【摘要】："口喚"制度是當(dāng)代中國(guó)穆斯林習(xí)慣法中的一項(xiàng)重要內(nèi)容。民族地區(qū)的法官解決此類糾紛時(shí)既要考慮國(guó)家法律又要兼顧習(xí)慣法,在"制度性事實(shí)"與"多元規(guī)范"之間做出平衡。解決民族地區(qū)基層司法實(shí)踐中面臨的類似習(xí)慣法問題,需要在不斷總結(jié)經(jīng)驗(yàn)的基礎(chǔ)上,進(jìn)一步強(qiáng)化人民法庭的功能,從而使其更好地為民族地區(qū)的社會(huì)穩(wěn)定與繁榮提供司法服務(wù)和保障。
[Abstract]:The " call " system is an important content in contemporary Chinese Muslim customary law . The judge of ethnic region should take into account both national laws and customary law when resolving such disputes . It is necessary to further strengthen the function of the people ' s court on the basis of constant summing - up experience , so as to provide judicial services and guarantees for the social stability and prosperity of ethnic areas .
