【摘要】：社會沖突治理對策選擇不當,難免衍生出一系列的后遺癥,究其原因,除了沖突一方(或雙方)違背約定而反悔外,應對者的公、私權利保護的優(yōu)先權順序安排不合理和剛性維穩(wěn)目標下治理手段選擇不當,才是深層的原因。為了實現(xiàn)社會安全,必須對社會沖突后遺癥進行再治理。為此,必須堅持追根溯源、阻疏結合、依法糾偏、慎用警力的原則,從技術的層面上找到阻斷沖突事件烽煙再起的具體方法,從制度層面上完善沖突后遺癥再治理的策略。
[Abstract]:The improper choice of countermeasures for the management of social conflict inevitably gives rise to a series of sequelae. The reason is that, in addition to one party (or both sides) of the conflict breaking the agreement and reneging, the public of the responder, The deep reason is that the priority order of private right protection is unreasonable and the management means are not properly chosen under the rigid maintenance target. In order to realize social security, the sequelae of social conflict must be retreated. Therefore, we must adhere to the principle of tracing back to the source, blocking the combination of obstruction and dispersing, rectifying errors according to law, using police force prudently, finding out the concrete method of blocking the reemergence of conflict incident from the technical level, and perfecting the strategy of retreating the sequelae of conflict from the system level.
