【摘要】：以水井為代表的公共生活物品治理既是水利社會的組成部分,也是公共事務治理的重要內(nèi)容。在無外力涉入的環(huán)境中,"有—用分置"是水井治理的顯著特征,也是特定范圍內(nèi)公共生活物品實現(xiàn)自主治理的機制。作為治理機制,"有—用分置"的核心是在占有權(quán)、使用權(quán)兩種財產(chǎn)權(quán)利分置的基礎(chǔ)上,通過不同權(quán)利擁有者之間的協(xié)調(diào)合作來實現(xiàn)治理。有—用分置是中國基層社會依據(jù)實際情況自然形成的治理機制,有著廣泛的適用性和認可度,雖然"有—用分置"的公共生活物品治理的實現(xiàn)有一定的前提約束,但這并不影響其對公共物品使用權(quán)的強調(diào)、產(chǎn)權(quán)分置的界定、綜合規(guī)則制度的確立,這對當代基層公共生活物品治理提供了積極的啟示。
[Abstract]:The management of public life goods represented by wells is not only an integral part of water conservancy society, but also an important part of public affairs management.In the environment without external force, "have-use separation" is a remarkable feature of well management, and is also the mechanism of self-governance of public life goods in a specific range.As a governance mechanism, the core of "have-use separation" is to realize governance through coordination and cooperation among different rights holders on the basis of the separation of possession and right of use.As a natural governance mechanism formed in China's grass-roots society according to the actual situation, it has extensive applicability and recognition, although the realization of the governance of public life goods with, using separation has certain preconditions and constraints.However, this does not affect its emphasis on the right to use of public goods, the definition of the separation of property rights, and the establishment of comprehensive rules and systems, which provides a positive inspiration for the governance of public life goods at the grass-roots level.
