【摘要】：正知識產(chǎn)權(quán)法的基本原則是知識產(chǎn)權(quán)法理論中的一個基礎(chǔ)性問題,對立法和司法實踐都具有直接的指導(dǎo)意義。經(jīng)過考察,筆者認為,基于知識產(chǎn)權(quán)及其客體的性質(zhì)、特征以及知識產(chǎn)權(quán)法的目的、作用, 知識產(chǎn)權(quán)法的基本原則應(yīng)當(dāng)包括鼓勵和保護以智力創(chuàng)造為主的知識產(chǎn)品創(chuàng)新活動原則、知識產(chǎn)權(quán)法定原則、知識
[Abstract]:The basic principle of positive intellectual property law is a basic problem in the theory of intellectual property law, which has direct guiding significance to legislation and judicial practice. After investigation, the author believes that, based on the nature and characteristics of intellectual property and its object, as well as the purpose of intellectual property law, The basic principles of intellectual property law should include the principle of encouraging and protecting intellectual product innovation, the legal principle of intellectual property, and the principle of knowledge.
