【摘要】：當今的金融市場競爭激烈，國內(nèi)商業(yè)銀行紛紛轉變經(jīng)營發(fā)展方式，網(wǎng)上銀行等電子化營銷渠道作為商業(yè)銀行實現(xiàn)轉型的主要抓手。網(wǎng)上銀行的便利和高效被廣泛接受，也會被洗錢分子所利用，因此，研究商業(yè)銀行網(wǎng)上銀行反洗錢對策，規(guī)避合規(guī)風險，保證健康有序開展，是撰寫本文的主要目的。 本文不僅提出商業(yè)銀行開展網(wǎng)上銀行反洗錢的必要性，而且運用納什理論，對商業(yè)銀行間、商業(yè)銀行與洗錢者、商業(yè)銀行與監(jiān)管部門進行博弈分析，說明在反洗錢監(jiān)管下，商業(yè)銀行在追求效用最大化的同時，如何“理性”做出選擇。對網(wǎng)上銀行反洗錢進行了成本收益分析，從效益成本角度提出做好網(wǎng)上銀行反洗錢的工作措施。與我國相比，國際反洗錢工作領先一步，在洗錢的新發(fā)領域如網(wǎng)絡洗錢確實有很好的做法值得我們學習與借鑒，因此，從國際網(wǎng)上銀行洗錢案例入手，總結歸納了國際組織關于網(wǎng)上銀行反洗錢的相關規(guī)定和工作框架，介紹了美國具體做法和經(jīng)驗，找出國際網(wǎng)上銀行反洗錢經(jīng)驗啟示。著重剖析了目前商業(yè)銀行在網(wǎng)上銀行反洗錢工作方面的不足，如客戶身份識別難、可疑交易識別難、反洗錢監(jiān)測系統(tǒng)不完善等七個問題，分析產(chǎn)生原因，并根據(jù)我國商業(yè)銀行實際情況提出一些加強網(wǎng)上銀行反洗錢工作的措施和建議。 通過本文，不僅為反洗錢人員提供參考，對我國商業(yè)銀行網(wǎng)上銀行反洗錢工作獻計獻策，而且對網(wǎng)上銀行洗錢更有清晰的認識，提高網(wǎng)上銀行反洗錢的重視程度，為更好地適應監(jiān)管要求，，防范合規(guī)風險，樹立商業(yè)銀行良好形象打下基礎。
[Abstract]:Nowadays, the competition of financial market is fierce, domestic commercial banks have changed the mode of operation and development one after another, and electronic marketing channels such as online banking are the main means to realize the transformation of commercial banks. The convenience and efficiency of online banking are widely accepted and will also be used by money launderers. Therefore, the main purpose of this paper is to study the countermeasures against money laundering in commercial banks, to avoid compliance risks and to ensure healthy and orderly development. This paper not only puts forward the necessity for commercial banks to carry out online banking anti-money laundering, but also applies Nash theory to the game analysis between commercial banks, commercial banks and money launderers, commercial banks and regulators, and explains that under the supervision of anti-money laundering, Commercial banks are pursuing utility maximization, how to make a rational choice at the same time. This paper analyzes the cost and benefit of internet bank anti-money laundering, and puts forward some measures for anti-money laundering of internet bank from the point of view of benefit and cost. Compared with our country, the international anti-money laundering work is one step ahead, in the new area of money laundering, such as network money laundering, there are really good practices worth learning and reference. Therefore, starting with the case of international online bank money laundering, This paper summarizes and summarizes the relevant regulations and working framework of international organizations on the anti-money laundering of Internet banking, introduces the specific practices and experiences of the United States, and finds out the enlightenment of the anti-money-laundering experience of the international online banks. This paper emphatically analyzes the shortcomings of commercial banks in anti-money laundering work in online banking, such as customer identification, suspicious transaction identification, imperfect anti-money laundering monitoring system, and analyzes the causes. According to the actual situation of commercial banks in China, the paper puts forward some measures and suggestions to strengthen the anti-money laundering work of internet banks. Through this article, not only to provide reference for anti-money laundering personnel, but also to make suggestions to the anti-money laundering work of our commercial bank online bank, but also to have a clearer understanding of the money laundering of online bank, and to raise the degree of attention to anti-money laundering of online bank. In order to better adapt to regulatory requirements, prevent compliance risks, establish a good image of commercial banks lay the foundation.
