政府項目代建制合同管理體系研究

【摘要】:代建制是一種新型的項目管理制度是隨著投資體制的變化和建設(shè)工程發(fā)展的不同階段而形成的。作為項目管理發(fā)展的主要問題,為了使代建單位替代政府部門更全面的管理工程項目,維護雙方各自利益代建制模式下建設(shè)工程合同的地位越來越突出。從1997年青島市開始推行代建制,2003年對兩個政府投資項目進行試點。2004年前后,對政府投資工程項目出現(xiàn)的腐敗問題,如“三超現(xiàn)象”和損失浪費問題起到了積極的作用。代建制在建設(shè)項目的管理中已經(jīng)獲得了一定成效,但到目前為止仍然存在很多問題。這些問題主要因為缺乏對稱性信息和影響工程的風(fēng)險性因素導(dǎo)致的政府項目代建制合同操作執(zhí)行方面。由于沒有出臺正式的代建項目合同示范文本導(dǎo)致代建制的優(yōu)勢不能充分發(fā)揮。因此,從理論與實踐結(jié)合的角度探討代建項目管理以及合同管理中存在的缺陷,通過改進得出政府投資項目的代建單位建立的合同管理體系的目標(biāo)是“項目公司利益最大化”。本文的主要研究內(nèi)容如下:(1)參考中外文獻,研究代建制合同管理的研究背景,探討政府項目代建合同管理的必要性。(2)政府代建項目管理模式概論。本章主要研究內(nèi)容包含兩部分首先第一節(jié)描述建設(shè)工程的代建管理,簡單闡述了代建制建設(shè)模式在我國的合法性、實際運作模式以及代建建設(shè)模式的發(fā)展,第二節(jié)合同理論介紹從各個不同的角度比如項目承包人,監(jiān)理工程師等角度討論代建工程合同管理,以及合同管理的價值。(3)代建工程項目合同管理組織形式研究。簡要介紹工程合同管理機制、代建項目合同管理中涉及的主要參與方、政府投資項目代建方的主要工作內(nèi)容,接下來分析工程項目合同管理存在的問題,并簡要說明合同管理體系建立的必要性及體系設(shè)計的原則。(4)政府投資代建項目合同管理體系評價。本部分內(nèi)容從代建公司的角度出發(fā),從代建制模式下合同主體選擇、合同管理模式及內(nèi)容、合同管理體系的組織保障等方面為出發(fā)點,希望建立能實現(xiàn)利益最大化的代建項目合同管理體系并結(jié)合工程實例分析評價代建合同管理效果、代建方業(yè)績的模糊綜合評判。
[Abstract]:Agent system is a new type of project management system which is formed with the change of investment system and the different stages of construction project development. As the main problem in the development of project management, in order to replace the government departments with more comprehensive management of the project, the status of the construction contract is becoming more and more prominent. From 1997, Qingdao began to carry out agent construction system, and in 2003, two government investment projects were tested. Around 2004, it played a positive role in the problems of corruption, such as "three superfluous phenomenon" and loss and waste, which appeared in government investment projects. Agent system has achieved some results in the management of construction projects, but there are still many problems up to now. These problems are mainly caused by the lack of symmetrical information and the risk factors affecting the project. Due to the absence of a formal contract model text, the advantages of the agency system can not be brought into full play. Therefore, from the angle of combining theory and practice, this paper discusses the defects in the management of agent construction project and contract management, and by improving the contract management system established by the agent of government investment project, it is concluded that the goal of the contract management system established by the government investment project agent is "maximization of the benefit of the project company". The main research contents of this paper are as follows: 1) referring to Chinese and foreign literature, this paper studies the research background of contract management of agent construction system, and discusses the necessity of contract management for government projects. The main contents of this chapter include two parts: the first section describes the construction management of the construction project, briefly expounds the legitimacy of the agent construction mode in our country, the actual operation model and the development of the agent construction mode. The second section introduces contract theory from different angles, such as project contractor, supervision engineer and so on, discusses the contract management of agency project, and the value of contract management. This paper briefly introduces the project contract management mechanism, the main participants involved in the contract management of the construction project, the main work content of the government investment project agent, and then analyzes the problems existing in the project contract management. The necessity of establishing contract management system and the principle of system design. This part starts from the perspective of the agent construction company, starting from the selection of the contract subject, the contract management model and the content, the organizational guarantee of the contract management system, etc. The author hopes to establish the contract management system of the agent construction project which can realize the maximum benefit, and to analyze and evaluate the effect of the contract management and the performance of the agent with the example of the project.
