中國(guó)第三方支付有效監(jiān)管研究

【摘要】:支付體系是現(xiàn)代市場(chǎng)經(jīng)濟(jì)和金融活動(dòng)的核心基礎(chǔ)設(shè)施。安全高效的支付體系是經(jīng)濟(jì)金融持續(xù)健康發(fā)展的重要保障。近十年來(lái),我國(guó)第三方支付呈現(xiàn)持續(xù)、快速發(fā)展的趨勢(shì),其業(yè)務(wù)規(guī)模、涉及領(lǐng)域不斷擴(kuò)大;第三方支付與經(jīng)濟(jì)金融活動(dòng)的聯(lián)系日益緊密,在我國(guó)支付體系中的重要性日益增強(qiáng)。在此背景下,本文在系統(tǒng)剖析我國(guó)第三方支付發(fā)展及監(jiān)管現(xiàn)狀的基礎(chǔ)上,基于“市場(chǎng)失靈”理論,論述了對(duì)第三方支付實(shí)施監(jiān)管的必要性,并以建立有效監(jiān)管機(jī)制為目標(biāo),通過(guò)借鑒國(guó)外先進(jìn)監(jiān)管經(jīng)驗(yàn),從有效監(jiān)管的基本準(zhǔn)則、監(jiān)管框架以及監(jiān)管指標(biāo)等方面著手,深入分析和精心設(shè)計(jì)了適應(yīng)我國(guó)國(guó)情的第三方支付有效監(jiān)管體系,圍繞第三方支付有效監(jiān)管的理論支撐和實(shí)踐路徑進(jìn)行了全面、系統(tǒng)的研究。主要結(jié)論包括:(1)針對(duì)不同類型第三方支付機(jī)構(gòu)及其創(chuàng)新產(chǎn)品帶來(lái)的認(rèn)知滯后和風(fēng)險(xiǎn)邊界判斷困難,應(yīng)以原則性監(jiān)管為基礎(chǔ),差異性監(jiān)管為手段,及時(shí)、動(dòng)態(tài)調(diào)整為策略,以求達(dá)到維持市場(chǎng)穩(wěn)定和平衡各方利益的有效監(jiān)管目標(biāo);(2)構(gòu)建我國(guó)第三方支付的有效監(jiān)管框架需要多維度、綜合性地考慮組織架構(gòu)、監(jiān)管內(nèi)容、監(jiān)管環(huán)節(jié)、監(jiān)管方式、監(jiān)管措施、監(jiān)管手段等因素;(3)現(xiàn)階段第三方支付的有效監(jiān)管應(yīng)盡快建立起以客戶備付金安全為核心,涉及第三方支付機(jī)構(gòu)流動(dòng)性、償付能力、收益能力、交易安全、損失彌補(bǔ)等多方面內(nèi)容的衡量、預(yù)警、提示性的監(jiān)測(cè)指標(biāo)體系,并設(shè)計(jì)了20余種具體監(jiān)測(cè)指標(biāo)。 與此前我國(guó)第三方支付監(jiān)管的研究成果相比,本文在分析第三方支付發(fā)展歷程、存在問(wèn)題及監(jiān)管必要性的基礎(chǔ)上,采用了從抽象到具體、定性分析與定量分析相結(jié)合、規(guī)范分析與模型分析相結(jié)合、歸納與演繹比較、歷史與現(xiàn)實(shí)相結(jié)合等多種研究方法,從理論和實(shí)踐兩方面,較為全面、系統(tǒng)地對(duì)構(gòu)建一個(gè)完整的第三方支付市場(chǎng)監(jiān)管體系進(jìn)行了分析與設(shè)計(jì)。本文的特色和創(chuàng)新主要包括以下方面: (1)按照理論與實(shí)務(wù)并重的思路,緊密圍繞相關(guān)制度經(jīng)濟(jì)學(xué)、西方經(jīng)濟(jì)學(xué)理論,以指導(dǎo)實(shí)際監(jiān)管工作為目標(biāo),從基本準(zhǔn)則、總體框架和監(jiān)管指標(biāo)等多個(gè)方面,首次綜合性、系統(tǒng)性地分析和闡述了適用于我國(guó)的第三方支付監(jiān)管體系。 (2)在深入分析、把握第三方支付發(fā)展規(guī)律的基礎(chǔ)上,結(jié)合“市場(chǎng)失靈”理論,剖析了第三方支付“市場(chǎng)失靈”的四大來(lái)源:公共品、外部性、壟斷和不完全競(jìng)爭(zhēng),并以外部性為例,詳細(xì)闡述了對(duì)第三方支付實(shí)施有效監(jiān)管的必要性。 (3)詳細(xì)回顧了第三方支付產(chǎn)生、發(fā)展歷程,全面介紹了第三方支付各類業(yè)務(wù)模式及存在的風(fēng)險(xiǎn)點(diǎn),深入比較了國(guó)外第三方支付監(jiān)管的基本模式與有益經(jīng)驗(yàn)。本文結(jié)合我國(guó)第三方支付發(fā)展現(xiàn)狀,就實(shí)施有效監(jiān)管進(jìn)行深入剖析,明確提出了有效監(jiān)管的監(jiān)管理念,并對(duì)有效監(jiān)管的監(jiān)管強(qiáng)度、監(jiān)管重心和監(jiān)管目標(biāo)進(jìn)行了分析,從理論層面提出了第三方支付有效監(jiān)管的可行條件和實(shí)現(xiàn)條件。 (4)初步構(gòu)建了我國(guó)第三方支付有效監(jiān)管的基本準(zhǔn)則、總體框架和基本機(jī)制。本文運(yùn)用博弈論方法分析了第三方支付有效監(jiān)管的基本準(zhǔn)則。本文所設(shè)計(jì)的第三方支付監(jiān)管框架適應(yīng)國(guó)情,立足于現(xiàn)階段第三方支付產(chǎn)業(yè)監(jiān)管的實(shí)際情況,對(duì)建立和優(yōu)化我國(guó)第三方支付監(jiān)管體系具有一定的理論和實(shí)踐指導(dǎo)意義。本文提出并分析了以中央銀行法定監(jiān)管為主,商業(yè)銀行協(xié)作監(jiān)督為輔,外部監(jiān)督和內(nèi)部自律相結(jié)合的第三方支付監(jiān)管框架。本文按照規(guī)范與發(fā)展并重的監(jiān)管目標(biāo),對(duì)我國(guó)第三方支付的監(jiān)管原則、監(jiān)管模式、重點(diǎn)環(huán)節(jié)以及監(jiān)管手段等進(jìn)行了全面深入的討論。 (5)針對(duì)目前國(guó)內(nèi)第三方支付機(jī)構(gòu)監(jiān)管的現(xiàn)實(shí)和重點(diǎn),本文圍繞客戶備付金這一核心問(wèn)題,設(shè)計(jì)了適合我國(guó)第三方支付機(jī)構(gòu)的備付金存管模式,并根據(jù)設(shè)計(jì)的備付金存管模式,構(gòu)建了一套務(wù)實(shí)的第三方支付機(jī)構(gòu)監(jiān)管指標(biāo)體系。該指標(biāo)體系包括反映第三方支付機(jī)構(gòu)資產(chǎn)負(fù)債結(jié)構(gòu)、資產(chǎn)質(zhì)量、安全性、流動(dòng)性以及盈利性的一系列指標(biāo)。該指標(biāo)體系有利于反映第三方支付機(jī)構(gòu)運(yùn)營(yíng)狀況,也便于監(jiān)管機(jī)構(gòu)監(jiān)控其日常運(yùn)營(yíng)風(fēng)險(xiǎn),從而實(shí)現(xiàn)對(duì)第三方支付機(jī)構(gòu)的定量化監(jiān)管。
[Abstract]:The payment system is the core infrastructure of the modern market economy and financial activity . The safe and efficient payment system is an important guarantee for the sustained and healthy development of the economy .
( 2 ) To construct the effective regulatory framework of third - party payment in our country requires multiple dimensions , considering the organizational structure , regulatory content , regulatory links , regulatory methods , regulatory measures , regulatory measures and so on ;
( 3 ) The effective supervision of third - party payment shall be established as soon as possible with the security of the client ' s preparation and payment as the core , involving the measurement , early warning and prompt monitoring index system of the liquidity , solvency , profitability , transaction safety and loss compensation of the third - party payment institution , and designs more than 20 specific monitoring indexes .

