【摘要】：在2009年、2010年我國天量貨幣投放、商業(yè)銀行擴(kuò)大信貸政策的背景下,銀行借助信托通道將表內(nèi)資產(chǎn)轉(zhuǎn)移至表外,為擴(kuò)大信貸規(guī)模提供了一條重要的通道,對減弱金融危機(jī)對我國經(jīng)濟(jì)產(chǎn)生的沖擊起到了積極有效的作用。但是在2011年貨幣政策由適度寬松轉(zhuǎn)向穩(wěn)健的情況下,這種做法在削弱國家宏觀調(diào)控效果的同時,本身也蘊(yùn)含著較大的經(jīng)營及合規(guī)風(fēng)險。在雙方合作的過程中,還存在信托公司較弱勢、產(chǎn)品結(jié)構(gòu)單一等問題。在金融業(yè)綜合經(jīng)營及金融危機(jī)的雙重背景下,商業(yè)銀行與信托公司是否應(yīng)該合作,以及采取什么方式合作,是一個很有實(shí)踐意義的、值得探討的問題。 本文在金融業(yè)綜合經(jīng)營的相關(guān)理論基礎(chǔ)上,重點(diǎn)從信托公司的角度,討論了信托公司及商業(yè)銀行的職能。同時搜集整理了國外信托公司發(fā)展及與商業(yè)銀行合作的歷程,為我國的信托業(yè)開展銀信合作提供了有益借鑒,并在系統(tǒng)分析我國銀信合作的現(xiàn)狀后,提出了相應(yīng)的發(fā)展對策與建議。 本文主要分為四部分：第一部分介紹了銀信合作的相關(guān)理論及意義；第二部分通過對美、日、德三個國家銀信混業(yè)經(jīng)營狀況及各自特點(diǎn)的分析,得出對發(fā)展中國銀信合作的有益啟示；第三部分分析了中國銀信合作的現(xiàn)狀、信托公司所面臨的困境以及現(xiàn)行的監(jiān)管政策；第四部分提出了發(fā)展中國銀信合作的目標(biāo)及總體思路,并提出相應(yīng)的具體建議。 本文認(rèn)為：對于信托公司與商業(yè)銀行的合作問題,應(yīng)該在正視其必然性及合理性的前提下進(jìn)行規(guī)范,宜疏不宜堵。雖然有人士倡導(dǎo)信托業(yè)應(yīng)朝著政治價值、經(jīng)濟(jì)價值和社會價值“三位一體”的方向發(fā)展,監(jiān)管方也出臺政策限制信托的“通道”類業(yè)務(wù)。但是,信托業(yè)的資產(chǎn)分割管理功能正是其在現(xiàn)代商業(yè)中的興盛的原因之一,信托業(yè)的發(fā)展注定是走商業(yè)化的道路,并且是以自身的利益最大化作為其經(jīng)濟(jì)價值的源動力。信托公司與商業(yè)銀行的合作應(yīng)在正確的市場定位下,遵循穩(wěn)步推進(jìn)的原則,探索符合我國國情的發(fā)展模式。具體措施上,應(yīng)構(gòu)建均衡性銀信合作框架、強(qiáng)化信托公司合作地位；加強(qiáng)信托業(yè)基礎(chǔ)制度建設(shè)；大力開發(fā)金融產(chǎn)品,提高銀信合作產(chǎn)品的附加值和競爭力。
[Abstract]:In 2009, 2010, when China put money into the world, commercial banks expanded their credit policy, and with the help of trust channels, banks transferred assets in the balance sheet to off-balance sheet, which provided an important channel for expanding the scale of credit. It has played a positive and effective role in mitigating the impact of the financial crisis on China's economy. However, in 2011, when monetary policy changed from moderately loose to sound, this approach weakened the effect of the state's macro-control at the same time. In the process of cooperation between the two sides, there are still some problems, such as weak trust companies, single product structure, etc. Under the dual background of comprehensive management of financial industry and financial crisis, Whether or not commercial banks and trust companies should cooperate, and how to cooperate, is a practical and worth discussing issue. On the basis of the theory of comprehensive management of financial industry, this paper discusses the functions of trust companies and commercial banks from the perspective of trust companies. At the same time, it collects and collates the history of the development of foreign trust companies and their cooperation with commercial banks. It provides a useful reference for the trust industry of our country to carry out the cooperation of the bank and letter, and after systematically analyzing the present situation of the cooperation of the bank and letter in our country, puts forward the corresponding development countermeasure and suggestion. This paper is divided into four parts: the first part introduces the theory and significance of Yinxin cooperation, the second part through the analysis of the three countries, the United States, Japan, Germany and the characteristics of the mixed banking and credit industry. The third part analyzes the current situation of China's bank and credit cooperation, the difficulties faced by trust companies and the current regulatory policies. Part 4th puts forward the goal and the general idea of developing the cooperation between Bank and Credit of China, and puts forward the corresponding concrete suggestions. This paper holds that the cooperation between trust companies and commercial banks should be regulated on the premise of facing up to its inevitability and rationality. With the development of "trinity" of economic value and social value, regulators have also issued policies to restrict the "channel" business of trust. However, the function of asset division and management in trust industry is one of the reasons for its prosperity in modern business. The development of trust industry is destined to follow the road of commercialization and take the maximization of its own interests as the source power of its economic value. The cooperation between trust companies and commercial banks should follow the principle of steady progress under the correct market orientation. We should establish a balanced cooperation framework of bank and credit, strengthen the cooperative status of trust companies, strengthen the basic system construction of trust industry, and vigorously develop financial products. Improve the added value and competitiveness of Yinxin cooperation products.
