【摘要】： 在知識經(jīng)濟(jì)時代，知識產(chǎn)權(quán)對經(jīng)濟(jì)增長和國際貿(mào)易的作用日漸重大，知識產(chǎn)權(quán)保護(hù)也成為各國高度重視的熱點問題，我國在知識產(chǎn)權(quán)保護(hù)中存在的不足直接導(dǎo)致我國在對外貿(mào)易中遭遇某些不公，為此，我們要加強知識產(chǎn)權(quán)保護(hù)，以促進(jìn)我國對外貿(mào)易既快又好的發(fā)展。本文將著重分析知識產(chǎn)權(quán)保護(hù)對我國對外貿(mào)易的影響，并提出加強知識產(chǎn)權(quán)保護(hù)的基本方略，力爭使文章的論述兼具理論意義和現(xiàn)實意義。 (1)將產(chǎn)權(quán)經(jīng)濟(jì)學(xué)理論與國際貿(mào)易理論相結(jié)合，構(gòu)建了新穎的知識產(chǎn)權(quán)保護(hù)理論分析框架。該框架以產(chǎn)權(quán)經(jīng)濟(jì)學(xué)中的外部性理論和交易費用理論為基點，進(jìn)一步融合國際貿(mào)易理論中的產(chǎn)品生命周期理論、比較優(yōu)勢和競爭優(yōu)勢理論，闡述了加強知識產(chǎn)權(quán)保護(hù)的理論合理性。這種理論框架突破了長期以來理論分析中單一體系的傳統(tǒng)，將原本分屬兩個不同研究體系的產(chǎn)權(quán)理論與貿(mào)易理論融合起來，是一種創(chuàng)新嘗試。它為深入分析知識產(chǎn)權(quán)保護(hù)與我國對外貿(mào)易的關(guān)系提供了強有力的理論支撐。 (2)選擇宏、中觀兩個角度構(gòu)建兩大模型進(jìn)行實證分析，揭示了知識產(chǎn)權(quán)保護(hù)在我國對外貿(mào)易的宏觀和中觀領(lǐng)域的影響作用。所建模型中一個是論證專利申請對我國進(jìn)出口貿(mào)易的影響，具有宏觀總體特征，一個是論證專利申請對高新技術(shù)產(chǎn)品出口額的影響，具有中觀產(chǎn)業(yè)特征。對于高新技術(shù)產(chǎn)業(yè)的選取，主要是看中它在說明問題時有突出的代表性和典型性，這種變量的選擇方法完全是從論證需要出發(fā)，不搞全面主義，不盲從傳統(tǒng)手法，構(gòu)成了本文在定量分析中的獨有特色。 (3)從專業(yè)的貿(mào)易視角出發(fā)，分析我國知識產(chǎn)權(quán)保護(hù)中存在的問題，經(jīng)由層層推理，剖析出知識產(chǎn)權(quán)保護(hù)對我國對外貿(mào)易產(chǎn)生的影響。通過重點分析日漸白熱化的知識產(chǎn)權(quán)糾紛問題，指出知識產(chǎn)權(quán)保護(hù)在對我國進(jìn)出口貿(mào)易、加工貿(mào)易、吸引FDI、吸收技術(shù)擴(kuò)散等與貿(mào)易有關(guān)的各方面產(chǎn)生的巨大影響，得出要重視并加強我國知識產(chǎn)權(quán)保護(hù)的結(jié)論。這一分析推理的邏輯體系非常完整，與主題無關(guān)的材料不做贅述，整個表述精練到位，力證主題，構(gòu)成了文章最核心的部分。 (4)提出促進(jìn)我國與貿(mào)易有關(guān)的知識產(chǎn)權(quán)保護(hù)的基本方略，，覆蓋制度、戰(zhàn)略、法律、企業(yè)等幾個層面，兼具全面性和針對性。論述了要從完善知識產(chǎn)權(quán)制度、實施知識產(chǎn)權(quán)戰(zhàn)略；強化知識產(chǎn)權(quán)保護(hù)意識、創(chuàng)造良好社會氛圍；增強企業(yè)自主創(chuàng)新能力等幾大方面入手加強我國知識產(chǎn)權(quán)保護(hù)，促進(jìn)我國對外貿(mào)易發(fā)展。這樣的建議思路兼顧了國家、企業(yè)和公民各幾大社會主體，做到了宏微觀相結(jié)合，由大及小，層層入微，有很強的可行性。 (5)采用有直觀性的數(shù)據(jù)、圖表、公式來說明問題，與文字性表述相輔相成，增強說服力。在我國知識產(chǎn)權(quán)保護(hù)的現(xiàn)狀部分，根據(jù)不同的說明需要，制作折線圖、柱形圖、餅狀圖來反映有關(guān)變量的總體數(shù)量、比重大小、發(fā)展趨勢等，增強了分析的量化力度。突出數(shù)理分析是經(jīng)濟(jì)學(xué)研究的自我特色，用真實數(shù)據(jù)說話是本文的強調(diào)重點，這一切都為論證本文論點做了很大貢獻(xiàn)。
[Abstract]:In the era of knowledge economy, the role of intellectual property in economic growth and international trade is becoming more and more important, and the protection of intellectual property has become a hot issue that all countries attach great importance to. Our country's deficiencies in intellectual property protection directly lead to some injustice in our foreign trade. Therefore, we should strengthen the protection of intellectual property to promote the protection of intellectual property. China's foreign trade is both fast and good. This article will focus on the analysis of the impact of intellectual property protection on China's foreign trade, and put forward the basic strategy to strengthen the protection of intellectual property rights, and strive to make the article's discussion both theoretical and practical.
