【摘要】：第十二屆全國(guó)人民代表大會(huì)第二次會(huì)議《政府工作報(bào)告》中提出，讓金融成為一池活水，更好地澆灌小微企業(yè)等實(shí)體經(jīng)濟(jì)之樹。作為一種新型的融資方式，知識(shí)產(chǎn)權(quán)質(zhì)押融資為科技型中小企業(yè)開辟了一條順暢、高效的融資渠道。積極開展知識(shí)產(chǎn)權(quán)質(zhì)押融資業(yè)務(wù)，既有利于科技型中小企業(yè)的快速成長(zhǎng)，又符合國(guó)家加強(qiáng)自主創(chuàng)新、建設(shè)創(chuàng)新型國(guó)家的發(fā)展戰(zhàn)略，同時(shí)有利于商業(yè)銀行拓寬經(jīng)營(yíng)范圍，增強(qiáng)盈利能力。但是，目前我國(guó)的知識(shí)產(chǎn)權(quán)質(zhì)押融資發(fā)展尚不夠成熟，面臨著許多發(fā)展困境，知識(shí)產(chǎn)權(quán)質(zhì)押融資制度也存在許多不健全和不完善的地方，因此，完善我國(guó)的知識(shí)產(chǎn)權(quán)質(zhì)押融資制度對(duì)于知識(shí)產(chǎn)權(quán)質(zhì)押融資的順利開展有一定的促進(jìn)作用。前人對(duì)知識(shí)產(chǎn)權(quán)質(zhì)押融資進(jìn)行了大量的理論和規(guī)范分析，積累了豐富的經(jīng)驗(yàn)和研究成果，為本文的寫作提供了強(qiáng)大的理論支持。 本文研究的目的是通過對(duì)我國(guó)知識(shí)產(chǎn)權(quán)質(zhì)押融資發(fā)展?fàn)顩r的分析，找出制約我國(guó)知識(shí)產(chǎn)權(quán)質(zhì)押融資發(fā)展的主要障礙，在借鑒國(guó)內(nèi)外發(fā)展經(jīng)驗(yàn)的基礎(chǔ)上，提出完善我國(guó)知識(shí)產(chǎn)權(quán)質(zhì)押融資制度的對(duì)策建議，促進(jìn)和推動(dòng)知識(shí)產(chǎn)權(quán)資本化的發(fā)展。首先，本文對(duì)知識(shí)產(chǎn)權(quán)質(zhì)押融資進(jìn)行了理論分析；其次，本文介紹了日、美、德、韓等知識(shí)產(chǎn)權(quán)大國(guó)發(fā)展知識(shí)產(chǎn)權(quán)質(zhì)押融資的先進(jìn)經(jīng)驗(yàn)，歸納總結(jié)出其對(duì)我國(guó)的啟示；再次，本文分析了我國(guó)知識(shí)產(chǎn)權(quán)質(zhì)押融資的發(fā)展歷程和發(fā)展?fàn)顩r，并對(duì)京滬等發(fā)展活躍地區(qū)的實(shí)踐情況進(jìn)行了簡(jiǎn)單介紹，總結(jié)了我國(guó)知識(shí)產(chǎn)權(quán)質(zhì)押融資面臨的主客體、法律、操作等不同層面的發(fā)展困境，最后，本文從運(yùn)行環(huán)境建設(shè)、配套服務(wù)平臺(tái)和開展模式優(yōu)化構(gòu)建等方面提出了完善我國(guó)知識(shí)產(chǎn)權(quán)質(zhì)押融資制度的若干建議。
[Abstract]:In the second session of the Twelfth National people's Congress, the "report on the work of the Government" proposed that finance should become a pool of living water and better irrigate the tree of real economy such as small and micro enterprises. As a new type of financing, intellectual property pledge has opened up a smooth and efficient financing channel for small and medium-sized technological enterprises. Actively developing intellectual property rights pledge financing business is not only conducive to the rapid growth of small and medium-sized scientific and technological enterprises, but also in line with the national development strategy of strengthening independent innovation and building an innovative country, and at the same time is conducive to broadening the scope of business of commercial banks. Increase profitability. However, at present, the development of intellectual property pledge financing in our country is not mature enough, and it is faced with many difficulties, and there are many imperfections and imperfections in the system of intellectual property rights pledge financing. Perfecting the system of intellectual property pledge financing in our country can promote the smooth development of intellectual property mortgage financing. Predecessors have made a lot of theoretical and normative analysis of intellectual property pledge financing, accumulated rich experience and research results, and provided a strong theoretical support for the writing of this paper. The purpose of this paper is to find out the main obstacles that restrict the development of intellectual property mortgage financing in China through the analysis of the development situation of intellectual property pledge financing in China, on the basis of drawing lessons from the development experience of domestic and international intellectual property rights pledge financing. This paper puts forward countermeasures and suggestions to perfect the financing system of intellectual property pledge in China, and promotes the development of intellectual property capitalization. Firstly, this paper makes a theoretical analysis of intellectual property pledge financing; secondly, this paper introduces the advanced experience of developing intellectual property pledge financing in Japan, the United States, Germany, Korea and other intellectual property countries, and sums up its enlightenment to our country. This paper analyzes the development course and situation of intellectual property pledge financing in China, and briefly introduces the practice in Beijing and Shanghai, summarizes the subject and object of intellectual property pledge financing in China, and summarizes the law. Finally, this paper puts forward some suggestions on how to perfect the financing system of intellectual property rights pledge in terms of the construction of operational environment, the supporting service platform and the optimization of development mode.
