【摘要】:地方政府創(chuàng)新是我國(guó)經(jīng)濟(jì)蓬勃發(fā)展的主要推動(dòng)力,是解決社會(huì)矛盾、保障社會(huì)穩(wěn)定發(fā)展的重要助力。地方政府創(chuàng)新的動(dòng)因既來(lái)自地方領(lǐng)導(dǎo)者創(chuàng)新精神的指引,同時(shí)也源于中央政府以及地方政府間競(jìng)爭(zhēng)的壓力,在上述動(dòng)因的驅(qū)動(dòng)下理論上地方政府創(chuàng)新的數(shù)量應(yīng)逐年遞增。但近年來(lái),我國(guó)地方政府創(chuàng)新陷入困境,地方政府官員不愿創(chuàng)新、不敢創(chuàng)新的現(xiàn)象大量存在,根據(jù)歷屆地方政府創(chuàng)新獎(jiǎng)的申報(bào)數(shù)量來(lái)看,地方政府創(chuàng)新的數(shù)量逐年遞減。理論與現(xiàn)實(shí)的相悖其背后的原因在于:其一,創(chuàng)新是一個(gè)試錯(cuò)的過(guò)程,其具有試錯(cuò)性和后顯性等特點(diǎn);其二,我國(guó)缺乏對(duì)于創(chuàng)新官員的保護(hù)機(jī)制;其三,社會(huì)環(huán)境對(duì)官員的負(fù)面激勵(lì)正在上升。當(dāng)前,我國(guó)已經(jīng)進(jìn)入改革的深水區(qū),全面深化改革勢(shì)在必行,要想打贏改革攻堅(jiān)戰(zhàn),各級(jí)地方政府官員需要大膽創(chuàng)新,為此,應(yīng)建立相應(yīng)的容錯(cuò)機(jī)制以鼓勵(lì)地方政府官員繼續(xù)走改革創(chuàng)新之路。為解決官員不敢創(chuàng)新的問(wèn)題,一些地方政府出臺(tái)了與“容錯(cuò)免責(zé)”相關(guān)的條例,以期通過(guò)對(duì)官員進(jìn)行容錯(cuò)免責(zé)的形式來(lái)鼓勵(lì)其大膽創(chuàng)新,但在實(shí)際的運(yùn)用中,未能發(fā)揮應(yīng)有的效用,地方政府官員不敢創(chuàng)新的現(xiàn)象依然存在且比較嚴(yán)峻。通過(guò)對(duì)各地出臺(tái)的“容錯(cuò)免責(zé)”條例進(jìn)行分析發(fā)現(xiàn),其未能發(fā)揮效用的原因在于條例的法律效力不足以及內(nèi)容專業(yè)性不夠。本文在結(jié)合國(guó)內(nèi)外相關(guān)經(jīng)驗(yàn)的基礎(chǔ)上,嘗試對(duì)構(gòu)建地方政府創(chuàng)新視域下容錯(cuò)機(jī)制進(jìn)行探索。本文認(rèn)為,完善的容錯(cuò)機(jī)制應(yīng)包含容錯(cuò)內(nèi)容、容錯(cuò)主體、容錯(cuò)程序以及容錯(cuò)過(guò)程中的公開(kāi)等子系統(tǒng)。同時(shí),為使容錯(cuò)機(jī)制能落實(shí)到實(shí)處,應(yīng)設(shè)立地方政府創(chuàng)新的紅線與危險(xiǎn)責(zé)任原則、營(yíng)造鼓勵(lì)創(chuàng)新、寬容失敗的社會(huì)氛圍。
[Abstract]:The innovation of local government is the main driving force for the vigorous development of our economy and the important help to solve the social contradictions and ensure the stable development of the society. The motivation of local government innovation comes not only from the guidance of local leaders' innovation spirit, but also from the pressure of competition between central government and local government. In theory, the number of local government innovation should increase year by year. However, in recent years, the local government innovation in our country is in a dilemma, local government officials are unwilling to innovate and dare not to innovate. According to the number of local government innovation awards declared, the number of local government innovation is decreasing year by year. The reasons behind the contradiction between theory and reality lie in: first, innovation is a process of trial and error, which has the characteristics of trial and error and postdominance; second, our country lacks the protection mechanism for innovation officials; third, Negative incentives from the social environment for officials are on the rise. At present, our country has entered the deep water area of reform, so it is imperative to deepen the reform in an all-round way. In order to win the war on reform, local government officials at all levels need to make bold innovations. The fault-tolerant mechanism should be established to encourage local government officials to continue to take the road of reform and innovation. In order to solve the problem that officials do not dare to innovate, some local governments have issued regulations related to "fault-tolerant exemption" in order to encourage officials to innovate boldly through the form of fault-tolerant exemption, but in practical use, The phenomenon that local government officials dare not innovate still exists and is severe. Through the analysis of the "fault-tolerant exemption" regulations, it is found that the reason for its failure lies in the lack of legal effect and the lack of professional content. Based on the relevant experience at home and abroad, this paper attempts to explore the fault-tolerant mechanism of local government innovation. This paper holds that a perfect fault-tolerant mechanism should include fault-tolerant content, fault-tolerant subject, fault-tolerant program and the open subsystem in the fault-tolerant process. At the same time, in order to implement the fault-tolerant mechanism, the red line of local government innovation and the principle of dangerous responsibility should be set up, and the social atmosphere of encouraging innovation and tolerating failure should be created.
