澳大利亞版權(quán)產(chǎn)業(yè)和版權(quán)立法研究

【摘要】:隨著知識經(jīng)濟的深入發(fā)展和經(jīng)濟全球化進程的明顯加快,智力創(chuàng)造對物質(zhì)生產(chǎn)、文化生產(chǎn)的作用越來越大,知識產(chǎn)權(quán)日益成為國家發(fā)展的戰(zhàn)略性資源和國際競爭力的核心要素。版權(quán)作為知識產(chǎn)權(quán)的重要分支,是版權(quán)法賦予版權(quán)作品(包括文學、藝術、科學等)作者的私有財產(chǎn)權(quán)。版權(quán)法起源于英國的《安娜法案》,并被普遍運用到澳大利亞等英聯(lián)邦國家,F(xiàn)代版權(quán)制度以國際版權(quán)組織和版權(quán)公約為主體,結(jié)合各國版權(quán)法對版權(quán)作品進行保護。綜觀各國版權(quán)法,不論是強調(diào)財產(chǎn)權(quán)保護的英美法系,還是強調(diào)人身權(quán)保護的大陸法系,版權(quán)法都表現(xiàn)出明顯的經(jīng)濟特征。各國版權(quán)產(chǎn)業(yè)經(jīng)濟貢獻的數(shù)據(jù)報告更是有力地證明了這一特征。 本文對澳大利亞版權(quán)產(chǎn)業(yè)的經(jīng)濟貢獻進行研究,發(fā)現(xiàn)雖然澳大利亞與中國同為版權(quán)凈進口國,但和大多數(shù)發(fā)達國家一樣,澳大利亞的核心版權(quán)產(chǎn)業(yè)對經(jīng)濟增長貢獻巨大,版權(quán)產(chǎn)業(yè)對澳大利亞國民經(jīng)濟發(fā)展起著至關重要的作用。 為深刻理解澳大利亞版權(quán)產(chǎn)業(yè)的現(xiàn)狀,本文對澳大利亞版權(quán)法的特點及歷史變化過程進行了介紹。發(fā)現(xiàn)澳大利亞在版權(quán)產(chǎn)業(yè)研究(1981年版權(quán)產(chǎn)業(yè)報告)和版權(quán)立法方面(1905年版權(quán)法)都曾處于世界領先地位。二戰(zhàn)后,隨著美國版權(quán)產(chǎn)業(yè)全球霸主地位的確立,澳大利亞因為國家利益的需要,版權(quán)法由受英國影響逐漸轉(zhuǎn)變?yōu)槭苊绹绊。這一點進一步說明了版權(quán)產(chǎn)業(yè)的重要性——版權(quán)產(chǎn)業(yè)的發(fā)展水平影響版權(quán)法的制定。當今澳大利亞的版權(quán)法反應了國際最高水準,澳大利亞的現(xiàn)代知識產(chǎn)權(quán)保護體系在世界排名前十。 澳大利亞與中國的經(jīng)貿(mào)關系十分緊密。在《與貿(mào)易有關的知識產(chǎn)權(quán)協(xié)議》框架下中國政府正加大對版權(quán)的重視力度,努力建設能適應新科技發(fā)展并與中國版權(quán)產(chǎn)業(yè)水平相匹配的有中國特色的版權(quán)保護機制。對澳版權(quán)產(chǎn)業(yè)發(fā)展成就及版權(quán)保護特別之處加以介紹對我國版權(quán)立法和版權(quán)產(chǎn)業(yè)的發(fā)展有著重要的借鑒作用。
[Abstract]:With the in-depth development of knowledge economy and the obvious acceleration of economic globalization, intellectual creation plays a more and more important role in material production and cultural production. Intellectual property rights are increasingly becoming the strategic resources of national development and the core elements of international competitiveness. Copyright, as an important branch of intellectual property rights, is the private property rights granted by copyright law to the authors of copyright works (including literature, art, science, etc.). Copyright law originated from Anna Act and was widely used in Commonwealth countries such as Australia. Modern copyright system takes international copyright organizations and copyright conventions as the main body and protects copyright works in combination with copyright laws of various countries. From a comprehensive view of the copyright laws of various countries, both the Anglo-American law system, which emphasizes the protection of property rights, and the civil law system, which emphasizes the protection of personal rights, the copyright law has obvious economic characteristics. The data report of the economic contribution of copyright industry in various countries proves this characteristic more forcefully. This paper studies the economic contribution of Australian copyright industry, and finds that although Australia and China are net importers of copyright, like most developed countries, Australia's core copyright industry contributes greatly to economic growth. The copyright industry plays a vital role in the development of Australia's national economy. In order to understand the current situation of Australian copyright industry, this paper introduces the characteristics and historical changes of Australian copyright law. Australia was found to be a world leader in copyright industry research (1981 copyright industry report) and copyright legislation (1905 copyright law). After World War II, with the establishment of the global dominance of the American copyright industry, the copyright law of Australia gradually changed from the influence of Britain to the influence of the United States because of the need of national interests. This further explains the importance of copyright industry-the development level of copyright industry affects the establishment of copyright law. Today's Australian copyright law reflects the highest international standards, with Australia's modern intellectual property protection system in the world's top 10. Australia has a very close economic and trade relationship with China. Under the framework of the Agreement on Trade-related intellectual property Rights, the Chinese government is paying more attention to copyright and making great efforts to build a copyright protection mechanism with Chinese characteristics which can adapt to the development of new technology and match the level of China's copyright industry. The development achievements of Australian copyright industry and the special features of copyright protection are introduced in this paper, which can be used for reference to the development of copyright legislation and copyright industry in China.
