【摘要】：I版權(quán)窮竭制度是平衡創(chuàng)作者和社會公眾之間利益的重要制度,在著作權(quán)法的各項(xiàng)制度與規(guī)則中,它是不可或缺的,對它的研究是當(dāng)今世界知識產(chǎn)權(quán)界一個極為引人注目的課題。由于版權(quán)窮竭制度的重要性,大多數(shù)國家對此制度都有規(guī)定,雖然具體規(guī)定并不相同。然而,就目前來說,我國還沒有對版權(quán)窮竭制度作出完善的法律規(guī)定。本文試圖從版權(quán)窮竭的基本概念、特征及性質(zhì)、版權(quán)窮竭的價值、版權(quán)窮竭的適用情況、版權(quán)窮竭與平行進(jìn)口、我國版權(quán)窮竭制度的完善等幾個方面進(jìn)行探討,從而提出完善我國版權(quán)窮竭制度的立法建議。 第一部分介紹版權(quán)窮竭的基本概念、特征及性質(zhì)。首先以版權(quán)窮竭的概念為切入點(diǎn),闡述它的最狹義、狹義及廣義三種觀點(diǎn),在分析之后得出本文贊同狹義的版權(quán)窮竭論的結(jié)論;其次分析版權(quán)窮竭適用的前提性、窮竭權(quán)項(xiàng)的特定性、窮竭對象的特定性和窮竭范圍的特定性等四個特征;最后通過探討關(guān)于版權(quán)窮竭性質(zhì)的默示許可說、所有權(quán)轉(zhuǎn)移說、法律規(guī)定說和權(quán)利限制說等四種學(xué)說,從而揭示版權(quán)窮竭的性質(zhì)是一種權(quán)利限制。 第二部分闡述版權(quán)窮竭的價值。版權(quán)窮竭體現(xiàn)三個方面的價值。首先,版權(quán)窮竭的效益價值,它消除了商品自由流通的障礙,實(shí)現(xiàn)了經(jīng)濟(jì)效益與社會效益的共贏;其次,版權(quán)窮竭的個人——社會雙向本位價值,它既體現(xiàn)了著作權(quán)法對著作權(quán)人利益的保護(hù),也體現(xiàn)了著作權(quán)法對社會公共利益的追求;最后,版權(quán)窮竭的利益平衡價值,它通過窮竭著作權(quán)人的部分權(quán)利,在著作權(quán)人、傳播者以及使用者之間達(dá)到了一種利益的平衡。 第三部分考察版權(quán)窮竭的適用問題。首先,分析版權(quán)窮竭的權(quán)項(xiàng)范圍,分別介紹發(fā)行權(quán)、展覽權(quán)適用版權(quán)窮竭,出租權(quán)、網(wǎng)絡(luò)作品發(fā)行權(quán)和藝術(shù)作品追續(xù)權(quán)不適用版權(quán)窮竭;其次,分析版權(quán)窮竭的空間效力范圍,版權(quán)窮竭是否具有地域性,主要有國內(nèi)窮竭說和區(qū)域窮竭說以及國際窮竭說三種不同的主張。 第四部分專門論述版權(quán)窮竭與平行進(jìn)口。首先,解釋平行進(jìn)口的基本含義;其次,介紹版權(quán)窮竭與平行進(jìn)口,平行進(jìn)口與一國對外貿(mào)易及經(jīng)濟(jì)發(fā)展利益密切相連,承認(rèn)版權(quán)窮竭的國際窮竭就等于承認(rèn)了平行進(jìn)口的合法性;最后,介紹美國、歐盟、日本及新加坡在平行進(jìn)口問題上的法律規(guī)定。 第五部分論述我國版權(quán)窮竭制度的完善問題。本文擬從我國版權(quán)窮竭立法的現(xiàn)狀分析著手,再分析比較國際上以及兩大法系主要國家對版權(quán)窮竭制度的不同立法情況,借鑒先進(jìn)的立法經(jīng)驗(yàn),完善我國的立法。所以,本文建議將版權(quán)窮竭的規(guī)定納入我國現(xiàn)行《著作權(quán)法》中“權(quán)利的限制”一節(jié),適用權(quán)項(xiàng)范圍規(guī)定為發(fā)行權(quán)窮竭、出租權(quán)、放映權(quán)和展覽權(quán)有條件的窮竭,空間適用范圍短期內(nèi)遵循有條件的國際窮竭說,短期內(nèi)原則上承認(rèn)在平行進(jìn)口的合法性。
[Abstract]:I the exhaustion system of copyright is an important system to balance the interests between creators and the public. It is indispensable in the systems and rules of copyright law. The study of copyright exhaustion is a very noticeable topic in the field of intellectual property rights in the world today. Due to the importance of copyright exhaustion system, most countries have provisions on this system, although the specific provisions are not the same. However, at present, China has not made perfect legal provisions on copyright exhaustion system. This paper attempts to discuss the basic concept, characteristics and nature of copyright exhaustion, the value of copyright exhaustion, the application of copyright exhaustion, copyright exhaustion and parallel import, and the perfection of copyright exhaustion system in China, so as to put forward some legislative suggestions for perfecting the copyright exhaustion system in China. The first part introduces the basic concept, characteristics and properties of copyright exhaustion. First of all, taking the concept of copyright exhaustion as the starting point, this paper expounds its three viewpoints: the narrowest sense, the narrow sense and the broad sense, and after the analysis, draws the conclusion that this paper agrees with the narrow sense copyright exhaustion theory. Secondly, it analyzes the four characteristics of the copyright exhaustion application, the specificity of the