【摘要】：隨著知識(shí)產(chǎn)權(quán)的超越一國(guó)的范圍，與知識(shí)產(chǎn)權(quán)相關(guān)的貿(mào)易也逐漸在國(guó)際舞臺(tái)占有越來(lái)越高的比重，國(guó)際貿(mào)易與知識(shí)產(chǎn)權(quán)之間日益緊密的聯(lián)系已經(jīng)成為當(dāng)代國(guó)際貿(mào)易的一個(gè)新特征。從上世紀(jì)90年代以來(lái)，由于知識(shí)經(jīng)濟(jì)在各發(fā)達(dá)國(guó)家的迅速發(fā)展，這也促進(jìn)了經(jīng)濟(jì)全球化和貿(mào)易自由化向更高方面的發(fā)展，進(jìn)一步也引發(fā)了諸多領(lǐng)域的變革。知識(shí)產(chǎn)權(quán)保護(hù)不再單單是影響一國(guó)科技進(jìn)步和經(jīng)濟(jì)發(fā)展水平的重要因素，在國(guó)際保護(hù)體制本質(zhì)上還體現(xiàn)著知識(shí)產(chǎn)權(quán)保護(hù)的貿(mào)易屬性。在進(jìn)入21世紀(jì)后而隨著第三世界國(guó)家經(jīng)濟(jì)的崛起，侵犯知識(shí)產(chǎn)權(quán)的案例不斷增加，世界主要發(fā)達(dá)國(guó)家為更好的維護(hù)本國(guó)的知識(shí)產(chǎn)權(quán)、保護(hù)本國(guó)的合法利益，開始研究建立一個(gè)超越以往人格有關(guān)知識(shí)產(chǎn)權(quán)保護(hù)的條例的協(xié)議——ACTA就是這樣的一個(gè)環(huán)境下誕生了。 論文就以此為研究線索，分四章對(duì)ACTA的建立是如何影響我國(guó)的對(duì)外貿(mào)易進(jìn)行了研究。該論文的第一章系統(tǒng)的介紹ACTA相關(guān)基本情況，，包括ACTA的內(nèi)涵、特點(diǎn)、ACTA的發(fā)展歷程及ACTA與現(xiàn)行的TRIPS的比較等方面分析《反假冒貿(mào)易協(xié)定》。正文第二章主要是介紹我國(guó)主要貿(mào)易伙伴國(guó)對(duì)ACTA的態(tài)度，有助于文章在接下來(lái)的實(shí)證分析中對(duì)ACTA是如何影響我國(guó)的對(duì)外貿(mào)易有一個(gè)初步的了解。第三章的核心就是通過(guò)建立模型，實(shí)證分析ACTA的建立對(duì)我國(guó)的對(duì)外貿(mào)易是如何產(chǎn)生影響的。本章主要從4方面入手，首先闡述了知識(shí)產(chǎn)權(quán)保護(hù)與發(fā)展國(guó)際貿(mào)易的理論基礎(chǔ)，其次對(duì)引力模型進(jìn)行了簡(jiǎn)單的介紹和模型設(shè)定，最后對(duì)本文需要利用的數(shù)據(jù)進(jìn)行了說(shuō)明，進(jìn)而利用eviews6.0對(duì)上述數(shù)據(jù)進(jìn)行回歸分析得出分析結(jié)果。第四章也是正文的最后一章，針對(duì)上述文章的介紹和論述提出我國(guó)在日后發(fā)展對(duì)外貿(mào)易時(shí)應(yīng)該采取怎樣的對(duì)策和措施。論文的主要著眼點(diǎn)是先從政府和國(guó)家著手完善立法、為企業(yè)提供更好的知識(shí)產(chǎn)權(quán)保護(hù)平臺(tái)；其次加強(qiáng)第三世界的合作，聯(lián)合抵制ACTA；再次借鑒西方國(guó)家發(fā)展知識(shí)產(chǎn)權(quán)的寶貴經(jīng)驗(yàn)，為更好發(fā)展本國(guó)的知識(shí)產(chǎn)權(quán)提供有益的借鑒；最后是從企業(yè)和個(gè)人入手，加強(qiáng)企業(yè)的知識(shí)產(chǎn)權(quán)研究與保護(hù)、提高企業(yè)和個(gè)人的知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)。
[Abstract]:With the development of intellectual property, the trade between international trade and intellectual property has become a new feature of contemporary international trade. Since the 1990s, the rapid development of the knowledge-based economy in the developed countries has also contributed to the development of the economic globalization and the trade liberalization to a higher level, which has further led to a number of changes in the field. The protection of intellectual property is no longer an important factor that affects the level of scientific and technological progress and economic development of a country, and it also embodies the trade attribute of intellectual property protection in the essence of the international protection system. After entering the 21st century, with the rise of the third-world economy and the increasing case of the infringement of intellectual property rights, the major developed countries of the world have provided better maintenance of their intellectual property rights and the protection of their legitimate interests. The start of the study was to set up an agreement that transcends the regulations on intellectual property protection of the past, and ACTA was born in such an environment. In this paper, the research leads and four chapters are divided into four chapters: how to influence the establishment of ACTA is to study the foreign trade of our country The first chapter of this paper introduces ACTA's basic condition, including the connotation and characteristics of ACTA, the development course of ACTA, and the comparison of ACTA with the current TRIPS. The second chapter of the text is to introduce the attitude of China's main trading partner to ACTA, which is helpful to the article in the following empirical analysis how the ACTA has a preliminary impact on China's foreign trade The core of the third chapter is to make an empirical analysis of the effect of ACTA's establishment on China's foreign trade through the establishment of a model. This chapter starts with four aspects, first expounds the theoretical foundation of the intellectual property protection and the development of international trade, and then makes a brief introduction to the gravity model and the model setting, and finally the data to be used in this paper And then the data is regression analyzed by using the eviews6.0 to obtain an analysis junction. The fourth chapter is also the last chapter of the text. In the light of the introduction and discussion of the above-mentioned articles, the countermeasures and measures should be taken to develop the foreign trade in the future. The main focus of the thesis is to improve the legislation from the government and the state, to provide a better platform for intellectual property protection for the enterprises, then to strengthen the cooperation of the third world, and to jointly resist the ACTA; and to draw on the valuable experience of the development of intellectual property rights in the western countries. To provide a useful reference for the better development of the intellectual property of the country; and finally, to start with the enterprise and the individual, to strengthen the research and protection of the intellectual property of the enterprise, and to improve the intellectual property protection of the enterprise and the individual.
