實(shí)用藝術(shù)作品知識(shí)產(chǎn)權(quán)保護(hù)研究

【摘要】:實(shí)用藝術(shù)作品是兼具實(shí)用性和藝術(shù)性的一類特殊作品,是《伯爾尼公約》規(guī)定的保護(hù)對(duì)象之一。世界各國(guó)已經(jīng)普遍對(duì)實(shí)用藝術(shù)作品提供知識(shí)產(chǎn)權(quán)保護(hù),而我國(guó)的相關(guān)法律對(duì)此立場(chǎng)不明。本文通過(guò)分析和比較我國(guó)知識(shí)產(chǎn)權(quán)法與外國(guó)知識(shí)產(chǎn)權(quán)法的立法內(nèi)容和司法實(shí)踐之異同,試圖為完善我國(guó)實(shí)用藝術(shù)作品的知識(shí)產(chǎn)權(quán)保護(hù)提出建議。本文主要包括前言、正文、結(jié)語(yǔ)和致謝。 正文主要由四個(gè)部分組成。第一部分為實(shí)用藝術(shù)作品的概述。本章通過(guò)下定義和比較相關(guān)概念的方式對(duì)實(shí)用藝術(shù)作品的基本概念進(jìn)行界定,并對(duì)實(shí)用藝術(shù)作品的特征和類型進(jìn)行分析。第二部分為實(shí)用藝術(shù)作品知識(shí)產(chǎn)權(quán)保護(hù)研究,主要介紹相關(guān)國(guó)際公約的規(guī)定和西方國(guó)家的法律概況。并以美國(guó)為代表,圍繞保護(hù)模式和法律定性兩個(gè)問(wèn)題對(duì)其相關(guān)立法與司法實(shí)踐做詳細(xì)介紹,同時(shí)指出其不足,為我國(guó)制度完善提供借鑒參考。第三部分主要介紹我國(guó)實(shí)用藝術(shù)作品知識(shí)產(chǎn)權(quán)保護(hù)的現(xiàn)狀并對(duì)其進(jìn)行評(píng)價(jià)。分別有兩個(gè)重點(diǎn),,其中之一是我國(guó)實(shí)用藝術(shù)作品知識(shí)產(chǎn)權(quán)保護(hù)的立法現(xiàn)狀及評(píng)價(jià),其二是我國(guó)實(shí)用藝術(shù)作品保護(hù)的司法實(shí)踐及評(píng)價(jià),這兩部分的結(jié)合也是理論和實(shí)踐的統(tǒng)一。第四部分提出完善我國(guó)實(shí)用藝術(shù)作品知識(shí)產(chǎn)權(quán)保護(hù)制度的建議。結(jié)合我國(guó)國(guó)情和立法狀況,分析單一保護(hù)模式和雙重保護(hù)模式的利弊,指出設(shè)立專門單行法的必要性和可行性,為我國(guó)實(shí)用藝術(shù)作品的完善提出自己的建議。
[Abstract]:Practical works of art is a kind of special works with both practicality and artistry, which is one of the protected objects stipulated in the Berne Convention. Countries all over the world have offered intellectual property protection to practical works of art. By analyzing and comparing the legislative content and judicial practice of China's intellectual property law and foreign intellectual property law, this paper tries to put forward some suggestions for perfecting the intellectual property protection of practical works of art in China. This paper mainly includes preface, text, conclusion and thanks. The main body consists of four parts. The first part is an overview of practical works of art. In this chapter, the basic concepts of practical works of art are defined by defining and comparing relevant concepts, and the characteristics and types of practical works of art are analyzed. The second part is the research on intellectual property protection of practical works of art, which mainly introduces the provisions of relevant international conventions and the legal situation of western countries. Taking the United States as a representative, the author makes a detailed introduction to the relevant legislation and judicial practice around the two issues of protection mode and legal characterization, and points out its shortcomings, which provides a reference for the perfection of our country's system. The third part mainly introduces the current situation of intellectual property protection of practical works of art in China and evaluates it. There are two key points, one of which is the legislative status and evaluation of intellectual property protection of practical works of art in China, the other is the judicial practice and evaluation of the protection of practical works of art in China. The combination of these two parts is also the unity of theory and practice. The fourth part puts forward some suggestions to perfect the intellectual property protection system of practical works of art in China. This paper analyzes the advantages and disadvantages of the single protection mode and the dual protection mode, and points out the necessity and feasibility of establishing the special law, and puts forward some suggestions for the perfection of our country's practical works of art.
