【摘要】：在當今社會,正值技術革命時期,要想推動我國社會主義事業(yè)又好又快的建設,推動知識產(chǎn)權發(fā)展是必不可少的。我國知識產(chǎn)權自改革開放以來如井噴式發(fā)展,’極大的帶動了經(jīng)濟發(fā)展。但在這背后卻有一個不容忽視的問題即知識產(chǎn)權的保護刻不容緩。在我國每一年都有大量的知識產(chǎn)權侵權事件發(fā)生,僅僅通過司法保護遠遠不夠。尤其在我國,推動知識產(chǎn)權行政保護的法律制度完善,能夠極大的保護知識產(chǎn)權免受不法侵害,推動知識產(chǎn)權事業(yè)發(fā)展。論文從知識產(chǎn)權行政保護的概念開始論述,闡述知識產(chǎn)權行政保護重要意義,通過分析我國知識產(chǎn)權相關法律法規(guī)規(guī)定與行政保護現(xiàn)狀,闡述現(xiàn)行我國知識產(chǎn)權行政保護基本情況,運用數(shù)據(jù)分析方法,并從機構(gòu)、立法、執(zhí)法、行政保護與司法保護銜接五個方面分析我國知識產(chǎn)權行政保護中存在的問題,剖析外域知識產(chǎn)權行政保護保護經(jīng)驗,并加以借鑒,對我國知識產(chǎn)權行政保護存在的問題提出了較為合理的解決方案。應通過整合知識產(chǎn)權行政保護機構(gòu),設立統(tǒng)一高效的行政機構(gòu),培養(yǎng)高素質(zhì)的知識產(chǎn)權行政人才強化知識產(chǎn)權司法保護能力建設；健全知識產(chǎn)權行政保護的法律體系,規(guī)定知識產(chǎn)權行政執(zhí)法主體的法律責任,完善知識產(chǎn)權行政執(zhí)法體系；依法移送案件杜絕“以罰代刑”,建立完善的證據(jù)轉(zhuǎn)化規(guī)則,建立知識產(chǎn)權專業(yè)鑒定體系,加強知識產(chǎn)權行政保護與司法保護的銜接；嚴格按照行政程序基本原則,確保程序正義,避免行政權力濫用,損害當事人利益。
[Abstract]:In today's society, it is necessary to promote the development of intellectual property in order to promote the construction of socialism in China. China's intellectual property rights since the reform and opening up, such as blowout development has greatly driven economic development. However, behind this there is a problem that can not be ignored, that is, the protection of intellectual property rights is urgent. There are a large number of intellectual property infringement incidents in our country every year, only through judicial protection is not enough. Especially in our country, the perfect legal system to promote the administrative protection of intellectual property can greatly protect intellectual property from illegal infringement and promote the development of intellectual property. This paper begins with the concept of administrative protection of intellectual property, expounds the important significance of administrative protection of intellectual property, and analyzes the relevant laws and regulations of intellectual property and the present situation of administrative protection in China. This paper expounds the basic situation of administrative protection of intellectual property in our country, analyzes the problems existing in the administrative protection of intellectual property in our country from five aspects: organization, legislation, law enforcement, administrative protection and judicial protection, using the method of data analysis. This paper analyzes the experience of administrative protection of intellectual property rights in foreign regions and draws lessons from it, and puts forward more reasonable solutions to the problems existing in administrative protection of intellectual property rights in China. Through the integration of administrative protection institutions for intellectual property rights, the establishment of a unified and efficient administrative body, the training of high-quality intellectual property administrative personnel to strengthen the capacity of intellectual property rights judicial protection, and improve the legal system of intellectual property administrative protection, To stipulate the legal responsibility of the subject of administrative enforcement of intellectual property rights, to perfect the system of administrative enforcement of intellectual property rights, to put an end to "punishment instead of punishment" by transferring cases according to law, to establish perfect rules for the conversion of evidence, and to establish a system of professional appraisal of intellectual property, Strengthen the link between the administrative protection of intellectual property and judicial protection, strictly follow the basic principles of administrative procedures, ensure procedural justice, avoid abuse of administrative power, harm the interests of the parties concerned.
