【摘要】：行政審批制度改革一直是我國行政體制改革中的熱點問題,是完善社會主義市場經(jīng)濟體制、處理好政府與市場關(guān)系的重要內(nèi)容,它在構(gòu)建“廉潔、勤政、務(wù)實、高效”的服務(wù)型政府中有著非常重要的作用。十八屆三中全會報告提出要“深化行政審批制度改革”,行政審批制度改革是未來政府工作的重點內(nèi)容。改革開放以來,隨著市場化程度的不斷加深,市場在資源配置中的作用不斷加大,如何充分發(fā)揮市場在資源配置中的決定性作用,就要正確處理政府和市場的關(guān)系。因此,減少政府的行政審批權(quán),大力實施簡政放權(quán),繼續(xù)深入推進行政審批制度改革,逐步建立和完善與市場經(jīng)濟發(fā)展相適應(yīng)的行政審批制度,是未來行政體制改革中一項常抓不懈的工作。自從2001年開展行政審批制度改革工作以來,甘肅省認真貫徹落實中央決策部署,按照中央統(tǒng)一安排,以行政審批制度改革為抓手,以轉(zhuǎn)變政府職能為核心,大力簡政放權(quán),不斷深化行政體制改革,取得了巨大成效。但是長期以來,由于行政管理理念落后、政府職能轉(zhuǎn)變滯后、行政程序法律體系不健全、部門利益的影響等原因,甘肅省在行政審批制度改革中依然存在效率低下、權(quán)力下放主動性不高和監(jiān)管不到位等問題,甘肅省與黨中央和一些發(fā)達兄弟省份的改革工作還存在一定差距�；诖�,研究甘肅省行政審批制度的改革歷程及現(xiàn)狀,進一步完善甘肅省行政審批制度,對于發(fā)展甘肅社會經(jīng)濟、提高公共服務(wù)水平、方便人民群眾具有極其深遠的意義。論文從行政審批制度的理論基礎(chǔ)著手,對甘肅省行政審批制度改革實踐進程、改革中存在的問題以及存在問題的原因等方面的資料進行了整理分析,并針對存在的問題,進一步探討了完善甘肅省行政審批制度的路徑,以期建立起適應(yīng)社會主義市場經(jīng)濟體制的行政審批制度。論文的具體結(jié)構(gòu)如下:第一章,緒論部分,分析了論文的研究緣起及意義,并闡述了國內(nèi)外研究現(xiàn)狀、論文采用的研究思路與方法,最后提出了論文的研究重點、難點以及創(chuàng)新點。第二章,闡述了行政審批制度的理論基礎(chǔ)及其演進,包括行政審批的內(nèi)涵界定及相關(guān)理論支持,主要支撐理論有政府管制理論、服務(wù)型政府理論和政府流程再造理論。第三章,主要采用歷史的分析方法,對甘肅省行政審批的實踐進程做一梳理和分析,對每一個歷史時期的大環(huán)境和行政審批的特征進行歸納總結(jié),展現(xiàn)出甘肅省在行政審批制度改革中不斷努力探索、逐步完善行政審批制度的動態(tài)過程。第四章,依據(jù)前文的研究方法和理論基礎(chǔ),通過搜集、整理大量文獻資料以及部分統(tǒng)計數(shù)據(jù),分析了甘肅省的行政審批現(xiàn)狀,對當前甘肅省行政審批已取得的成效、存在的問題以及存在問題的原因進行了探討和總結(jié)。第五章,針對前文所分析的甘肅省行政審批存在的問題,以國務(wù)院、黨中央以及甘肅省省委、省政府關(guān)于行政審批制度改革的相關(guān)法律法規(guī)、政策及文件為主要依據(jù),積極貫徹國務(wù)院、黨中央的整體部署,結(jié)合甘肅省實際狀況,提出了完善甘肅省行政審批制度的具體路徑。具體而言,就是加快政府職能轉(zhuǎn)變,深入推進行政審批改革工作;加強社會組織規(guī)范化建設(shè),進一步強化政府監(jiān)管力度;規(guī)范行政審批行為,推進審批方式和管理體制創(chuàng)新;繼續(xù)深入推進簡政放權(quán),厘清政府與市場邊界;健全行政審批機制,完善行政審批體系等。
[Abstract]:The reform of the administrative examination and approval system has always been a hot issue in the reform of the administrative system in China. It is an important content of perfecting the socialist market economy system and dealing with the relationship between the government and the market. It has a very important role in building a "clean, diligent, pragmatic and efficient" service-oriented government. The report of the third Plenary Session of the 18th CPC Central Committee is "deep". Since the reform and opening up, with the deepening of the market level, the role of the market in the allocation of resources is increasing. The concrete structure of the thesis is as follows: the first chapter, the introduction part, analyses the origin of the research of the paper. In the second chapter, the theoretical basis and evolution of the administrative examination and approval system are expounded, including the definition of administrative examination and approval and the support of relevant theories, and the main support theory has the theory of government control. In the third chapter, the third chapter mainly adopts the historical analysis method to analyze and analyze the practice process of administrative examination and approval in Gansu Province, summarizes the characteristics of the great environment and administrative examination and approval in every historical period, and shows that Gansu province is constantly trying to explore the reform of administrative examination and approval system. To improve the dynamic process of the administrative examination and approval system gradually. In the fourth chapter, according to the research method and theoretical basis of the previous article, through collecting, sorting out a large number of documents and some statistical data, the present situation of administrative examination and approval in Gansu province is analyzed. The results of the current administrative examination and approval of Gansu Province, the existing problems and the reasons for the existing problems are introduced.
