【摘要】：西藏自治區(qū)地方政府建立和完善權(quán)力清單制度,是推動(dòng)政府依法、全面、正確履行管理職能的一項(xiàng)重要舉措,是全面推進(jìn)依法治藏、全面深化改革的一次有益探索,是實(shí)現(xiàn)地方政府治理能力和治理體系建設(shè)的重要一步。西藏自治區(qū)地方政府認(rèn)真貫徹執(zhí)行了黨中央、國務(wù)院部署的一項(xiàng)重要改革任務(wù),積極推行權(quán)力清單制度,推動(dòng)權(quán)力清單制度落地生效,不斷深化“放管服”等有關(guān)工作,編制自治區(qū)政府權(quán)責(zé)清單、行政權(quán)力運(yùn)行流程圖和服務(wù)指南的配套制度。本文在對現(xiàn)存關(guān)于“權(quán)力清單制度”的文獻(xiàn)進(jìn)行閱讀整理之后,將“治理現(xiàn)代化”作為其視角對民族地區(qū)進(jìn)行分析的文獻(xiàn)較少,故本文將“治理現(xiàn)代化”作為其視角,引入到對“權(quán)力清單”的研究之中。通過對西藏自治區(qū)各廳級(jí)單位的考量,結(jié)合其相關(guān)權(quán)威網(wǎng)站的資料,在對西藏關(guān)于實(shí)施“權(quán)力清單”的相關(guān)情況進(jìn)行調(diào)查之后,其有諸多不足,決定借鑒其他省份關(guān)于實(shí)施“權(quán)力清單制度”的辦法,深入分析自治區(qū)所面臨相關(guān)難題的各種原因,并試圖尋找具有可行性的解決方案:第一章為權(quán)力清單制度的理論和相關(guān)概念界定。本章分兩個(gè)部分:第一部分為相關(guān)概念界定,界定了善治、國家治理能力現(xiàn)代化、權(quán)力清單以及權(quán)力清單制度四個(gè)概念。第二部分為相關(guān)理論介紹,主要為權(quán)力制約理論、善治理論、政府再造理論,介紹權(quán)力清單制度實(shí)施的理論基礎(chǔ)。第二章為西藏自治區(qū)政府推行權(quán)力清單制度的背景和取得的成就。首先分析我國中央政府和地方政府推行權(quán)力清單制度的社會(huì)背景,主要是從推進(jìn)國家治理現(xiàn)代化和地方政府治理現(xiàn)代化的迫切任務(wù),社會(huì)活力亟需進(jìn)一步激發(fā)的改革訴求,人民對透明高效、清廉政府的強(qiáng)烈期盼和電子信息化浪潮的沖擊等四個(gè)方面提出,中央政府和地方政府需要推行權(quán)力清單制度的社會(huì)背景。其次介紹了西藏自治區(qū)地方政府在推行權(quán)力清單制度中取得的成就,主要從涉及范圍廣,落實(shí)程度深,重視程度高,規(guī)范了公共資源交易,壓縮了權(quán)力尋租空間和權(quán)力公開化,突出政府的陽光行政等五個(gè)方面來說西藏自治區(qū)地方政府推行權(quán)力清單制度所取得成就。第三章為西藏自治區(qū)在推行權(quán)力清單制度中面臨問題的原因分析。從權(quán)力清單制度缺乏法律約束,行政體制約束,運(yùn)行的環(huán)境不完善以及監(jiān)督機(jī)制不健全等四個(gè)大方面來分析西藏自治區(qū)在推行權(quán)力清單制度中面臨的問題。第四章為西藏自治區(qū)政府在推行權(quán)力清單制度中的對策和建議。從政府層面、市場層面、社會(huì)層面和法律層面四個(gè)層面來提出有針對性的對策建議,來促進(jìn)西藏自治區(qū)權(quán)力清單制度的實(shí)施,加快西藏自治區(qū)政府治理能力現(xiàn)代化的建設(shè)。本文認(rèn)為,推行西藏自治區(qū)權(quán)力清單制度建設(shè),雖然還存在很多問題,還有很多路要走,但是依靠“老西藏精神”,發(fā)揚(yáng)吃苦、忍耐、團(tuán)結(jié)、奉獻(xiàn)的老西藏精神,任何問題就會(huì)迎刃而解、柳暗花明。西藏自治區(qū)各行政職能部門要確實(shí)做好行政權(quán)力清單的制定和實(shí)施,做到權(quán)力可執(zhí)行、可監(jiān)督、可問責(zé),解決各行政職能部門不作為、懶政、怠政等問題,建設(shè)成人民滿意、信任的政府。
