【摘要】：全面深化改革是當今時代的潮流,是當今中國的主旋律。加快推進產(chǎn)業(yè)的轉(zhuǎn)型升級發(fā)展,加快轉(zhuǎn)變經(jīng)濟發(fā)展方式是深化改革的重要內(nèi)容。知識產(chǎn)權(quán)制度作為激勵發(fā)明創(chuàng)造,推進產(chǎn)業(yè)發(fā)展,是參與國際競爭的一種重要手段。在經(jīng)濟全球化,科技日新月異的環(huán)境下,知識產(chǎn)權(quán)制度的重要性已經(jīng)日益凸顯,儼然成為一個國家促進經(jīng)濟發(fā)展的重要手段,加強知識產(chǎn)權(quán)管理和制度的建設(shè),是世界各國推動經(jīng)濟、科技發(fā)展的重要選擇,是增強一國實力的重要選擇。發(fā)達國家的知識產(chǎn)權(quán)事業(yè)起步較早,已經(jīng)逐步建立了健全的知識產(chǎn)權(quán)保護制度和管理體系,知識產(chǎn)權(quán)已經(jīng)成為發(fā)達國家指導科技創(chuàng)新,優(yōu)化產(chǎn)業(yè)升級,調(diào)整經(jīng)濟結(jié)構(gòu)的重要手段。 由于我國知識產(chǎn)權(quán)事業(yè)起步較晚,在參與國際經(jīng)濟、貿(mào)易過程中缺乏自主知識產(chǎn)權(quán)的核心技術(shù),產(chǎn)業(yè)多以粗放型為主。國際發(fā)達國家利用我國知識產(chǎn)權(quán)制度落后這一弱點,不斷在我國境內(nèi)申報發(fā)明專利,占領(lǐng)技術(shù)市場,我國的創(chuàng)新空間受到了強大的擠壓。在加入WTO以來,由于我國的知識產(chǎn)權(quán)管理體系還不夠健全,國際發(fā)達國家利用技術(shù)性的貿(mào)易壁壘對我國施壓,國內(nèi)企業(yè)的出口產(chǎn)品頻頻受阻,國內(nèi)知名的專利技術(shù)和商標在國外受到排擠和孤立,這都是因為我國知識產(chǎn)權(quán)管理體系發(fā)展落后所引起的。 改革開放以來,我國政府逐漸認識到知識產(chǎn)權(quán)制度對國家發(fā)展的重要性,開始著手大力發(fā)展知識產(chǎn)權(quán)戰(zhàn)略,逐漸建立起較完善的知識產(chǎn)權(quán)管理體系。由于起步較晚,知識產(chǎn)權(quán)管理體系的建設(shè)速度還比較慢,相關(guān)制度還存在著許多的問題。本人是一名地方政府的知識產(chǎn)權(quán)管理工作人員,根據(jù)自己的工作實際,以地方政府知識產(chǎn)權(quán)管理的角度,分析當前經(jīng)濟發(fā)展方式下完善地方政府知識產(chǎn)權(quán)管理體系建設(shè)的方式與對策,并提出意見。 本文從現(xiàn)代公共管理的角度,多方面的展開對地方知識產(chǎn)權(quán)管理體系的研究和探索。國內(nèi)知識產(chǎn)權(quán)相關(guān)研究較少,原因是知識產(chǎn)權(quán)在社會上并沒有廣泛的被認知和重視,本文可彌補這方面研究的不足。由于我國知識產(chǎn)權(quán)管理體系的建設(shè)還在不斷建設(shè)與完善中,面臨著諸多的困難與挑戰(zhàn),因本人的理論水平不高,研究時間有限,本文對地方政府知識產(chǎn)權(quán)管理體系的研究和分析還不夠深入,所提出的想法和建議也還不夠細致和完善,文中難免有不當之處,有待今后學術(shù)界能夠進一步的研究。
[Abstract]:Deepening reform in an all-round way is the trend of the times and the main melody of today's China. Accelerating the transformation and upgrading of industry and changing the mode of economic development are the important contents of deepening the reform. Intellectual property system is an important means to participate in international competition. Under the environment of economic globalization and rapid changes in science and technology, the importance of the intellectual property system has become increasingly prominent and has become an important means for a country to promote economic development, and to strengthen the management of intellectual property rights and the construction of the system. It is an important choice to promote the development of economy, science and technology, and to strengthen the strength of a country. The intellectual property rights of developed countries started early, and they have gradually established a sound intellectual property protection system and management system. Intellectual property rights have become developed countries to guide scientific and technological innovation and optimize industrial upgrading. An important means of readjusting the economic structure. Because of the late start of intellectual property in our country, the lack of core technology of independent intellectual property in the process of participating in international economy and trade, the industry is mostly extensive. The international developed countries take advantage of the weakness of our intellectual property system to declare the invention patent and occupy the technology market in our country constantly, and the innovation space of our country has been squeezed strongly. Since China's entry into WTO, because the intellectual property management system of our country is not perfect enough, international developed countries use technical trade barriers to exert pressure on our country, and the export products of domestic enterprises are frequently blocked. Domestic well-known patent technology and trademark are excluded and isolated in foreign countries, which is caused by the backward development of intellectual property management system in China. Since the reform and opening up, our government gradually realized the importance of the intellectual property system to the development of the country, began to vigorously develop the intellectual property strategy, and gradually set up a more perfect intellectual property management system. Due to the late start, the construction of intellectual property management system is still slow, and there are still many problems in the related system. I am a local government intellectual property management staff, according to their work reality, from the perspective of local government intellectual property management, This paper analyzes the ways and countermeasures of perfecting the local government's intellectual property management system under the current economic development mode, and puts forward some suggestions. From the perspective of modern public management, this paper studies and explores the local intellectual property management system in many aspects. There are few researches on intellectual property right in China, because intellectual property right is not widely recognized and valued in the society, this paper can make up for the deficiency of this research. As the construction of intellectual property management system in our country is still under construction and perfection, it faces many difficulties and challenges, because my theoretical level is not high, and the research time is limited. The research and analysis of the local government intellectual property management system in this paper is not deep enough, the ideas and suggestions put forward are not enough detailed and perfect, and there are inevitably some improper points in the paper, which need to be further studied by the academic circles in the future.
