【摘要】：一直以來,城市管理都是城市化發(fā)展過程中不容忽視的問題之一,也是廣大人民群眾比較關(guān)心的社會問題。最近幾年來,因城市管理不善引發(fā)巨大公共危機(jī)的案例屢見不鮮,不僅損害了群眾根本利益,也對社會和諧穩(wěn)定造成了巨大負(fù)面影響。城市主要功能是改善人民生活質(zhì)量,促進(jìn)生活更加美好。但是隨著我國城市化快速發(fā)展,大量農(nóng)村人口以極快的速度涌進(jìn)城市,許多城市,尤其是北上廣等一線城市早已不堪重負(fù),無法保障市民高品質(zhì)生活服務(wù)。城管是我國社會發(fā)展到一定階段的必然產(chǎn)物,是在我國城市化高速發(fā)展背景下的產(chǎn)物,是社會管理、城市管理的重要組織機(jī)構(gòu)和模式。1996年,國務(wù)院頒布了《中華人民共和國行政處罰法》,各地方政府紛紛啟動了行政處罰權(quán)試點(diǎn)工作,城管部門由此成立并開始發(fā)揮作用。城管的出現(xiàn),是地方政府創(chuàng)新城市管理工作的具體體現(xiàn),由于組建時間較晚,城管部門行政執(zhí)法法律體系不完善、人員素質(zhì)相對偏低,在開展實(shí)際工作中遇到了各種各樣的阻力和困難,并引起了社會的廣泛質(zhì)疑。如何提高城管執(zhí)法水平,促進(jìn)社會管理公平公正,已成為當(dāng)前社會各界廣泛關(guān)注的問題。面對這種現(xiàn)狀,筆者作為北京經(jīng)濟(jì)技術(shù)開發(fā)區(qū)的一名一線城管執(zhí)法工作者,進(jìn)行了深入的思考,并以北京經(jīng)濟(jì)技術(shù)開發(fā)區(qū)城管行政執(zhí)法作為研究對象,對北京經(jīng)濟(jì)技術(shù)開發(fā)區(qū)城管執(zhí)法實(shí)踐中存在的各城市共性問題和北京經(jīng)濟(jì)技術(shù)開發(fā)區(qū)市特有問題,進(jìn)行了深入分析,力求從源頭上找出原因、給出對策,為我國城管執(zhí)法的規(guī)范化做出貢獻(xiàn)。
[Abstract]:Urban management has always been one of the problems that cannot be ignored in the process of urbanization development, and it is also a social issue of concern to the general public. In recent years, there have been many cases of great public crisis caused by poor urban management. It not only damages the fundamental interests of the masses, but also has a huge negative impact on social harmony and stability. The main function of the city is to improve the quality of life of the people and promote a better life. However, with the rapid development of urbanization in China, A large number of rural people are flocking into cities at a very fast speed. Many cities, especially first-tier cities such as going north to Guangzhou, have already been overwhelmed and unable to ensure the high quality of life services for their citizens. Urban management is an inevitable product of the development of our society to a certain stage. It is the product of the rapid development of urbanization in our country, and the important organization and mode of social management and urban management. In 1996, The State Council promulgated the Administrative punishment Law of the people's Republic of China, and various local governments started the pilot work of administrative punishment power one after another. Thus, the urban management department was established and began to play its role. It is the concrete embodiment of the local government's innovative urban management work. Due to the late establishment, the imperfect legal system of urban management administrative law enforcement and the relatively low quality of the personnel, there are various obstacles and difficulties in carrying out the actual work. How to improve the level of urban management law enforcement and promote the fairness and fairness of social management has become a widespread concern of all sectors of society. Faced with this status quo, As a front-line urban management law enforcement worker in the Beijing Economic and technological Development Zone, the author has made a deep thinking, and taken the Beijing Economic and technological Development Zone as the research object. This paper makes a deep analysis of the common problems existing in the practice of urban management law enforcement in Beijing Economic and technological Development Zone and the unique problems in Beijing Economic and technological Development Zone, in order to find out the causes and give the countermeasures from the source. To make contribution to the standardization of urban management law enforcement in our country.