exhaustion right item, the specificity of the exhaustion object and the specificity of the exhaustion range. Finally, by discussing the implied license theory about the nature of copyright exhaustion, the theory of ownership transfer, the theory of legal provisions and the theory of right restriction, this paper reveals that the nature of copyright exhaustion is a kind of right restriction. The second part expounds the value of copyright exhaustion. Copyright exhaustion reflects the value of three aspects. First of all, the benefit value of copyright exhaustion, which eliminates the obstacles to the free circulation of commodities and realizes the win-win benefits of economic and social benefits; secondly, the two-way standard value of copyright exhaustion, which not only embodies the protection of the interests of copyright owners in copyright law, but also reflects the pursuit of social and public interests in copyright law. Finally, the balance of interests of copyright exhaustion, which achieves a balance of interests among copyright owners, communicators and users by exhausting some of the rights of copyright owners. The third part examines the application of copyright exhaustion. First of all, this paper analyzes the scope of copyright exhaustion, and introduces the right of distribution, the right of exhibition is applicable to copyright exhaustion, rental right, network work distribution right and art work continuation right is not applicable to copyright exhaustion; secondly, it analyzes the spatial effect range of copyright exhaustion and whether copyright exhaustion is regional, mainly including domestic exhaustion theory, regional exhaustion theory and international exhaustion theory. The fourth part is devoted to copyright exhaustion and parallel import. First of all, it explains the basic meaning of parallel import; secondly, it introduces that copyright exhaustion and parallel import are closely related to a country's foreign trade and economic development interests, recognizing the international exhaustion of copyright exhaustion is tantamount to recognizing the legitimacy of parallel import; finally, it introduces the legal provisions of the United States, the European Union, Japan and Singapore on the issue of parallel import. The fifth part discusses the perfection of copyright exhaustion system in our country. This paper intends to start with the analysis of the present situation of copyright exhaustion legislation in China, and then analyze and compare the different legislative conditions of copyright exhaustion system in the world and the main countries of the two legal systems, and learn from the advanced legislative experience to improve the legislation of our country. Therefore, this paper suggests that the provisions of copyright exhaustion should be included in the section of "limitation of Rights" in the current copyright Law of our country. The scope of applicable rights is the conditional exhaustion of distribution rights, rental rights, projection rights and exhibition rights. The scope of space application follows the conditional international exhaustion theory in a short period of time, and in principle recognizes the legitimacy of parallel imports in a short period of time.
