the sustainable supply and utilization of public common objects.
