【摘要】：公路行政中的廉政制度,是行政管理學(xué)關(guān)注的問(wèn)題之一,是我國(guó)廉政制度在公路事業(yè)中的具體體現(xiàn)與有效延伸。公路廉政制度,包括職權(quán)性行政中的廉政制度和非職權(quán)性行政中的廉潔從業(yè)制度。公路廉政制度,貫穿于公路行政的規(guī)劃、建設(shè)、養(yǎng)護(hù)、經(jīng)營(yíng)、使用和管理等六種社會(huì)關(guān)系中。研究公路行政中的廉政制度走向,探索我國(guó)公路行政管理中的廉政制度,是豐富行政管理中的廉政制度,提升公路廉政制度研究水平的基礎(chǔ)工作之一。本文依托行政管理中廉政制度的有關(guān)理論,綜合運(yùn)用了行政制度、行政法學(xué)等理論,對(duì)公路行政中所涉及的六種社會(huì)關(guān)系,就其中的廉政制度和廉潔從業(yè)[1]進(jìn)行了分析。運(yùn)用文獻(xiàn)分析法,較系統(tǒng)地梳理、總結(jié)了國(guó)內(nèi)外相關(guān)理論研究成果和政策制度現(xiàn)狀。運(yùn)用比較分析法,對(duì)國(guó)內(nèi)外的廉政建設(shè)理念和廉政制度建設(shè)經(jīng)驗(yàn)進(jìn)行了比較歸納。運(yùn)用系統(tǒng)分析法,從職權(quán)性行政與非職權(quán)性行政兩個(gè)層面出發(fā),結(jié)合公路規(guī)劃、建設(shè)、養(yǎng)護(hù)、經(jīng)營(yíng)、使用和管理等六大環(huán)節(jié),就公路廉政制度開(kāi)展研究與分析。通過(guò)研究發(fā)現(xiàn),公路廉政制度的建設(shè)具有兩個(gè)層面(職權(quán)性行政與非職權(quán)性行政)的意義。公路廉政建設(shè),存在于六種社會(huì)關(guān)系(規(guī)劃、建設(shè)、養(yǎng)護(hù)、經(jīng)營(yíng)、使用和管理)中。公路廉政建設(shè),須通過(guò)預(yù)防、監(jiān)督、懲治等制度措施,以形成公路廉政建設(shè)的長(zhǎng)效機(jī)制。職權(quán)行政與非職權(quán)性行政中的公路廉政建設(shè),具有不同的行政管理學(xué)意義。六種公路社會(huì)關(guān)系的規(guī)范中,均有廉政建設(shè)任務(wù)。構(gòu)建融預(yù)防制度、監(jiān)督制度與懲治制度三位一體、合力互補(bǔ)的公路廉政制度體系,將預(yù)防制度、監(jiān)督制度和懲治制度,延伸到六種公路社會(huì)關(guān)系(規(guī)劃、建設(shè)、養(yǎng)護(hù)、經(jīng)營(yíng)、使用和管理)的始終,既是公路行政中防微杜漸的制度要求,也是克服諸如“重懲治,輕預(yù)防,少監(jiān)督”等缺陷性廉政制度建設(shè)的需要�？茖W(xué)地規(guī)劃與設(shè)計(jì)公路行政中的預(yù)防制度、監(jiān)督制度與懲治制度,從實(shí)體與程序方面輔之于相應(yīng)的管理制度,以期充實(shí)公路廉政管理制度的理論與實(shí)踐。
[Abstract]:The clean government system in highway administration is one of the issues concerned by administrative management, and it is the concrete embodiment and effective extension of the clean government system in our country. Highway clean government system includes clean government system in authority administration and incorruptible practice system in non-authority administration. Highway clean government system runs through six kinds of social relations, such as planning, construction, maintenance, management, use and management of highway administration. It is one of the basic work to study the trend of the clean government system in the highway administration and to explore the clean government system in the highway administration of our country. It is one of the basic work to enrich the clean government system in the administration and improve the research level of the highway clean government system. Based on the relevant theories of clean government system in administrative management, this paper synthetically applies the theories of administrative system and administrative law, and analyzes the six kinds of social relations involved in highway administration, including the system of clean government and the practice of honest work [1]. By using literature analysis, this paper summarizes the domestic and foreign related theoretical research results and the present situation of policy system. By means of comparative analysis, this paper compares and sums up the experience of clean government construction at home and abroad. Based on the system analysis method and combining the six aspects of highway planning, construction, maintenance, management, use and management, this paper carries out research and analysis on the system of clean government of highway from the two aspects of authority administration and non-authority administration, combining with the six aspects of highway planning, construction, maintenance, management, use and management. Through the study, it is found that the construction of highway clean government system has two levels (authority administration and non-authority administration). The construction of clean and honest highway exists in six kinds of social relations (planning, construction, maintenance, management, use and management). In order to form a long-term mechanism for the construction of a clean and honest highway, measures of prevention, supervision and punishment should be adopted in the construction of a clean and honest highway. The construction of a clean and honest highway in the administration of authority and non-authority has different meanings of administrative management. Six kinds of highway social relations standard, all have the clean government construction task. The system of highway clean government, which integrates the prevention system, the supervision system and the punishment system, is constructed. The system of prevention, supervision and punishment is extended to six kinds of highway social relations (planning, construction, maintenance and management). Use and management) is not only the system requirement of prevention and control in highway administration, but also the need to overcome such defects as "heavy punishment, light prevention, less supervision" and so on. In order to enrich the theory and practice of highway clean administration, the scientific planning and design of prevention system, supervision system and punishment system are supplemented by the corresponding management system in terms of substance and procedure.
