【摘要】：公私合作制在我國(guó)已有20余年的發(fā)展歷史,近年來,由于地方政府財(cái)政困局頻出,它作為一種有效的融資渠道再度進(jìn)入公眾視野,各地公私合作項(xiàng)目頻繁上馬,中央也制定了大量規(guī)范性法律文件對(duì)其進(jìn)行規(guī)制。但我們對(duì)公私合作制的認(rèn)識(shí)不能僅停留在融資渠道這一淺層次上,應(yīng)當(dāng)看到其背后的制度供給。公私合作制一方面是我國(guó)推進(jìn)混合所有制改革的重要途徑;另一方面,公私合作制也是推進(jìn)社會(huì)治理現(xiàn)代化的重要契機(jī)。在有了理論認(rèn)識(shí)之后,在實(shí)踐操作中,我們需將公私合作制改革納入法治運(yùn)行軌道,廓清政府、民間資本與民眾在項(xiàng)目建設(shè)過程中的權(quán)利與義務(wù)關(guān)系,完善監(jiān)督,使之成為我國(guó)社會(huì)發(fā)展的推動(dòng)力量。
[Abstract]:Public-private cooperative system has been developing for more than 20 years in our country. In recent years, as a kind of effective financing channel, the local government financial difficulties frequently come into the public view, and the public-private cooperation projects in various places are frequently launched. The central government has also formulated a large number of normative legal documents to regulate them. However, our understanding of public-private cooperation system should not only stay on the superficial level of financing channels, but also the institutional supply behind it. On the one hand, the public-private cooperative system is an important way to promote the reform of mixed ownership in China; on the other hand, the public-private cooperative system is also an important opportunity to promote the modernization of social governance. After the theoretical understanding, in practice, we need to bring the reform of public-private cooperation system into the track of rule by law, clarify the relationship between the government, private capital and the public in the process of project construction, and improve supervision. Make it become the driving force of our country's social development.
