后金融危機(jī)時(shí)代我國(guó)金融監(jiān)管體制改革法律問題研究

【摘要】:這次金融危機(jī)深深影響了世界經(jīng)濟(jì)的發(fā)展,對(duì)全球經(jīng)濟(jì)造成了巨大損失,也對(duì)金融秩序造成了極大的沖擊和破壞。金融自由化潮流驅(qū)動(dòng)下,混業(yè)經(jīng)營(yíng)的加深,金融衍生品的發(fā)展使得舊式金融監(jiān)管體制下積累的系統(tǒng)性風(fēng)險(xiǎn)逐步暴露。于是各國(guó)紛紛審視金融監(jiān)管模式,調(diào)整金融監(jiān)管架構(gòu),以求恢復(fù)金融市場(chǎng)信心和穩(wěn)定。 我國(guó)較為封閉的監(jiān)管體制并未像歐美國(guó)家受到重創(chuàng),因此2008年金融危機(jī)后我國(guó)金融監(jiān)管體制并未有較大改動(dòng)。但不得不強(qiáng)調(diào),我國(guó)現(xiàn)有的金融監(jiān)管體制不利于金融創(chuàng)新。改革現(xiàn)有監(jiān)管體制不僅利于金融業(yè)的發(fā)展而且適應(yīng)國(guó)際化大趨勢(shì)。我國(guó)金融監(jiān)管水平較為落后,,學(xué)界也缺乏足夠的研究,同時(shí)往往照搬國(guó)外監(jiān)管模式、脫離我國(guó)實(shí)際,缺乏本土適應(yīng)性。本文旨在通過剖析現(xiàn)行金融監(jiān)管法律框架下暴露出的問題,借鑒發(fā)達(dá)國(guó)家危機(jī)后金融監(jiān)管體制改革,結(jié)合我國(guó)實(shí)際,提出完善我國(guó)金融監(jiān)管法律體制的建議。 本文共分為四部分 第一部分介紹了金融監(jiān)管的基礎(chǔ)理論,明晰后金融危機(jī)以及金融監(jiān)管法律體制的含義;詳細(xì)對(duì)金融監(jiān)管模式進(jìn)行分類,為進(jìn)一步確立我國(guó)金融監(jiān)管模式的選擇提供有益借鑒;從經(jīng)濟(jì)學(xué)角度分析金融監(jiān)管體制改革的必要性,對(duì)我國(guó)金融監(jiān)管體制的選擇同樣有借鑒意義。 第二部分,以美國(guó)、英國(guó)、澳大利亞為例,通過對(duì)發(fā)達(dá)國(guó)家金融危機(jī)前后金融監(jiān)管法律體制改革的變化,總結(jié)出國(guó)際金融監(jiān)管立法改革的新趨勢(shì)。加強(qiáng)宏觀審慎監(jiān)管,加強(qiáng)對(duì)金融消費(fèi)者的保護(hù),金融監(jiān)管模式的轉(zhuǎn)變等。 第三部分,回顧了我國(guó)金融監(jiān)管體制的發(fā)展歷程,闡述了金融危機(jī)后我國(guó)做出的金融監(jiān)管體制的改革,分析我國(guó)金融監(jiān)管體制存在的問題,市場(chǎng)開放不足,缺乏有效的信息共享與協(xié)調(diào)機(jī)制等。 第四部分,通過對(duì)金融危機(jī)前后發(fā)達(dá)國(guó)家金融監(jiān)管體制的變化,以及我國(guó)金融監(jiān)管體制存在的問題分析,得出適合我國(guó)國(guó)情的金融監(jiān)管體制改革路徑。初期,完善金融監(jiān)管協(xié)調(diào)機(jī)制,中長(zhǎng)期,基于宏觀審慎監(jiān)管,以及市場(chǎng)行為和金融消費(fèi)者保護(hù)兩大目標(biāo),建立以目標(biāo)為導(dǎo)向的雙峰監(jiān)管體制。同時(shí)在完善相關(guān)法規(guī)的同時(shí),構(gòu)建宏觀審慎監(jiān)管體系,完善金融消費(fèi)者保護(hù)的相關(guān)法律法規(guī)。
[Abstract]:This financial crisis has deeply affected the development of the world economy, caused enormous losses to the global economy, and caused great impact and destruction to the financial order. Driven by the trend of financial liberalization, the mixed operation deepened. The development of financial derivatives gradually exposes the systemic risks accumulated under the old financial supervision system, so many countries have examined the financial supervision model and adjusted the financial regulatory structure in order to restore the confidence and stability of the financial market. China's relatively closed regulatory system has not been hit as hard as that of Europe and the United States, so there has been no major change in our financial supervision system since the financial crisis in 2008. The current financial supervision system in China is not conducive to financial innovation. The reform of the existing regulatory system is not only conducive to the development of the financial industry but also to the trend of internationalization. The level of financial supervision in China is relatively backward, and the academic community lacks sufficient research. At the same time, the foreign regulatory model is often copied, which is divorced from the reality of our country and lacks local adaptability. This paper aims to learn from the financial supervision system reform after the crisis in developed countries by analyzing the problems exposed under the current legal framework of financial supervision. Combining with the reality of our country, this paper puts forward some suggestions to perfect the legal system of financial supervision in our country. This paper is divided into four parts. The first part introduces the basic theory of financial supervision, clarifies the meaning of post-financial crisis and the legal system of financial supervision, classifies the mode of financial supervision in detail, and provides useful reference for further establishing the choice of financial supervision model in China. The analysis of the necessity of the reform of the financial supervision system from the angle of economics can also be used as a reference for the choice of the financial supervision system in our country. The second part, taking the United States, the United Kingdom and Australia as an example, through the changes in the legal system of financial supervision before and after the financial crisis in developed countries, summarizes the new trend of the legislative reform of international financial supervision, and strengthens macro-prudential supervision. Strengthen the protection of financial consumers, the transformation of financial supervision model. The third part reviews the development course of our country's financial supervision system, expounds the reform of our country's financial supervision system after the financial crisis, analyzes the problems existing in our country's financial supervision system, and the lack of market opening. Lack of effective information sharing and coordination mechanism. In the 4th part, by analyzing the changes in the financial supervision system of developed countries before and after the financial crisis, and the problems existing in the financial supervision system of our country, we get the path of the reform of the financial supervision system suitable for the national conditions of our country. To improve the coordination mechanism of financial supervision, in the medium and long term, and based on the two goals of macro-prudential supervision, market behavior and financial consumer protection, to establish a two-peak goal-oriented regulatory system. At the same time, while perfecting the relevant laws and regulations, Build macroscopical prudential supervision system, perfect the relevant laws and regulations of financial consumer protection.
