【摘要】：我國信托業(yè)自1979年恢復以來，，由于監(jiān)管體系的失衡、信托理念的錯位、法規(guī)制度建設(shè)滯后、服務體系配套缺失和信托業(yè)內(nèi)部風險控制體系不足，使得我國信托監(jiān)管陷入“發(fā)展—混亂—整頓—再發(fā)展—再混亂—再整頓”的“怪圈”，因此，我國信托業(yè)的這種狀況說明完善信托市場監(jiān)管制度的必然性和必要性，充分發(fā)揮信托市場的功能，保證其穩(wěn)定持續(xù)的發(fā)展。事實證明，信托市場作為我國金融市場的必要組成部分，國家對其調(diào)整效果與其在我國國民經(jīng)濟發(fā)展中的作用發(fā)揮息息相關(guān)，特別是中國加入世貿(mào)以后，信托業(yè)將與其他的金融業(yè)也一樣面臨著外資進入的嚴峻挑戰(zhàn)。本文正是基于這一背景而展開研究，探究出一條適應于我國國情的信托市場監(jiān)管制度，促進信托業(yè)穩(wěn)健發(fā)展，完善我國的資本市場。 本文共分五章。第一章主要介紹選題意義和目的，國內(nèi)外研究現(xiàn)狀；第二章主要介紹了信托監(jiān)管理論，給予了信托監(jiān)管概念界定，闡述了信托業(yè)監(jiān)管的從經(jīng)濟學和法學角度論述了監(jiān)管必要性；第三章講述了我國信托業(yè)監(jiān)管的發(fā)展史，及其此過程中所存在的問題；第四章介紹了發(fā)達國家的信托業(yè)監(jiān)管模式和特點及其對我國的借鑒意義；第五章主要介紹完善我國信托市場監(jiān)管制度的具體建議和措施。
[Abstract]:Since the restoration of the trust industry in China in 1979, due to the imbalance of the supervision system, the dislocation of the trust concept, the lagging of the legal system construction, the lack of supporting service system and the insufficiency of the internal risk control system of the trust industry, The trust supervision of our country falls into the "strange circle" of "development-chaos, rectifying, redeveloping, rearranging". Therefore, this situation of trust industry in our country shows the inevitability and necessity of perfecting the supervision system of trust market. Give full play to the functions of the trust market to ensure its stable and sustainable development. Facts have proved that the trust market, as a necessary part of our financial market, is closely related to the effect of adjustment by the state in the development of our national economy, especially after China's accession to the WTO. The trust industry will face the same challenges as other financial sectors. Based on this background, this paper explores a trust market supervision system suitable for the situation of our country, promotes the steady development of the trust industry, and consummates the capital market of our country. This paper is divided into five chapters. The first chapter mainly introduces the significance and purpose of the topic, the current research situation at home and abroad, the second chapter mainly introduces the theory of trust supervision, defines the concept of trust supervision, and expounds the necessity of supervision from the angle of economics and law. The third chapter describes the history of the supervision of trust industry in China and the existing problems in the process, the fourth chapter introduces the model and characteristics of the trust industry supervision in developed countries and its reference significance to our country. The fifth chapter mainly introduces the concrete suggestions and measures to perfect the supervision system of trust market in our country.
