【摘要】：政府采購在不同的國家具有不同的采購方式，，單一來源采購則是較為普遍也是較為特殊的一種。其普遍性在于在多個(gè)國家、地區(qū)和國際組織的政府采購法律中均有提及，特殊性則主要表現(xiàn)在與其他采購方式相比其缺乏競爭的方面，我國《政府采購法》規(guī)定了六種采購方式，單一來源采購就是其中之一。隨著我國政府采購范圍和規(guī)模的不斷擴(kuò)大，單一來源采購使用的財(cái)政資金的數(shù)額也不斷增長，為提高財(cái)政資金的使用效益、確保政府采購行為的規(guī)范運(yùn)行，建立一套完善的單一來源采購制度體系就顯得尤為重要。本文綜合運(yùn)用文獻(xiàn)法、案例研究法和比較分析法對我國單一來源采購制度做出研究。 通過對現(xiàn)行單一來源采購制度的理論研究，結(jié)合作者在政府采購管理部門的工作實(shí)踐，提出我國現(xiàn)行單一來源采購制度在執(zhí)行中在以下四個(gè)方面存在突出問題：（1）違規(guī)選取單一來源采購方式頻發(fā)；（2）部分采購項(xiàng)目違背公平公正原則；（3）采購流程不統(tǒng)一；（4）部分采購人采用違規(guī)手段變相達(dá)成單一來源采購目的。并針對性的從三個(gè)方面分析了導(dǎo)致以上問題出現(xiàn)的制度成因：（1）法律體系不健全；（2）制度約束力較低；（3）政府采購監(jiān)管部門監(jiān)管不力。 在提出問題、分析問題成因的基礎(chǔ)上，借鑒國外單一來源采購制度設(shè)計(jì)及運(yùn)行情況，文章提出了對我國單一來源采購制度的改進(jìn)建議：（1）規(guī)范單一來源采購方式的適用范圍和適用條件；（2）細(xì)化采購流程規(guī)定；（3）加強(qiáng)監(jiān)督和責(zé)任追究機(jī)制，并在此基礎(chǔ)上通過一系列的配套措施將制度體系設(shè)計(jì)的更加完善、有效。
[Abstract]:Government procurement has different procurement methods in different countries, and single source procurement is more common and special. Its universality lies in the fact that it is mentioned in the government procurement laws of many countries, regions and international organizations, while the particularity is mainly manifested in the lack of competition compared with other procurement methods. The Government Procurement Law of our country stipulates six kinds of procurement methods, one of which is single source procurement. With the continuous expansion of the scope and scale of government procurement in our country, the amount of financial funds used in single-source procurement is also increasing. In order to improve the efficiency of the use of financial funds and ensure the standardized operation of government procurement behavior, it is particularly important to establish a perfect single-source procurement system. In this paper, literature method, case study method and comparative analysis method are used to study the single source procurement system in China. Through the theoretical study of the current single-source procurement system, combined with the author's working practice in the government procurement management department, this paper puts forward that there are four outstanding problems in the implementation of the current single-source procurement system in China: (1) illegal selection of single-source procurement methods frequently; (2) some procurement items violate the principle of fairness and fairness; (3) the procurement process is not unified; (4) some purchasers use illegal means to achieve the purpose of single-source procurement in disguised form. It also analyzes the institutional causes of the above problems from three aspects: (1) the legal system is not perfect; (2) the institutional binding force is low; (3) the supervision of government procurement supervision departments is weak. On the basis of putting forward the problems and analyzing the causes of the problems, and drawing lessons from the design and operation of the single source procurement system in foreign countries, this paper puts forward some suggestions for the improvement of the single source procurement system in China: (1) standardizing the applicable scope and conditions of the single source procurement mode; (2) refining the provisions of the procurement process; (3) strengthen the mechanism of supervision and accountability, and on this basis, through a series of supporting measures, the system design will be more perfect and effective.
