低碳技術(shù)轉(zhuǎn)移與知識產(chǎn)權(quán)保護(hù)沖突研究

【摘要】:氣化變化引發(fā)的危機(jī)已經(jīng)嚴(yán)重影響到人類的生存和發(fā)展,低碳技術(shù)的使用是應(yīng)對這一危機(jī)的最主要手段。發(fā)達(dá)國家經(jīng)過兩百多年的工業(yè)化發(fā)展,積累了相當(dāng)量的財(cái)富和技術(shù),利用最先進(jìn)的低碳技術(shù)控制了本國二氧化碳的排放量,而發(fā)展中國家在其工業(yè)化過程中,由于缺乏資金和技術(shù),仍然處于粗放式生產(chǎn)階段,排放了大量的二氧化碳。但是空氣是流動(dòng)的,氣候變化引發(fā)的災(zāi)難沒有哪一個(gè)國家能夠幸免。在此背景之下,低碳技術(shù)從發(fā)達(dá)國家向發(fā)展中國家轉(zhuǎn)移是大勢所趨。但是目前低碳技術(shù)的轉(zhuǎn)移現(xiàn)狀并不令人滿意。影響低碳技術(shù)轉(zhuǎn)移的因素有很多,高額關(guān)稅、投資風(fēng)險(xiǎn)、高利潤比等等,而知識產(chǎn)權(quán)保護(hù)制度則一直是是發(fā)達(dá)國家和發(fā)展中國家爭論的焦點(diǎn)。雙方均認(rèn)為知識產(chǎn)權(quán)制度阻礙了低碳技術(shù)的轉(zhuǎn)移,只是發(fā)達(dá)國家認(rèn)為發(fā)展中國家知識產(chǎn)權(quán)制度不夠完善,導(dǎo)致企業(yè)不愿意進(jìn)行技術(shù)轉(zhuǎn)移;發(fā)展中國家則認(rèn)為是世界范圍內(nèi)知識產(chǎn)權(quán)保護(hù)急劇擴(kuò)張導(dǎo)致大型企業(yè)享有絕對的壟斷優(yōu)勢,使發(fā)展中國家企業(yè)無法在市場機(jī)制下獲得低碳技術(shù)。因此,我們需要探究的是低碳技術(shù)與知識產(chǎn)權(quán)保護(hù)之間的關(guān)系究竟如何、產(chǎn)生“阻礙”的本質(zhì)原因是什么、現(xiàn)有的解決這種沖突的理論和機(jī)制不能有效發(fā)揮作用的原因是什么。本文主要采用理論分析的方法,將全文分為六個(gè)部分對問題進(jìn)行闡述、分析。第一章簡要介紹本文的研究背景與意義、研究現(xiàn)狀和研究內(nèi)容與方法。第二章對低碳技術(shù)的特點(diǎn)和轉(zhuǎn)移模式進(jìn)行介紹,重點(diǎn)闡述低碳技術(shù)轉(zhuǎn)移的必要性。第三章探究低碳技術(shù)轉(zhuǎn)移與知識產(chǎn)權(quán)保護(hù)之間的關(guān)系,產(chǎn)生沖突的本質(zhì)原因,并對沖突的表現(xiàn)進(jìn)行了介紹。第四章主要介紹為了解決低碳技術(shù)轉(zhuǎn)移與知識產(chǎn)權(quán)保護(hù)的沖突、促進(jìn)技術(shù)轉(zhuǎn)移,所引入的理論建議和國際公約規(guī)定的機(jī)制。第五章解決低碳技術(shù)轉(zhuǎn)移與知識產(chǎn)權(quán)保護(hù)沖突的基本原則和具體措施建議。第六章對全文進(jìn)行總結(jié)。
[Abstract]:The crisis caused by gasification has seriously affected the survival and development of human beings. The use of low-carbon technology is the most important means to deal with this crisis. After more than 200 years of industrial development, developed countries have accumulated equivalent wealth and technology, using state-of-the-art low-carbon technologies to control their carbon dioxide emissions, while developing countries in the course of their industrialization, Due to lack of funds and technology, it is still in the extensive production stage, emitting a large amount of carbon dioxide. But the air is flowing, and no country can survive the disaster caused by climate change. In this context, the transfer of low-carbon technology from developed countries to developing countries is the general trend. But the current low-carbon technology transfer status is not satisfactory. There are many factors affecting the transfer of low-carbon technology, such as high tariffs, investment risk, high profit ratio, and so on. The intellectual property protection system has always been the focus of debate between developed and developing countries. Both sides believe that the intellectual property system hinders the transfer of low-carbon technology, but the developed countries believe that the intellectual property system in developing countries is not perfect, which leads to the reluctance of enterprises to transfer technology; Developing countries believe that the rapid expansion of intellectual property protection in the world has led to the absolute monopoly advantage of large enterprises, which makes developing countries unable to obtain low-carbon technology under the market mechanism. Therefore, what we need to explore is how the relationship between low-carbon technology and intellectual property protection is, what is the essential cause of "hindrance", and what is the reason why the existing theories and mechanisms to resolve this kind of conflict cannot play an effective role. This article mainly uses the theoretical analysis method, divides the full text into six parts to carry on the elaboration and the analysis to the question. The first chapter briefly introduces the research background and significance, research status, research contents and methods. The second chapter introduces the characteristics and transfer mode of low-carbon technology, focusing on the necessity of low-carbon technology transfer. The third chapter explores the relationship between low-carbon technology transfer and intellectual property protection, the essential cause of conflict, and introduces the performance of conflict. The fourth chapter mainly introduces the theoretical suggestions and mechanisms stipulated in international conventions in order to solve the conflict between low-carbon technology transfer and intellectual property protection and to promote technology transfer. Chapter five: the basic principles and specific measures to solve the conflict between low-carbon technology transfer and intellectual property protection. The sixth chapter summarizes the full text.
