我國行政權(quán)力縱向配置研究

【摘要】:國家行政權(quán)力是指國家行政機關(guān)依靠特定的強制手段,為有效執(zhí)行國家意志而依據(jù)憲法原則對全社會進行管理的一種能力,國家行政權(quán)力與立法權(quán)、司法權(quán)是國家權(quán)力的重要組成部分。我國國家行政權(quán)力縱向配置至今仍有許多問題,對此筆者展開研究。本文在研究的過程中,首先采用了文獻資料搜集法,搜集整理了有關(guān)國家行政權(quán)力縱向配置的基本理論和歷史變遷等內(nèi)容,對中國行政區(qū)劃與政府層級的變遷、中央與地方事權(quán)調(diào)整路徑及得失、中央與地方財權(quán)劃分的沿革及評價進行了簡單介紹,為后文的研究奠定了理論基礎(chǔ)。其次,在上述理論基礎(chǔ)上,采用邏輯分析法,歸納總結(jié)了我國國家行政權(quán)縱向配置的制度困境。主要包括:中央權(quán)威不足,地方無約束感;事權(quán)分工不明,權(quán)力配置失衡;權(quán)力配置隨意,模式非制度化;權(quán)力行使混亂,監(jiān)督機制欠缺。在分析這些制度困境的同時,說明了各自產(chǎn)生的原因,從而針對問題及成因,提出了走出困境的基本思路,即行政權(quán)力配置必立足于基本國情;在中央集權(quán)基礎(chǔ)上進行適度分權(quán);集權(quán)與分權(quán)應(yīng)當(dāng)法律化、制度化。最后,本文根據(jù)走出制度困境的基本思路,提出了我國行政權(quán)力縱向配置的具體方案,即:通過現(xiàn)行行政權(quán)力體制的缺陷、國外相關(guān)規(guī)定的比較、我國地方政府層級制度改革設(shè)想三個方面說明行政區(qū)劃與政府層級的重構(gòu);通過中央與地方事權(quán)劃分模式的國際比較與借鑒、我國中央與地方事權(quán)劃分機制的法治化進路說明中央與地方政府間事權(quán)配置法治化;從中央與地方財權(quán)劃分模式的國際比較與借鑒、完善我國中央與地方財權(quán)配置機制的基本構(gòu)想角度說明建立合理的中央與地方財權(quán)配置格局。
[Abstract]:The state administrative power refers to the ability of the state administrative organ to manage the whole society according to the constitutional principles in order to carry out the national will effectively, depending on the specific coercive means, the state administrative power and the legislative power.Judicial power is an important part of state power.There are still many problems in the vertical allocation of state administrative power in China.In the course of the study, this paper firstly adopts the method of literature collection, collects and sorts out the basic theories and historical changes of the vertical distribution of state administrative power, and analyzes the changes of administrative divisions and government levels in China.This paper briefly introduces the adjustment path and gain and loss of central and local authority, the evolution and evaluation of the division of central and local financial power, which lays a theoretical foundation for the later study.Secondly, on the basis of the above theory, this paper summarizes the system dilemma of the vertical allocation of the state administrative power by using the logical analysis method.Mainly includes: the central authority is insufficient, the local does not have the restraint sense; the task power division of labor is not clear, the power disposition is unbalanced; the power disposition is random, the pattern is not institutionalized; the power exercise is chaotic, the supervision mechanism lacks.At the same time, it explains the causes of these system dilemmas, and then puts forward the basic idea of getting out of the predicament, that is, the allocation of administrative power must be based on the basic national conditions.It should be legalized and institutionalized on the basis of centralization.Finally, according to the basic idea of getting out of the predicament of the system, this paper puts forward the concrete scheme of the vertical allocation of the administrative power in our country, that is, through the defects of the current administrative power system, the comparison of the relevant provisions of foreign countries,This paper discusses the reconstruction of administrative divisions and levels of government in three aspects of the reform of the local government hierarchy system in China, compares and draws lessons from the international comparison of the mode of division between central and local authorities.The rule of law of the division mechanism between the central and local governments shows that the allocation of administrative power between the central and local governments is governed by law.The basic conception of perfecting the allocation mechanism of central and local financial power illustrates the establishment of a reasonable pattern of central and local financial power allocation.
