安徽省農業(yè)知識產權保護研究

【摘要】：21世紀，隨著全球經濟活動從物質經濟轉向知識經濟，知識正在成為經濟發(fā)展的主推力量，科學技術成為生產力的第一要素。在市場經濟條件下，我國農業(yè)正在由傳統(tǒng)農業(yè)向現(xiàn)代化農業(yè)轉變，正在走產業(yè)化發(fā)展的道路。農業(yè)從農產品的種植養(yǎng)殖到加工利用，這個過程逐漸被細分為若干個環(huán)節(jié)，產業(yè)鏈不斷延伸，進行社會化的管理，市場化的經營。作為支撐農業(yè)發(fā)展和進步的重要環(huán)節(jié)，農業(yè)科技創(chuàng)新作為關鍵要素貫穿了整個農業(yè)產業(yè)鏈。在農業(yè)生產中，利用好科技成果，保護權利人的利益、維護市場經濟秩序、促進經濟發(fā)展等都要求建立知識產權制度。 安徽省十分重視知識產權，制定了多部有關知識產權的地方性法律法規(guī)。然而，在農業(yè)領域，尤其是對農業(yè)科研、生產、銷售等產業(yè)鏈上的知識產權問題缺少梳理，認識不清，相關技術成果或產品在市場競爭上沒有體現(xiàn)出權利人所擁有的權利，權利人的發(fā)明創(chuàng)造性成果沒有得到尊重和保護，創(chuàng)造性的價值也沒有實現(xiàn)。知識產品作為人類創(chuàng)造性勞動成果，如果不能夠對其進行有效的保護，讓知識的創(chuàng)造者得不到合理的回報，不僅會挫傷知識產權所有人的積極性，同時也會影響農業(yè)科技成果的推廣使用。 論文運用知識產權管理、知識產權保護等方面的相關理論，采用比較分析法，，系統(tǒng)分析法，綜合分析法等，在借鑒國內外學者研究成果基礎上，從安徽省農業(yè)知識產權發(fā)展現(xiàn)狀出發(fā)，分析影響安徽省農業(yè)知識產權保護的影響因素，發(fā)現(xiàn)其存在的問題，并提出解決的相關對策和建議，包括加強對農業(yè)知識產權保護相關法律的宣傳、加強安徽省農業(yè)科技創(chuàng)新能力、完善農業(yè)知識產權的激勵機制、提高安徽省農民對農業(yè)知識產品的消費能力、建立健全安徽省農業(yè)知識產權管理制度等。 本文堅持“背景研究——提出問題——分析問題——對策建議”的基本邏輯思路，希望通過安徽省農業(yè)知識產權保護的系統(tǒng)研究，能夠對安徽省知識產權保護提供理論上的有效對策和建議。
[Abstract]:In the 21st century, with the change of global economic activity from material economy to knowledge economy, knowledge is becoming the main driving force of economic development, and science and technology is becoming the first factor of productivity. Under the condition of market economy, China's agriculture is changing from traditional agriculture to modern agriculture, and is taking the road of industrialization development. Agriculture from planting and breeding to processing and utilization of agricultural products, this process is gradually divided into a number of links, the industrial chain continues to extend, socialized management, market-oriented management. As an important link to support the development and progress of agriculture, agricultural scientific and technological innovation runs through the whole agricultural industrial chain as a key factor. In agricultural production, making good use of scientific and technological achievements, protecting the interests of rights holders, maintaining the order of market economy, promoting economic development, and so on, require the establishment of intellectual property rights system. Anhui Province attaches great importance to intellectual property rights, formulated a number of local laws and regulations on intellectual property rights. However, in the field of agriculture, especially in the field of agricultural research, production, sales and other industrial chain intellectual property issues lack of comb, unclear understanding, related technical achievements or products in the market competition does not reflect the rights of the owner of the right, The creative achievements of the obligee's invention have not been respected and protected, and the value of creativity has not been realized. Knowledge products, as the fruits of human creative work, will not only undermine the enthusiasm of intellectual property owners if they cannot be effectively protected and the creators of knowledge will not get a reasonable return. At the same time, it will also affect the popularization and use of agricultural scientific and technological achievements. Based on the relative theories of intellectual property management, intellectual property protection, comparative analysis, system analysis, comprehensive analysis and so on, this paper draws lessons from the research results of domestic and foreign scholars. Based on the development status of agricultural intellectual property rights in Anhui Province, this paper analyzes the influential factors affecting the protection of agricultural intellectual property rights in Anhui Province, finds out the existing problems, and puts forward some countermeasures and suggestions to solve these problems. These include strengthening the publicity of laws related to the protection of agricultural intellectual property rights, strengthening the ability of agricultural scientific and technological innovation in Anhui Province, perfecting the incentive mechanism of agricultural intellectual property rights, and improving the consumption capacity of farmers in Anhui Province for agricultural intellectual property products. Establish and perfect the management system of agricultural intellectual property rights in Anhui Province. This paper insists on the basic logical thinking of "background study-putting forward problems-analyzing problems-countermeasures and suggestions", and hopes to make a systematic study on the protection of agricultural intellectual property rights in Anhui Province. Can provide theoretical effective countermeasures and suggestions to the protection of intellectual property rights in Anhui Province.