(1) combining the theory of property right economics with the international trade theory, a new theoretical framework for the protection of intellectual property rights is constructed. The framework is based on the externality theory and transaction cost theory in property rights economics, and further integrates the theory of product life cycle in international trade theory, comparative advantage and competitive advantage theory, and the theory of comparative advantage and competitive advantage is expounded. Strengthening the theoretical rationality of intellectual property protection. This theoretical framework breaks through the tradition of a single system in theoretical analysis for a long time. It is an innovative attempt to integrate the property rights theory and trade theory which was originally divided into two different research systems. It provides an in-depth analysis of the relationship between the protection of intellectual property rights and the relationship between China's foreign trade. Strong theoretical support.
(2) an empirical analysis of the macro and meso two models is constructed by selecting macro and meso two angles. The impact of intellectual property protection on China's foreign trade is revealed. One of the models is a demonstration of the impact of patent application on China's import and export trade, which has macro overall characteristics, and the other is to demonstrate the application of patent application to high and new technology. The influence of the export volume of the product has the characteristics of the meso industry. (3) from the perspective of professional trade, this paper analyzes the problems existing in the protection of intellectual property in China and analyzes the impact of intellectual property protection on our foreign trade through layers of reasoning. Through the analysis of the increasingly white hot issues of intellectual property rights, it is pointed out that the protection of intellectual property rights is in the import and export trade, processing trade and F in China. DI, absorbing the huge impact of the diffusion of technology and other trade related aspects, draws the conclusion that we should attach importance to and strengthen the protection of intellectual property in our country. (4) put forward the basic strategy of promoting the protection of intellectual property rights related to trade in our country, covering the system, strategy, law, enterprise and so on. It is discussed that it is necessary to improve the intellectual property system, implement the intellectual property strategy, strengthen the awareness of intellectual property protection, create a good social atmosphere, and enhance the independent innovation of the enterprise. Capacity and other major aspects to strengthen the protection of intellectual property rights in China and promote the development of China's foreign trade. This suggestion has taken into account several major social subjects of the state, enterprises and citizens, and the combination of macro and micro, from large and small to small, has a strong feasibility.
(5) the use of intuitive data, charts, formulas to explain the problem, and the literal expression complement each other, enhance persuasion. In the current status of intellectual property protection in China, according to the needs of the different description, making the fold map, the column chart, the pie chart to reflect the total quantity of the relevant variables, the proportion size, the development trend and so on, enhanced the analysis. Quantitative analysis is the self characteristic of economic research. Speaking with real data is the emphasis of this article, all of which have made a great contribution to the argument of this thesis.
