【摘要】：由于我國目前經(jīng)濟(jì)和社會發(fā)展的需求,致使流動攤販大量存在。他們的經(jīng)營活動是為了維持自己的生計,同時也方便了群眾的生活。流動攤販的存在促進(jìn)了就業(yè),增加了就業(yè)機(jī)會,改善了民生。同時也鼓勵了創(chuàng)業(yè),體現(xiàn)了萬眾創(chuàng)業(yè)的精神。流動攤販的經(jīng)營活動促進(jìn)了市場經(jīng)濟(jì)的發(fā)展,他們的存在同時也促進(jìn)了社會的和諧與穩(wěn)定。然而,在現(xiàn)實生活中,由于流動攤販還給交通、環(huán)境等帶來一些不良的影響,所以城市管理部門與流動攤販的沖突不斷,但是,這些只是表面的問題,其實質(zhì)問題是,我國的流動攤販在法律上沒有得到承認(rèn),不屬于商事主體。本文是從商事主體的構(gòu)成要件為立足點,結(jié)合流動攤販的特征,分析理論界關(guān)于流動攤販的主體地位的爭議,運(yùn)用比較分析法、歷史分析方法等方法對其進(jìn)行了研究。第一章介紹了流動攤販的基本理論,包括怎樣界定流動攤販,流動攤販形成的原因、生存現(xiàn)狀以及流動攤販問題的成因。第二章和第三章是本篇論文的關(guān)鍵部分,從商事主體的構(gòu)成要件及特征,結(jié)合國外典型國家及我國港臺地區(qū)的立法例分析了賦予我國流動攤販商事主體地位的必要性,筆者認(rèn)為,應(yīng)建立流動攤販的商事主體地位。第四章提出確立我國流動攤販商事主體地位的途徑以及治理的措施。從立法、司法、執(zhí)法以及流動攤販的自我管理等方面進(jìn)行論述并提出建議,希望對保障流動攤販經(jīng)營活動的正常進(jìn)行及緩解與城管之間的矛盾有所幫助。
[Abstract]:Due to the demand of economic and social development, mobile vendors exist in large quantities. Their business is to maintain their livelihood, but also to facilitate the life of the masses. The existence of mobile vendors promotes employment, increases employment opportunities and improves people's livelihood. At the same time, it also encourages entrepreneurship, reflecting the spirit of entrepreneurship. The business activities of mobile vendors promote the development of market economy, and their existence also promotes social harmony and stability. However, in real life, because mobile vendors bring some adverse effects to traffic and the environment, so the conflicts between urban management departments and mobile vendors are constant. However, these are only superficial problems, and the substantive problems are: The mobile vendors in our country are not recognized legally and are not commercial subjects. From the standpoint of the constituent elements of commercial subjects and the characteristics of mobile vendors, this paper analyzes the disputes about the subject status of mobile vendors in the theoretical circle, and studies them by means of comparative analysis and historical analysis methods. The first chapter introduces the basic theory of mobile vendors, including how to define the mobile vendors, the reasons for the formation of mobile vendors, the status quo of existence and the causes of mobile vendors. The second and third chapters are the key parts of this paper, from the elements and characteristics of commercial subjects, combined with the typical foreign countries and the Hong Kong and Taiwan regions of China, the necessity of giving commercial subject status to mobile vendors in China is analyzed. The author believes that the commercial subject status of mobile vendors should be established. Chapter four puts forward the ways to establish the status of the commercial subject of mobile vendors in China and the measures of governance. From the aspects of legislation, judicature, law enforcement and self-management of mobile vendors, this paper discusses and puts forward some suggestions, hoping to help to ensure the normal operation of mobile vendors and to alleviate the contradiction between mobile vendors and urban management.
