【摘要】：近年來(lái),市場(chǎng)經(jīng)濟(jì)飛速發(fā)展,知識(shí)經(jīng)濟(jì)迅猛崛起,在國(guó)民經(jīng)濟(jì)建設(shè)中,無(wú)形資產(chǎn)發(fā)揮著越來(lái)越大的作用,知識(shí)產(chǎn)權(quán)作為無(wú)形資產(chǎn)的重要內(nèi)容,在長(zhǎng)期的實(shí)際工作中,其轉(zhuǎn)化愈加困難,故此,進(jìn)一步加快深入研究知識(shí)產(chǎn)權(quán)質(zhì)押?jiǎn)栴}的步伐有其必要性。 知識(shí)產(chǎn)權(quán)質(zhì)押作為一種特殊的權(quán)利質(zhì)押,解決了我國(guó)借貸中過(guò)分依賴不動(dòng)產(chǎn)作為質(zhì)押的問(wèn)題,充分利用了知識(shí)產(chǎn)權(quán)的財(cái)產(chǎn)價(jià)值及使用價(jià)值,豐富了融資途徑,有利于社會(huì)資源的充分利用。在我國(guó),現(xiàn)行的《擔(dān)保法》建立了知識(shí)產(chǎn)權(quán)質(zhì)押體系,商標(biāo)專用權(quán)、專利權(quán)、著作權(quán)中依法可以轉(zhuǎn)讓的的財(cái)產(chǎn)權(quán)可以設(shè)質(zhì)。目前,中國(guó)的法律過(guò)于概括的規(guī)定知識(shí)產(chǎn)權(quán)質(zhì)押,導(dǎo)致其在實(shí)踐中的可操作性較差,知識(shí)產(chǎn)權(quán)質(zhì)押沒(méi)有得到充分的利用。這是因?yàn)槔碚撗芯�、立法技術(shù)不成熟等原因,綜上所述,深入探討知識(shí)產(chǎn)權(quán)質(zhì)押中的一系列法律問(wèn)題顯得尤為重要。 本文針對(duì)以上問(wèn)題,對(duì)知識(shí)產(chǎn)權(quán)標(biāo)的的范圍、質(zhì)押的特征、概念；知識(shí)產(chǎn)權(quán)質(zhì)押效力的范圍；知識(shí)產(chǎn)權(quán)質(zhì)押的設(shè)定；及其消滅與實(shí)現(xiàn)我國(guó)知識(shí)產(chǎn)權(quán)質(zhì)押制度中的問(wèn)題進(jìn)行的探討,就是為了深入認(rèn)識(shí)知識(shí)產(chǎn)權(quán)質(zhì)押的相關(guān)理論,令知識(shí)產(chǎn)權(quán)質(zhì)押制度具有可操作性,進(jìn)而使我國(guó)現(xiàn)行的知識(shí)產(chǎn)權(quán)質(zhì)押制度得到進(jìn)一步完善。
[Abstract]:In recent years, with the rapid development of market economy and the rapid rise of knowledge economy, intangible assets play a more and more important role in the construction of national economy. Therefore, it is necessary to speed up further research on intellectual property pledge. As a special pledge of rights, the pledge of intellectual property solves the problem of excessive reliance on immovable property as pledge in our country, makes full use of the property value and use value of intellectual property, and enriches the way of financing. It is beneficial to the full utilization of social resources. In our country, the current "guarantee Law" establishes the system of intellectual property pledge, trademark exclusive right, patent right, copyright can be transferred in accordance with the law property rights can be pledged. At present, the Chinese law is too general to stipulate intellectual property pledge, which leads to its poor operability in practice, and the intellectual property pledge has not been fully utilized. This is due to the theoretical research and immature legislative technology. In summary, it is particularly important to explore a series of legal issues in intellectual property pledge. In this paper, the scope of intellectual property rights subject matter, the characteristics of pledge, the concept of intellectual property pledge, the scope of the validity of intellectual property pledge, the setting of intellectual property pledge; In order to understand the relevant theories of intellectual property pledge and make the system of intellectual property pledge operable, Thus, the current intellectual property pledge system in China has been further improved.
