論工程風(fēng)險(xiǎn)的責(zé)任——基于公共安全的視角

【摘要】:按照傳統(tǒng)的四極張力關(guān)系即"誰(shuí)、為什么、在誰(shuí)面前、依哪些標(biāo)準(zhǔn)"難以確定工程風(fēng)險(xiǎn)的責(zé)任。需要改變過(guò)于窄化的責(zé)任概念,豐富工程風(fēng)險(xiǎn)責(zé)任的涵義,拓展工程風(fēng)險(xiǎn)責(zé)任的邊界。工程風(fēng)險(xiǎn)的責(zé)任是多維度的復(fù)合的共同責(zé)任。建立一個(gè)共同責(zé)任的理論模型,以積極責(zé)任和消極責(zé)任為分析框架,探討工程風(fēng)險(xiǎn)責(zé)任的分配。
[Abstract]:According to the traditional quadrupole tension relation, namely "who, why, in front of who, which standard" is difficult to determine the responsibility of engineering risk. It is necessary to change the concept of overly narrowed responsibility, enrich the meaning of engineering risk responsibility and expand the boundary of engineering risk responsibility. The theoretical model of responsibility is based on the analysis framework of positive responsibility and negative liability, and explores the allocation of engineering risk responsibility.
