【摘要】：當(dāng)前社會公眾對建立健全公務(wù)員申報制度的呼聲愈來愈強烈。本文從財產(chǎn)申報制度的理論基礎(chǔ)及必要性分析入手,以公務(wù)員房產(chǎn)申報作為推進(jìn)公務(wù)員財產(chǎn)申報制度的切入點。本研究運用公共選擇理論和社會契約理論,分析制約我國房產(chǎn)申報制度構(gòu)建與推行的原因。在總結(jié)借鑒國內(nèi)外相關(guān)實踐經(jīng)驗的基礎(chǔ)上,提出推進(jìn)完善我國公務(wù)員房產(chǎn)申報制度的對策和建議。本研究提出,應(yīng)當(dāng)健全房產(chǎn)申報頂層制度設(shè)計,具體界定申報范圍,實行申報有限公開并嚴(yán)格問責(zé)機制。從制度設(shè)計層面健全公務(wù)員房產(chǎn)申報——監(jiān)督——公示——問責(zé)四位一體的申報體系;在路徑選擇方面,提出分階段分步驟施行,先以擬提拔干部作為切入點,在條件成熟基礎(chǔ)上再促成房產(chǎn)申報自上而下全面推廣;應(yīng)盡快完善房產(chǎn)征信的配套設(shè)計工作,依托《不動產(chǎn)登記暫行條例》及金融實名制促進(jìn)房產(chǎn)實名,構(gòu)建以個人身份證號為社會信用保障號碼,同時建立住房金融紀(jì)檢的共享聯(lián)網(wǎng)平臺。通過上述舉措,推進(jìn)我國公務(wù)員房產(chǎn)申報制度的構(gòu)建與完善。
[Abstract]:At present, the public calls for the establishment of a sound civil servant declaration system are becoming more and more intense. This paper begins with the theoretical basis and necessity analysis of the property declaration system. This study uses the theory of public choice and the theory of social contract as the entry point to promote the property declaration system of civil servants. This paper analyzes the reasons that restrict the construction and implementation of the real estate declaration system in China. On the basis of summing up the relevant practical experience at home and abroad, it puts forward the countermeasures and suggestions to promote the improvement of the real estate declaration system of civil servants in China. We should perfect the design of the top floor system of real estate declaration, define the scope of declaration concretely, and implement the limited open and strict accountability mechanism of declaration. From the system design level, we should perfect the declaration system of civil servants' real estate declaration, supervision, publicity and accountability. In the aspect of path selection, it is proposed to implement it in stages and step by step, with the proposed promotion of cadres as the starting point, and then promote the comprehensive promotion of property declaration from top to bottom on the basis of ripe conditions, and improve the supporting design work of real estate credit information as soon as possible. Relying on the interim regulations on Real Estate Registration and the Financial Real name system to promote the real name of real estate, to build a social credit guarantee number based on personal ID number, and to establish a shared networking platform for the discipline inspection of housing finance. To promote the construction and improvement of civil service real estate declaration system in China.
