權(quán)力清單制度研究—以功能主義為視角

【摘要】:權(quán)力清單不是一個新名詞,它已經(jīng)在全國范圍內(nèi)展開,不僅在省級單位全面鋪行,市縣聯(lián)動的權(quán)力清單也已經(jīng)或正在推行。但權(quán)力清單到底是什么,我們以什么樣的角度去看待權(quán)力清單,如何完善權(quán)力清單,又如何看待權(quán)力清單在司法實踐中的適用,這些問題都值得我們?nèi)ド钏。在全面深化改革的中堅?對權(quán)力清單的研究不僅具有理論上的意義,對國家治理體系現(xiàn)代化也有著深刻的現(xiàn)實意義,由此本文選擇了一種符合現(xiàn)代化需求、符合行政治理改革的方法論,即功能主義,并在開篇展開了對功能主義論述。雖然目前從表面上看,權(quán)力清單已經(jīng)在全國范圍內(nèi)鋪開,從中央到各省市單位,甚至縣級單位,都給予了最大的熱情和付出,學(xué)術(shù)界也出現(xiàn)了不少研究權(quán)力清單的文章,但是問題仍然存在。首先對權(quán)力清單的制度定性就沒有形成統(tǒng)一的定論。對權(quán)力清單的制度定性是研究權(quán)力清單的基礎(chǔ),不僅是對其自身性質(zhì)的把握,也是區(qū)分其他概念的關(guān)鍵所在。文章主要是將各種調(diào)整行政權(quán)利義務(wù)關(guān)系的抽象規(guī)則進行對比,通過系統(tǒng)的比對,將權(quán)力清單定性為行政規(guī)則,并以功能主義的角度,在得出定位的基礎(chǔ)上論述了權(quán)力清單制度的功能,進一步認(rèn)清權(quán)力清單的真諦。其次,各級單位在制定權(quán)力清單時沒有形成統(tǒng)一的程序。本文以三個典型省份作為案例,發(fā)現(xiàn)從清理職權(quán)到最終制定完成公布,三個省份在雖然大體流程上出入不大,但在具體細節(jié)的處理上各有千秋。基于此,本文在研究權(quán)力清單的制定程序時,選擇了求同存異的理念,認(rèn)為根據(jù)各地方的經(jīng)濟社會文化發(fā)展情況的不同,稍有差異也是合理的。除了外在的制定流程,對制度過程中的內(nèi)在利益沖突也不可忽視,實際上,完善權(quán)力清單的制定程序也是均衡各方利益以達到社會經(jīng)濟和諧發(fā)展的目的。再者,目前權(quán)力清單的推行仍處于調(diào)整和進階期,司法理論上并沒有形成統(tǒng)一的學(xué)說,立法上也沒有形成規(guī)范性指導(dǎo),但是這并不是說權(quán)力清單在司法上毫無應(yīng)用,相反,在目前的司法實裁判中,權(quán)力清單的出現(xiàn)已經(jīng)不是個案。權(quán)力清單兼具規(guī)則和自制雙重個性,基于此,我們在探討權(quán)力清單與司法審查時,就有必要從權(quán)力清單的兩種屬性出發(fā),即作為審查依據(jù)的屬性和作為審查對象的屬性。文章整理出的29則實踐案例,將這29則司法案例分類,在大類中又找出典型案例,試圖對權(quán)力清單在司法實踐中的適用展開實證分析,論述權(quán)力清單在司法審查中的標(biāo)準(zhǔn)和強度。權(quán)力清單將權(quán)力制單曬出,順應(yīng)了改革潮流,順應(yīng)了政府職能轉(zhuǎn)變的呼吁。本文對權(quán)力清單進行研究,以期達到更有力地發(fā)揮權(quán)力清單推動全面深化改革作用的目的。
[Abstract]:The list of powers is not a new term. It has been carried out all over the country, not only in provincial units, but also in cities and counties. But what is the power list, what kind of angle we treat the power list, how to perfect the power list, and how to look at the application of the power list in judicial practice, these problems are worth our thinking. In the period of deepening the reform in an all-round way, the research on the list of powers is not only of theoretical significance, but also of profound practical significance to the modernization of the national governance system. In line with the methodology of administrative governance reform, that is functionalism, and in the beginning of the discussion of functionalism. Although at present, on the surface, the list of powers has been spread throughout the country, from the central authorities to the provincial and municipal units, and even to the county-level units, they have given their greatest enthusiasm and dedication, and many articles on the power list have also appeared in the academic community. But the problem remains. First of all, there is no unified conclusion on the institutional characterization of the list of powers. The institutional characterization of the list of powers is the basis of studying the list of powers, which is not only the grasp of its own nature, but also the key to distinguish other concepts. This paper compares various abstract rules that regulate the relationship between administrative rights and obligations. Through systematic comparison, the list of powers is characterized as administrative rules, and from the perspective of functionalism, The function of power list system is discussed on the basis of orientation, and the true meaning of power list is recognized. Second, units at all levels in the formulation of the list of powers did not form a unified procedure. This paper takes three typical provinces as a case, and finds that the three provinces have their own characteristics in dealing with the specific details, although there is little difference in the general process between the three provinces from the clean-up authority to the final formulation and publication. Based on this, this paper chooses the idea of seeking common ground while reserving differences when studying the procedure of making lists of powers, and thinks that it is reasonable to have some differences according to the different economic, social and cultural development of different places. In addition to the external formulation process, the internal conflict of interest in the process of the system can not be ignored. In fact, the goal of balancing the interests of all parties to achieve the harmonious development of social economy is to perfect the process of making the list of powers. Moreover, at present, the implementation of the list of powers is still in the period of adjustment and advancement. There is no unified theory in judicial theory or normative guidance in legislation, but this does not mean that the list of powers has no application in the administration of justice. On the contrary, it does not mean that the list of powers has no application in the administration of justice. In the current judicial decision, the emergence of the list of powers is no longer a case. The list of power has both the character of rule and self-control. Therefore, when we discuss the power list and judicial review, we should proceed from the two attributes of power list, that is, the attribute that is the basis of the examination and the attribute of the object of examination. The article collates 29 practical cases, classifies 29 judicial cases, finds out typical cases in large categories, and tries to carry out empirical analysis on the application of power list in judicial practice. This paper discusses the standard and intensity of power list in judicial review. The list of powers reflects the system of power, conforms to the trend of reform and calls for the transformation of government functions. This paper studies the list of powers in order to give full play to the role of the list of powers in promoting the overall deepening of reform.
