海峽兩岸工程監(jiān)理制度比較研究

【摘要】:隨著海峽兩岸之間的合作與交流越來越緊密,建設(shè)工程領(lǐng)域的合作也逐步加深。2013年兩岸簽署的《海峽兩岸服務(wù)貿(mào)易協(xié)議》中規(guī)定,大陸企業(yè)可以以合資形式在臺灣地區(qū)從事工程服務(wù)。同時大陸地區(qū)允許臺灣企業(yè)以同樣的方式在大陸投標(biāo)工程,而且還允許臺灣地區(qū)具有相應(yīng)條件的工程技術(shù)人員報考監(jiān)理工程師考試,并可以在福建省注冊執(zhí)業(yè)。基于此背景,本文通過運用比較研究和文獻研究的方法對兩岸工程監(jiān)理制度進行比較分析,不僅能為大陸工程監(jiān)理的改革提供合理建議和措施,而且還可以為未來兩岸工程監(jiān)理領(lǐng)域的合作與交流提供理論基礎(chǔ)。首先,闡述了文章的研究背景,回顧和總結(jié)目前現(xiàn)有的研究成果,提出文章研究的切入點。梳理和總結(jié)海峽兩岸工程監(jiān)理制度的起源和發(fā)展,為后續(xù)的監(jiān)理制度內(nèi)容的比較提供理論基礎(chǔ),同時限定比較范圍。其次,通過運用比較研究法對工程監(jiān)理的法律制度、監(jiān)理的模式和行業(yè)監(jiān)管模式進行比較分析,得出兩岸在工程監(jiān)理法律制度的構(gòu)建層面,二者的立法基礎(chǔ)相差將近三十年,從而導(dǎo)致二者在法律的完備性方面存在差距。特別是關(guān)于監(jiān)理從業(yè)人員的法律體系構(gòu)建,大陸目前只有住建部層面的管理辦法,而反觀臺灣地區(qū),則有建筑師法、技師法等不同層級的體系。兩岸監(jiān)理模式的不同導(dǎo)致了監(jiān)理內(nèi)容、方式、取費標(biāo)準(zhǔn)等都不同。在行業(yè)監(jiān)管方面,臺灣地區(qū)政府部門和行業(yè)協(xié)會分工明確,構(gòu)建了事前、事中、事后全過程的監(jiān)管體系,大陸地區(qū)則著重于事前的監(jiān)管,事中和事后的監(jiān)管力量還比較薄弱。最后,在法律制度、監(jiān)理模式和行業(yè)監(jiān)管模式三個層面的比較分析基礎(chǔ)上,總結(jié)臺灣地區(qū)工程監(jiān)理制度的成熟做法,結(jié)合大陸工程監(jiān)理的特殊性,提出了大陸應(yīng)該從完善法律法規(guī)體系,出臺監(jiān)理工程師管理條例、拓寬工程監(jiān)理的范圍、強化監(jiān)理執(zhí)業(yè)行為的監(jiān)管、推行監(jiān)理服務(wù)滿意度評價、試行監(jiān)理工程師執(zhí)業(yè)年度考核制度、鼓勵監(jiān)理企業(yè)和人員加入行業(yè)協(xié)會等方面改進工程監(jiān)理制度。
[Abstract]:With the closer and closer cooperation and exchanges between the two sides of the Taiwan Strait, cooperation in the field of construction projects has gradually deepened. The "Agreement on Cross-Strait Services Trade" signed by the two sides of the Taiwan Strait in 2013 stipulates that Mainland enterprises may engage in engineering services in Taiwan in the form of joint ventures. At the same time, Taiwan enterprises are allowed to bid for projects in the mainland in the same way, and engineering technicians with corresponding conditions in Taiwan are also allowed to apply for the examination of supervisory engineers, and can register and practise in Fujian Province. Based on this background, this paper makes a comparative analysis of the cross-straits engineering supervision system by means of comparative study and literature study, which can not only provide reasonable suggestions and measures for the reform of engineering supervision in mainland China. It can also provide the theoretical basis for the cooperation and exchange in the field of project supervision. Firstly, the research background of the paper is expounded, and the current research results are reviewed and summarized, and the breakthrough point of the research is put forward. Combing and summing up the origin and development of the engineering supervision system on both sides of the Taiwan Strait, this paper provides a theoretical basis for the comparison of the contents of the subsequent supervision system and limits the scope of comparison at the same time. Secondly, through the comparative analysis of the legal system of engineering supervision, the mode of supervision and the mode of industry supervision, the author draws a conclusion that the legislative basis of the two sides is nearly thirty years different from that of the construction of the legal system of engineering supervision. As a result, there is a gap between the two in the completeness of the law. Especially with regard to the construction of legal system for supervisors, the mainland only has the management methods at the level of residence and construction at present, while in Taiwan, there are systems of different levels such as architect's law and technician's law. The different supervision modes of both sides of the strait lead to different supervision contents, ways and standards. In the aspect of industry supervision, the division of labor between government departments and trade associations in Taiwan is clear, and the supervision system of the whole process of pre-incident, in-process and post-event has been constructed, while in mainland China the supervision is focused on the prior supervision, and the power of supervision in the event and after the event is still relatively weak. Finally, on the basis of comparative analysis of legal system, supervision mode and industry supervision model, this paper summarizes the mature practices of engineering supervision system in Taiwan, and combines the particularity of engineering supervision in mainland China. It is put forward that the mainland should improve the system of laws and regulations, introduce the management regulations of supervision engineers, widen the scope of engineering supervision, strengthen the supervision of supervision practice, and carry out the evaluation of supervision service satisfaction. To try out the annual examination system for supervision engineers and encourage supervision enterprises and personnel to join trade associations to improve engineering supervision system.
