【摘要】："一帶一路"沿線國家隸屬法系不同,對外開放程度、法治狀況和市場化水平、貿(mào)易保護(hù)政策差異較大,中國企業(yè)在參與共建"一帶一路"中可能會遭遇因投資貿(mào)易、市場準(zhǔn)入、知識產(chǎn)權(quán)保護(hù)、金融交易、勞工問題、環(huán)境保護(hù)等引發(fā)的法律風(fēng)險。面對諸多法律風(fēng)險,政府可通過與投資伙伴國簽署投資保護(hù)協(xié)議,建立海外投資貿(mào)易咨詢、指導(dǎo)、服務(wù)機(jī)構(gòu)及相關(guān)制度,有針對性地開展風(fēng)險管控專項(xiàng)培訓(xùn),優(yōu)化創(chuàng)新海外投資保險制度等措施加以應(yīng)對。企業(yè)應(yīng)學(xué)習(xí)和研究"一帶一路"沿線國家和地區(qū)的相關(guān)法律,嚴(yán)格依法經(jīng)營,遵守國際貿(mào)易規(guī)則,重視爭端解決機(jī)制,善于利用中介機(jī)構(gòu)進(jìn)行盡職調(diào)查,提高自身風(fēng)險防范意識。
[Abstract]:The countries along the "Belt and Road" line belong to different legal systems, the degree of opening to the outside world, the state of the rule of law and the level of marketization, and trade protection policies are quite different. Chinese enterprises may encounter investment trade in participating in the co-construction of "Belt and Road." Market access, intellectual property protection, financial transactions, labor issues, environmental protection and other legal risks. In the face of many legal risks, the government may, by signing investment protection agreements with its investment partners, establish overseas investment and trade consultation, guidance, service agencies and related systems, and conduct targeted training on risk management. To optimize and innovate the overseas investment insurance system and other measures to deal with. Enterprises should study and study the relevant laws of countries and regions along "Belt and Road", strictly operate according to law, abide by the rules of international trade, attach importance to the dispute settlement mechanism, and be good at making use of intermediaries to conduct due diligence. Improve their own awareness of risk prevention.
