【摘要】：我國(guó)環(huán)境保護(hù)管理體制是我國(guó)環(huán)境保護(hù)工作的重要載體。但是長(zhǎng)期以來(lái),環(huán)境保護(hù)行政管理體制一直處于邊緣化的弱勢(shì)地位,不能承擔(dān)生態(tài)文明建設(shè)、建設(shè)美麗中國(guó)的重任,未能很好履行《環(huán)境保護(hù)法》等法律設(shè)定的權(quán)力、義務(wù),嚴(yán)重影響環(huán)境保護(hù)工作發(fā)展,形成了我國(guó)環(huán)境保護(hù)工作事倍功半、污染事件頻發(fā)的局面,損害了法律的權(quán)威,破壞了民眾對(duì)政府的信任關(guān)系。因此,深入探討環(huán)境保護(hù)行政管理體制存在的問(wèn)題,分析原因,找出解決的對(duì)策,完善我國(guó)環(huán)境保護(hù)行政管理體制,是一項(xiàng)非常重要的工作。本文從選題背景及意義出發(fā),研讀了很多研究環(huán)境保護(hù)管理體制的論文和資料,通過(guò)個(gè)案研究、對(duì)比分析等方法,對(duì)我國(guó)環(huán)境管理體制存在問(wèn)題進(jìn)行研究。本文界定了環(huán)境、環(huán)境保護(hù)、環(huán)境保護(hù)管理體制等關(guān)鍵概念的內(nèi)涵,深入分析了各個(gè)概念之間的關(guān)系,分階段簡(jiǎn)述了我國(guó)環(huán)境保護(hù)行政管理體制的產(chǎn)生、發(fā)展過(guò)程,并分析了其顯著特征,介紹了美國(guó)、德國(guó)、日本這三個(gè)具有代表性的國(guó)家環(huán)境保護(hù)行政管理現(xiàn)狀、特點(diǎn)和有益做法,對(duì)比分析了環(huán)境保護(hù)行政管理的共性和優(yōu)點(diǎn),為我國(guó)環(huán)境保護(hù)行政管理體制改革提供一些思路。之后,分析了我國(guó)環(huán)境保護(hù)行政管理體制存在問(wèn)題的表現(xiàn),并對(duì)部分環(huán)保污染事件進(jìn)行實(shí)例分析,如分析內(nèi)蒙古阿拉善盟騰格里工業(yè)園區(qū)環(huán)境污染事件、山東濟(jì)南揚(yáng)塵污染事件等,指出了我國(guó)環(huán)保行政管理體制中依然存在權(quán)責(zé)不清、基層環(huán)保機(jī)構(gòu)缺失、環(huán)保執(zhí)法偏軟、跨區(qū)域環(huán)境糾紛缺乏解決機(jī)制等問(wèn)題,對(duì)這些問(wèn)題產(chǎn)生的原因進(jìn)行了剖析。在根據(jù)國(guó)家最新出臺(tái)的環(huán)境保護(hù)政策,提出完善我國(guó)環(huán)境保護(hù)行政管理體制的對(duì)策,即健全環(huán)境保護(hù)行政管理體制機(jī)制、全面提升環(huán)境保護(hù)的地位和權(quán)威、建立更加廣泛的群眾監(jiān)督參與機(jī)制等等,為我國(guó)環(huán)境保護(hù)工作提供有益的、可資借鑒的辦法和建議。
[Abstract]:Our country environmental protection management system is our country environmental protection work important carrier. However, for a long time, the administrative system of environmental protection has been in a marginalized and weak position, unable to undertake the heavy task of building ecological civilization and building a beautiful China, and failing to fulfil the rights and obligations established by the laws such as the Environmental Protection Law. It has seriously affected the development of environmental protection, formed the situation of our country's environmental protection work with half the effort, frequent pollution incidents, damaged the authority of the law, and destroyed the trust relationship of the public to the government. Therefore, it is a very important work to probe into the problems existing in the administrative system of environmental protection, to analyze the reasons, to find out the countermeasures to solve, and to perfect the administrative system of environmental protection in our country. Based on the background and significance of the topic, this paper studies many papers and materials on environmental protection management system, and studies the existing problems of environmental management system in China through case study, comparative analysis and other methods. This paper defines the connotation of the key concepts such as environment, environmental protection and environmental protection management system, analyzes the relationship among them, and describes the emergence and development process of the administrative system of environmental protection in China in stages. It also analyzes its remarkable characteristics, introduces the current situation, characteristics and beneficial practices of environmental protection administration in three representative countries, the United States, Germany and Japan, and compares and analyzes the commonalities and advantages of environmental protection administration. To provide some ideas for the reform of administrative system of environmental protection in China. After that, the paper analyzes the problems existing in the administrative system of environmental protection in China, and analyzes some environmental pollution incidents, such as the environmental pollution incident in Tenggeri Industrial Park of Alashan League in Inner Mongolia. The dust pollution incident in Jinan, Shandong Province, points out that there are still some problems in the administrative system of environmental protection in China, such as unclear powers and responsibilities, lack of environmental protection institutions at the grass-roots level, soft enforcement of environmental protection laws, lack of mechanisms for resolving cross-regional environmental disputes, etc. The causes of these problems are analyzed. According to the state's latest environmental protection policy, the author puts forward the countermeasures to perfect the administrative system of environmental protection in China, that is, to perfect the system mechanism of environmental protection administration and to promote the status and authority of environmental protection in an all-round way. The establishment of a more extensive mass supervision and participation mechanism will provide useful and useful suggestions for environmental protection in China.