Compared with previous research results of third - party payment supervision in our country , this paper analyzes and designs a complete third - party payment market supervision system from abstract to concrete , qualitative analysis and quantitative analysis based on the analysis of the development course of third - party payment , the problems and the necessity of supervision .

( 1 ) According to the theory and practice , and closely surround the relevant system economics and the western economics theory , to guide the actual supervision work as the objective , the first comprehensive and systematic analysis and elaboration of the third - party payment supervision system applicable to our country from aspects such as basic criterion , overall framework and supervision index , etc .

( 2 ) On the basis of deeply analyzing and grasping the third - party payment development law , combining the theory of " market failure " , the paper analyzes the four main sources of the third - party payment of " market failure " : public goods , external , monopoly and imperfect competition , and discusses the necessity of effective supervision on third - party payment .

( 3 ) The third party payment generation and development course is reviewed in detail . The third party pays all kinds of business model and the risk points , and compares the basic mode and beneficial experience of third party payment supervision . This paper makes an in - depth analysis on the implementation of effective supervision based on the present situation of third party payment development in our country , and makes an analysis on the supervision intensity , supervision center of gravity and regulatory target of effective supervision , and puts forward the feasible conditions and realization conditions for effective supervision of third party payment .

( 4 ) The basic criterion , the general framework and the basic mechanism of the third - party payment effective supervision in our country are preliminarily constructed . The third - party payment regulatory framework designed by this paper is applicable to the actual situation of the third - party payment supervision system , and the third - party payment regulatory framework combined with the supervision of the third - party payment industry is proposed and analyzed . The article puts forward and analyzes the supervision framework of third - party payment supervision based on the regulation and development of the third party , and discusses the supervision principle , supervision mode , key link and supervision means of third - party payment in our country .

( 5 ) In view of the current situation and focus of the supervision of the third - party payment institution in China , this paper designs a set of pragmatic third - party payment institution supervision index system based on the core issue of the customer ' s reserve payment . The index system includes a series of indicators reflecting the structure of the third - party payment institution , asset quality , safety , liquidity and profitability . The index system is beneficial to reflect the operational status of the third - party payment institution , and also facilitates the supervision and monitoring of the daily operational risk of the third - party payment institution , so as to realize the quantitative supervision of the third - party payment institution .
