【摘要】：青天情結(jié)是中國特有的一種民間現(xiàn)象,為研究當(dāng)代公共行政提供了獨(dú)特的視角。本文開篇以青天人物立意,何為“青天”?清如水,明如鏡,愛民如子,如同青天。在一些文學(xué)作品中,人們常常將“清官”與“青天”視為同一概念,實(shí)際上并非如此,在民眾心中“青天”與“清官”在評價標(biāo)準(zhǔn)上存在著價值分野,就“清官”而言,評價標(biāo)準(zhǔn)傾向于甘于清貧、廉潔自律等,而青天本身更強(qiáng)調(diào)對公平正義的堅(jiān)守,反映了人們相比于推崇清官清廉的品質(zhì),更看重青天對公平正義的維護(hù)。不可否認(rèn),青天人物在其所處朝代雖有緩和社會矛盾,為鞏固帝制服務(wù)的一面,但他們?yōu)槊褡鲋?堅(jiān)守正義的行政理念卻有著超越時空的價值。故而,時至今日,當(dāng)一些遠(yuǎn)離公正的弱勢群體在利益受損時,仍會寄望于“青天大老爺”的出現(xiàn),人們渴望“青天”式的正義。實(shí)際上,這種“青天”崇拜在一定程度上代表了當(dāng)代社會正義的普遍失落,代表了人們對公共行政正義的訴求。從理論層面來講,強(qiáng)調(diào)正義也是公共行政學(xué)說百年發(fā)展歷史的必然選擇,公共行政正義作為公共行政的核心價值,為我們進(jìn)一步完善中國公共行政提供了重要邏輯基礎(chǔ)。事實(shí)上,中國也的確存在著現(xiàn)實(shí)的公共行政正義困境,“青天情結(jié)”以各種各樣的形式存在于現(xiàn)實(shí)社會當(dāng)中,值得我們反思與警醒,我們并非要弘揚(yáng)青天情結(jié),而是從青天情結(jié)產(chǎn)生和存續(xù)的原因上汲取符合當(dāng)代中國發(fā)展的行政智慧。而且公共行政正義作為公共行政首要和核心的價值,一旦缺失必然會引發(fā)公共行政問題,因而,筆者的研究主要從“青天情結(jié)”對公共行政正義的啟示出發(fā),根據(jù)其中可供借鑒的部分來尋求一種拯救公共行政正義的可能性路徑。正文的主體部分首先充分論證了青天情結(jié)背后的正義訴求,然后以十八大報告提出的公共行政正義所追求的三大公平正義維度為分析框架,從青天情結(jié)與公共行政正義的契合之處出發(fā),結(jié)合中國的現(xiàn)實(shí)困境,尋求路徑以捍衛(wèi)權(quán)利公平、保障機(jī)會公平、堅(jiān)守規(guī)則公平,并最終實(shí)現(xiàn)當(dāng)代中國所吁求的社會公平正義。
[Abstract]:Qingtian complex is a special folk phenomenon in China, which provides a unique perspective for the study of contemporary public administration. At the beginning of this article, what is the meaning of "Qingtian"? As clear as water, as clear as a mirror, love the people as the green sky. In some literary works, people often regard "Qingguan" and "Qingtian" as the same concept. In fact, this is not the case. In the minds of the public, there is a distinction of value between "Qingtian" and "Qingguan" in terms of evaluation criteria, as far as "Qingguan" is concerned. The evaluation standard tends to be willing to be poor, honest and self-discipline, while Qingtian itself emphasizes the adherence to fairness and justice, which reflects the fact that people attach more importance to the maintenance of fairness and justice than to the quality of promoting clean officials. It can not be denied that although the Qing Heaven figures in their dynasties have eased the social contradictions and served for the consolidation of the monarchy, but they have the value of transcending time and space to make decisions for the people and to adhere to the administrative concept of justice. Therefore, even today, when some vulnerable groups far from justice in the interests of damage, still hope for the emergence of "the Great Master of Heaven", people yearn for "Qingtian" type of justice. In fact, this worship of the "Green Heaven" to a certain extent represents the general loss of contemporary social justice and people's demands for public administration justice. Theoretically speaking, emphasizing that justice is also the inevitable choice of the century-old development of public administration theory. As the core value of public administration, public administration justice provides an important logical basis for us to further improve Chinese public administration. In fact, there is a real dilemma of public administration justice in China. "Qingtian complex" exists in real society in all kinds of forms. It is worth our reflection and warning. We do not want to carry forward the Qingtian complex. Instead, we draw administrative wisdom from the causes of the emergence and existence of the Qingtian complex in line with the development of contemporary China. And public administration justice is the first and core value of public administration, once it is missing, it will inevitably lead to public administration problem. Therefore, the author's research mainly starts from the enlightenment of "Qingtian complex" to public administration justice. According to the part which can be used for reference, to seek a possible way to save public administration justice. The main body of the text first fully demonstrates the justice demand behind the Qingtian complex, and then takes the three dimensions of fairness and justice pursued by the report of the 18th National Congress of the Communist Party of China as the analytical framework. Starting from the coincidence between the Qingtian complex and the justice of public administration, and combining with China's realistic predicament, we seek ways to safeguard the fairness of rights, guarantee the fairness of opportunities, stick to the fairness of rules, and finally realize the social fairness and justice called for by contemporary China.
