【摘要】：典當(dāng)是以特定物品或者財產(chǎn)權(quán)利質(zhì)押的形式，向典當(dāng)機(jī)構(gòu)借貸的特殊融資方式。其本質(zhì)特征和運(yùn)作模式是以物換錢。作為一種方便快捷的融資方式，典當(dāng)是其他融資方式的有力補(bǔ)充，并有自己獨(dú)特的比較優(yōu)勢。雖然典當(dāng)業(yè)與銀行業(yè)存在著一定的區(qū)別，但它對拓寬融資渠道、發(fā)展社會經(jīng)濟(jì)、方便人民生活、穩(wěn)定社會秩序，，仍具有十分重要的作用。在我國，自典當(dāng)業(yè)復(fù)出以來，整個經(jīng)濟(jì)環(huán)境和社會環(huán)境都發(fā)生了巨大的變化，對典當(dāng)業(yè)的生存和發(fā)展提出了嚴(yán)峻的挑戰(zhàn)。 本論文由引言、正文和結(jié)論三個部分組成，其中正文部分又由四個章節(jié)組成。 第一章節(jié)對典當(dāng)業(yè)發(fā)展進(jìn)行了概述，并對我國典當(dāng)業(yè)發(fā)展中存在的問題進(jìn)行了分析。首先介紹了典當(dāng)?shù)幕径x和基本運(yùn)作流程，并將典當(dāng)業(yè)與銀行業(yè)進(jìn)行了簡單比較；其次闡述了典當(dāng)業(yè)發(fā)展的社會需要，以形成對典當(dāng)業(yè)較為清晰的了解和認(rèn)識；最后總結(jié)歸納并分析了我國典當(dāng)業(yè)發(fā)展中存在的問題，如觀念存在偏見、專業(yè)人才匱乏、行業(yè)屬性不清等。 第二章節(jié)對典當(dāng)業(yè)的監(jiān)管制度基礎(chǔ)進(jìn)行了分析。首先分析了典當(dāng)業(yè)的金融業(yè)屬性及監(jiān)管必要性，如立法制度不完善、重要制度缺失、監(jiān)管體制不健全等。其次通過三個案例分析，闡述了典當(dāng)業(yè)的風(fēng)險與監(jiān)管，主要是市場風(fēng)險與操作風(fēng)險。最后介紹了我國現(xiàn)有的不同監(jiān)管主體監(jiān)管時期的典當(dāng)業(yè)監(jiān)管制度。 第三章節(jié)探討了境外典當(dāng)業(yè)的先進(jìn)監(jiān)管制度。主要闡述了世界典當(dāng)業(yè)發(fā)達(dá)國家如美國、英國、日本等國的立法及運(yùn)行中的監(jiān)管制度，分析了其成功發(fā)展的經(jīng)驗，如良好的法律法規(guī)環(huán)境、嚴(yán)格的市場準(zhǔn)入條件、合理的絕當(dāng)處理制度及健全的監(jiān)管體系等，以便為我國典當(dāng)業(yè)的持續(xù)健康發(fā)展提供借鑒。 第四章節(jié)在前文分析、概括和整理的基礎(chǔ)上，針對目前我國典當(dāng)業(yè)存在的問題，借鑒國外先進(jìn)經(jīng)驗，提出了健全我國監(jiān)管制度的措施，如完善法律法規(guī)，建立和細(xì)化市場準(zhǔn)入和退出制度，規(guī)定善意收贓制度，健全監(jiān)管體系等，以期能完善外部環(huán)境和促進(jìn)自身改革，從而推動我國典當(dāng)業(yè)的健康、規(guī)范發(fā)展，進(jìn)而促進(jìn)整個社會經(jīng)濟(jì)的發(fā)展。
[Abstract]:Pawnbroking is a special financing way to the pawnbroking institution in the form of the pledge of specific goods or property rights. Its essential features and operating modes are to exchange money. As a convenient and quick financing way, Pawnbroking is a powerful supplement to other financing ways, and has its own unique comparative advantage. Although pawnbroking and Banking exist There are certain differences, but it still plays a very important role in widening the financing channels, developing the social economy, facilitating the people's living and stabilizing the social order. Since the recovery of the pawnbroking industry, the whole economic environment and social environment have undergone tremendous changes and put forward a severe challenge to the survival and development of the canon industry.
This thesis is composed of three parts: introduction, text and conclusion. The body part consists of four chapters.
The first chapter summarizes the development of pawnbroking industry and analyzes the problems in the development of pawnbroking industry in China. First, it introduces the basic definition and basic operation process of pawnbroking, and compares the pawnbroking industry with the banking industry. Secondly, it expounds the social needs of the pawnbroking industry in order to form a clearer to pawnbroking industry. In the end, we summarize and analyze the problems in the development of our pawnbroking industry, such as prejudice, lack of professional talents, and unclear industry attributes.
The second chapter analyses the basis of the regulatory system of pawnbroking industry. First, it analyzes the financial property of pawnbroking industry and the necessity of supervision, such as imperfect legislative system, lack of important system, unsound supervision system and so on. Secondly, through three cases analysis, it expounds the risk and supervision of pawnbroking, mainly the market risk and operation risk. After that, it introduces the supervision system of pawnbroking in different regulatory subjects in China.
The third chapter discusses the advanced regulatory system of the overseas pawnbroking industry. It mainly expounds the regulatory system in the legislation and operation of the developed countries such as the United States, Britain and Japan, such as the United States, the United Kingdom and Japan, and analyzes its successful development experience, such as good legal and regulatory environment, strict market access conditions, reasonable handling system and sound. Supervision system, etc., in order to provide reference for the sustainable and healthy development of China's pawnbroking industry.
In the fourth chapter, on the basis of the previous analysis, summary and collation, in view of the existing problems of the pawnbroking industry in our country and drawing on the advanced experience of foreign countries, we put forward the measures to improve the supervision system of our country, such as perfecting the laws and regulations, establishing and refining the system of market access and withdrawal, and stipulating that the system of good and meaning collection of stolen goods, and the perfect supervision system, in order to perfect the outside world. In order to promote the health and standard development of China's pawnbroking industry and promote the development of the whole society and economy, the Ministry's environment and its own reform are promoted.
