無錫市餐飲服務(wù)食品安全監(jiān)管問題研究

【摘要】:食品安全是當(dāng)今社會普遍關(guān)注的焦點問題,餐飲服務(wù)作為食品供應(yīng)鏈的終末端,與消費者是最直接接觸的,它的安全與否至關(guān)重要。一個地區(qū)餐飲服務(wù)食品安全水平直接體現(xiàn)了該城市的經(jīng)濟發(fā)展水平、消費者的食品安全意識以及政府的治理能力。近年來,無錫市也不斷發(fā)生"假牛肉"、"一滴香"、地溝油、火鍋底料違規(guī)添加等食品安全問題,政府通過深化機構(gòu)改革、完善監(jiān)管機制、加大執(zhí)法力度等措施,加強食品安全管理,基本穩(wěn)定了食品安全大環(huán)境。但是隨著生活水平提高和工作節(jié)奏加快,餐飲服務(wù)發(fā)展迅猛,導(dǎo)致餐飲服務(wù)企業(yè)誠信意識不強、食品安全管理能力差、監(jiān)管部門執(zhí)法力量薄弱、執(zhí)法技術(shù)支撐滯后、消費者維權(quán)能力不足等,餐飲服務(wù)食品安全過渡依賴行政監(jiān)管,食品安全社會共治的格局尚未形成。上述問題普遍存在于江蘇各地區(qū),本文依據(jù)無縫管理理論、信息不對稱理論和政府失靈理論,運用數(shù)據(jù)采集法、文獻研究法、比較研究法等,來研究餐飲服務(wù)食品安全監(jiān)管中存在的問題。首先,明確餐飲服務(wù)、食品安全、行政監(jiān)管的定義,對無錫市餐飲服務(wù)食品安全現(xiàn)狀進行分析,探討餐飲服務(wù)食品安全監(jiān)管存在的問題;其次,對國外先進食品安全管理經(jīng)驗進行分析、借鑒;最后結(jié)合無錫市的具體情況以及自己在餐飲監(jiān)管工作中的經(jīng)驗,提出了在餐飲服務(wù)監(jiān)管過程中必須積極整合執(zhí)法資源、構(gòu)建執(zhí)法三級網(wǎng)絡(luò)、完善餐飲服務(wù)食品安全預(yù)警機制,通過構(gòu)建行業(yè)信用、食品追溯、社會共治三大管理體系,促進餐飲服務(wù)行業(yè)健康良性發(fā)展。本文在理論方面,為我國完善法律規(guī)范提供了建議,積極推動了我國食品安全監(jiān)管的理論研究;在實踐方面,為無錫市餐飲服務(wù)環(huán)節(jié)監(jiān)管工作、推動社會經(jīng)濟又好又快發(fā)展、保障人民群眾健康提供了參考依據(jù)。
[Abstract]:Food safety is the focus of our society. As the end of food supply chain, food service is the most direct contact with consumers. The level of food safety in a region directly reflects the level of economic development of the city, the food safety consciousness of consumers and the governance ability of the government in recent years. In Wuxi City, food safety problems such as "fake beef", "a drop of incense", gutter oil and the illegal addition of hot pot bottom materials have been constantly occurring. The government has strengthened food safety management through deepening institutional reform, perfecting the supervision mechanism, and strengthening law enforcement measures. The food safety environment has basically been stabilized. However, with the improvement of living standards and the quickening pace of work, catering services have developed rapidly, leading to a weak sense of good faith, poor food safety management ability and weak law enforcement power of the regulatory authorities. Law enforcement technical support lags behind, consumer rights protection ability is insufficient, catering service food safety transition depends on administrative supervision, food safety social co-governance pattern has not yet formed. The above problems generally exist in all regions of Jiangsu. Based on seamless management theory, information asymmetry theory and government failure theory, this paper uses data collection method, literature research method and comparative research method to study the problems existing in food safety supervision of catering service. The definition of food safety, the definition of administrative supervision, the analysis of the present situation of food safety of catering service in Wuxi city, the discussion of the problems existing in food safety supervision of catering service, secondly, the analysis of the advanced food safety management experience of foreign countries. Finally, combined with the specific situation of Wuxi city and its own experience in the catering supervision work, the author puts forward that in the process of catering service supervision, we must actively integrate the law enforcement resources, construct a three-level law enforcement network, and improve the food safety early warning mechanism of catering service. In order to promote the healthy and healthy development of catering service industry, this paper provides suggestions for perfecting the legal norms of our country in theory, by constructing three management systems of industry credit, food tracing and social co-governance, and promoting the healthy and benign development of catering service industry. It actively promotes the theoretical research of food safety supervision in our country, and in practice, provides a reference basis for the supervision of catering service links in Wuxi City, the promotion of social economy and the rapid development of social economy, and the protection of the health of the people.
