【摘要】：論文構(gòu)建起一個(gè)產(chǎn)權(quán)與治理相融合的理論分析框架,結(jié)合來自中部地區(qū)M縣"三違"現(xiàn)象的案例分析,指出違建現(xiàn)象涌現(xiàn)是地權(quán)分割與基層治理能力弱化共同作用的結(jié)果。一方面,地權(quán)分割為灰色土地市場(chǎng)的興起提供了制度空間,外部利潤(rùn)誘使著利益相關(guān)者持續(xù)地參與違建活動(dòng);另一方面,基層治理能力弱化為地利分配秩序固化創(chuàng)造了行為空間,地方性"謀地精英"控制著違建利益的分配秩序。研究還表明,地權(quán)單元和治理單元的不對(duì)稱是違建現(xiàn)象發(fā)生的制度根源,且地權(quán)單元和治理單元交互地發(fā)揮著作用,這個(gè)綜合的制度互動(dòng)系統(tǒng)塑造了違建活動(dòng)的多元空間。因此,應(yīng)當(dāng)重構(gòu)地權(quán)單元與基層治理單元間的關(guān)系,正視城市化對(duì)集體地權(quán)秩序造成的沖擊,以促進(jìn)地權(quán)漸進(jìn)式發(fā)展與治理變遷的良性互動(dòng)來化解違建治理困境。
[Abstract]:This paper constructs a theoretical analysis framework of property rights and governance, and combines the case study of "three violations" from M County in the central region. It is pointed out that the emergence of illegal construction is the result of the joint action of the division of land rights and the weakening of the basic management ability. On the one hand, the division of land rights provides the institutional space for the rise of the grey land market. External profits induce stakeholders to continue to participate in illegal construction activities; on the other hand, the weak governance capacity of the grassroots creates behavior space by solidifying the distribution order. The local "land elite" controls the distribution order of illegal building benefits. The study also shows that the asymmetry of land ownership unit and governance unit is the institutional root of illegal building phenomenon, and land ownership unit and governance unit play an interactive role. Therefore, the relationship between land ownership unit and grass-roots governance unit should be reconstructed, and the impact of urbanization on collective land ownership order should be faced squarely. In order to promote the gradual development of land rights and governance changes of benign interaction to resolve the plight of illegal building governance.
