【摘要】：沈陽具有近百年的工業(yè)發(fā)展歷程,工業(yè)化基礎(chǔ)雄厚,同時(shí)包袱也較重。沈陽市作為全國推進(jìn)新型工業(yè)化進(jìn)程全面創(chuàng)新改革示范區(qū),其經(jīng)濟(jì)與社會發(fā)展面臨著新的機(jī)遇與挑戰(zhàn)。進(jìn)一步推動沈陽新型工業(yè)化進(jìn)程的路徑極具復(fù)雜性,以知識產(chǎn)權(quán)制度為研究視角,尤其是探討完善知識產(chǎn)權(quán)制度保障新型工業(yè)化的全面創(chuàng)新改革發(fā)展路徑,試圖解決其滯后性和不適應(yīng)等問題,也越發(fā)顯得重要。文章在對新型工業(yè)化內(nèi)涵及知識產(chǎn)權(quán)保障機(jī)制進(jìn)行深入研究的基礎(chǔ)上,采用文獻(xiàn)研究法、實(shí)證研究法和比較分析法等研究方法,從知識產(chǎn)權(quán)立法、行政執(zhí)法、司法保護(hù)和服務(wù)管理等幾個(gè)方面進(jìn)行分析闡述,結(jié)合推動沈陽新型工業(yè)化進(jìn)程的知識產(chǎn)權(quán)制度現(xiàn)狀,梳理并分析了沈陽新型工業(yè)化發(fā)展過程中存在的知識產(chǎn)權(quán)問題,借鑒國內(nèi)外新型工業(yè)化進(jìn)程中的知識產(chǎn)權(quán)促進(jìn)制度的實(shí)踐,提出了推進(jìn)沈陽新型工業(yè)化進(jìn)程的知識產(chǎn)權(quán)制度保障相關(guān)建議。在完善知識產(chǎn)權(quán)政策法規(guī)方面,提出了制定囊括促進(jìn)企業(yè)創(chuàng)新創(chuàng)業(yè)、循環(huán)經(jīng)濟(jì)、兩化融合等內(nèi)容,打通知識產(chǎn)權(quán)創(chuàng)造、運(yùn)用、保護(hù)、管理和服務(wù)全鏈條的知識產(chǎn)權(quán)保護(hù)和促進(jìn)地方性法律法規(guī);在知識產(chǎn)權(quán)行政執(zhí)法方面,提出了建立適應(yīng)新型工業(yè)化發(fā)展的專利、商標(biāo)、著作權(quán)等“多合一”的知識產(chǎn)權(quán)綜合行政執(zhí)法機(jī)構(gòu);在司法保護(hù)建設(shè)方面,提出構(gòu)建知識產(chǎn)權(quán)民事、行政、刑事“三合一”審判機(jī)制,完善司法糾紛解決機(jī)制,設(shè)立沈陽市知識產(chǎn)權(quán)仲裁院;在促進(jìn)知識產(chǎn)權(quán)服務(wù)管理方面,提出了完善知識產(chǎn)權(quán)運(yùn)營管理制度、促進(jìn)專利代理等知識產(chǎn)權(quán)服務(wù)業(yè)發(fā)展、對知識產(chǎn)權(quán)中介服務(wù)機(jī)構(gòu)以事中事后監(jiān)管取代準(zhǔn)入審批等政策。總之,本文試圖為促進(jìn)沈陽新型工業(yè)化進(jìn)程的知識產(chǎn)權(quán)保障進(jìn)行了較為系統(tǒng)的制度設(shè)計(jì),彌補(bǔ)了以知識產(chǎn)權(quán)視角對沈陽新型工業(yè)化進(jìn)行專題研究的空白。
[Abstract]:Shenyang has nearly a hundred years of industrial development, industrialization foundation is strong, at the same time, the burden is also heavy. Shenyang, as a demonstration area of all-round innovation and reform to promote the process of new industrialization in China, its economic and social development is facing new opportunities and challenges. The path to further promote the process of new industrialization in Shenyang is very complex, so it is more and more important to take the intellectual property system as the research angle, especially to explore the comprehensive innovation reform and development path to perfect the intellectual property system to ensure the new industrialization, and to try to solve its lag and unadaptability. On the basis of in-depth study of the connotation of new industrialization and the mechanism of intellectual property protection, this paper adopts the methods of literature research, empirical research and comparative analysis, analyzes and expounds the intellectual property legislation, administrative law enforcement, judicial protection and service management from the aspects of intellectual property legislation, administrative law enforcement, judicial protection and service management, combined with the present situation of intellectual property system promoting the process of new industrialization in Shenyang. This paper combs and analyzes the problems of intellectual property rights existing in the development of Shenyang's new industrialization, draws lessons from the practice of intellectual property promotion system in the process of new industrialization at home and abroad, and puts forward some suggestions on the protection of intellectual property rights system to promote the process of Shenyang's new industrialization. In the aspect of perfecting intellectual property policies and regulations, this paper puts forward the formulation of intellectual property rights protection and promotion of local laws and regulations, which include promoting enterprise innovation and entrepreneurship, circular economy, twinning integration and so on, so as to open up the intellectual property rights to create, apply, protect, manage and serve the whole chain of intellectual property rights. In the aspect of administrative law enforcement of intellectual property rights, this paper puts forward the establishment of "multi-in-one" comprehensive administrative law enforcement agencies of intellectual property rights, such as patents, trademarks and copyright, which are suitable for the development of new industrialization, and puts forward the construction of "three-in-one" trial mechanism of civil, administrative and criminal intellectual property rights in the construction of judicial protection, the improvement of judicial dispute resolution mechanism and the establishment of Shenyang intellectual property Arbitration Court. In the aspect of promoting the management of intellectual property service, this paper puts forward some policies, such as perfecting the management system of intellectual property operation and management, promoting the development of intellectual property service industry such as patent agency, and replacing the admission examination and approval with the supervision of intellectual property intermediary service organization after the event. In a word, this paper attempts to carry out a more systematic system design to promote the intellectual property protection in the process of Shenyang's new industrialization, and makes up for the blank of the special research on Shenyang's new industrialization from the perspective of intellectual property rights.
