【摘要】：2016年11月7日,《中華人民共和國(guó)網(wǎng)絡(luò)安全法》由全國(guó)人大常委會(huì)審議通過(guò)并發(fā)布。作為我國(guó)網(wǎng)絡(luò)安全領(lǐng)域的基礎(chǔ)性法律,《網(wǎng)絡(luò)安全法》充分體現(xiàn)了信息化發(fā)展與網(wǎng)絡(luò)安全并重的安全發(fā)展觀,突出的亮點(diǎn)是:確立了網(wǎng)絡(luò)空間主權(quán)原則、明確了重要數(shù)據(jù)的本地化儲(chǔ)存、強(qiáng)化了對(duì)個(gè)人信息的保護(hù)、確定了網(wǎng)絡(luò)安全人才培養(yǎng)制度、提出了關(guān)鍵信息基礎(chǔ)設(shè)施的安全保護(hù)及其范圍,尤其是針對(duì)當(dāng)前通訊信息詐騙等新型網(wǎng)絡(luò)違法犯罪的多發(fā)態(tài)勢(shì),增加了懲治網(wǎng)絡(luò)詐騙等新型網(wǎng)絡(luò)違法犯罪活動(dòng)的規(guī)定,《網(wǎng)絡(luò)安全法》具有整體性、協(xié)調(diào)性、穩(wěn)定性和可操作性等特征,是我國(guó)應(yīng)對(duì)國(guó)際網(wǎng)絡(luò)安全挑戰(zhàn)、維護(hù)網(wǎng)絡(luò)空間主權(quán)、保障公民網(wǎng)絡(luò)空間的合法權(quán)益不受侵害、保障國(guó)家安全的利器,為全球互聯(lián)網(wǎng)的治理貢獻(xiàn)了中國(guó)智慧。
[Abstract]:On November 7, 2016, the Internet Security Law of the people's Republic of China was passed and promulgated by the standing Committee of the National people's Congress. As the basic law in the field of network security in our country, the Law of Network Security fully embodies the concept of security development, which lays equal stress on the development of information technology and network security. The outstanding highlights are the establishment of the principle of sovereignty over cyberspace. This paper clarifies the localization storage of important data, strengthens the protection of personal information, determines the network security personnel training system, and puts forward the security protection and scope of the key information infrastructure. In particular, in view of the current situation of new types of network illegal crimes such as communication information fraud and other new types of network crimes, provisions have been added to punish new types of network illegal criminal activities, such as network scams. The Network Security Law has integrity and coordination. The characteristics of stability and maneuverability are a powerful weapon for our country to meet the challenges of international network security, to safeguard the sovereignty of cyberspace, to protect the legitimate rights and interests of citizens in cyberspace, and to safeguard national security. For the global Internet governance contributed to China's wisdom.
