【摘要】：著作權集體管理已經成為當下備受關注的制度,甚至成為衡量一個國家版權保護程度的基準。目前,我國音樂、音像、文字、攝影、電影等領域的版權集體管理組織相繼成立,正在努力開展相關的工作任務。在文化市場中,版權費征收的糾紛經常出現,反映了集體管理中的壟斷和反壟斷問題。我國著作權集體管理組織與世界上其他國家相比并沒有太長的發(fā)展歷史,但卻更容易出現濫用市場支配地位的現象,破壞市場競爭秩序的壟斷行為也很頻繁地發(fā)生。這與我國的經濟環(huán)境和社會基礎有關,但也是該項制度不完善的惡果。我們需要做的就是借鑒其他地區(qū)的相關經驗,不斷完善我國的制度模式,提高中國的著作權集體管理組織維護著作權人利益的水平,竭盡全力保護文化軟實力的生產者以及問世作品的應有價值。
[Abstract]:The collective management of copyright has become a concerned system and even a benchmark to measure the degree of copyright protection in a country. At present, China's music, audio and video, text, photography, film and other areas of copyright collective management organizations have been established, is working hard to carry out related tasks. In the cultural market, disputes over royalty collection often occur, reflecting the monopoly and antitrust problems in collective management. Compared with other countries in the world, the collective management organization of copyright in our country has no long history of development, but it is more likely to abuse the dominant position of the market, and the monopoly behavior of destroying the order of market competition occurs frequently. This is related to our country's economic environment and social foundation, but it is also the result of the imperfect system. What we need to do is to learn from the relevant experiences of other regions, constantly improve our country's institutional model, and improve the level of the copyright collective management organizations in China to safeguard the interests of copyright owners. Make every effort to protect the producers of cultural soft power and the due value of the published works.
