【摘要】:隨著經(jīng)濟(jì)和科學(xué)技術(shù)的迅猛發(fā)展,知識(shí)產(chǎn)權(quán)在國(guó)際競(jìng)爭(zhēng)中的作用日漸凸顯。作為文化的重要組成部分,知識(shí)產(chǎn)權(quán)文化是由有關(guān)知識(shí)產(chǎn)權(quán)的價(jià)值觀念、道德規(guī)范、法律法規(guī)、服務(wù)和管理體系及行為方式等構(gòu)成的有機(jī)整體,包括知識(shí)產(chǎn)權(quán)觀念文化、知識(shí)產(chǎn)權(quán)制度文化、知識(shí)產(chǎn)權(quán)物態(tài)文化和知識(shí)產(chǎn)權(quán)行為文化四方面內(nèi)容,具有激發(fā)創(chuàng)新意識(shí)、營(yíng)造創(chuàng)新氛圍、激勵(lì)創(chuàng)新發(fā)展等價(jià)值。 自2003年世界知識(shí)產(chǎn)權(quán)組織首次提出“知識(shí)產(chǎn)權(quán)文化”概念后,國(guó)內(nèi)學(xué)界開(kāi)始了關(guān)于知識(shí)產(chǎn)權(quán)文化的相關(guān)研究。2007年10月,黨的十七大提出“提升國(guó)家文化軟實(shí)力”的戰(zhàn)略構(gòu)想。2008年6月,國(guó)務(wù)院頒布的《國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要》中將知識(shí)產(chǎn)權(quán)文化培育列為國(guó)家戰(zhàn)略,為我國(guó)知識(shí)產(chǎn)權(quán)文化培育提供了重要的政策依據(jù)。因此,本選題的研究,對(duì)于踐行社會(huì)主義核心價(jià)值體系,營(yíng)造創(chuàng)新氛圍,促進(jìn)科技發(fā)展,提升國(guó)家文化軟實(shí)力具有理論和現(xiàn)實(shí)意義。 本文采用文獻(xiàn)研究、實(shí)證研究、比較研究等研究方法,以國(guó)家知識(shí)產(chǎn)權(quán)局兩次全國(guó)性調(diào)查結(jié)果為主要分析樣本,突破以往研究中多以知識(shí)產(chǎn)權(quán)代替知識(shí)產(chǎn)權(quán)文化的思維局限,注重“文化”的語(yǔ)義表現(xiàn)以及“培育”的目標(biāo)指向,對(duì)我國(guó)知識(shí)產(chǎn)權(quán)文化培育進(jìn)行了較為全面系統(tǒng)的研究。論文詳細(xì)介紹了文化、傳統(tǒng)文化、現(xiàn)代文化、知識(shí)產(chǎn)權(quán)、文化軟實(shí)力和知識(shí)產(chǎn)權(quán)文化等基本概念,闡釋了知識(shí)產(chǎn)權(quán)文化的特征、價(jià)值和內(nèi)容構(gòu)成等基本范疇;以馬克思主義文化理論為指導(dǎo),借鑒中華傳統(tǒng)文化的優(yōu)秀思想,依據(jù)我國(guó)知識(shí)產(chǎn)權(quán)文化培育的相關(guān)政策,立足我國(guó)知識(shí)產(chǎn)權(quán)文化培育的現(xiàn)狀,客觀分析取得的成就,剖析存在的問(wèn)題及其成因;從歷程、基本模式、啟示等方面全面考察了美、日、韓、德等國(guó)知識(shí)產(chǎn)權(quán)文化培育的實(shí)踐,提煉出美國(guó)四載體多向互動(dòng)、日本三主體參與教育、韓國(guó)五計(jì)劃戰(zhàn)略主導(dǎo)、德國(guó)兩維度協(xié)同發(fā)展等國(guó)外知識(shí)產(chǎn)權(quán)文化培育的基本模式;在確立我國(guó)知識(shí)產(chǎn)權(quán)文化培育的原則方針及目標(biāo)基礎(chǔ)上,提出注重觀念培養(yǎng)、完善制度建設(shè)、夯實(shí)物態(tài)基礎(chǔ)、加強(qiáng)行為引導(dǎo)等推進(jìn)我國(guó)知識(shí)產(chǎn)權(quán)文化培育的對(duì)策思考。
[Abstract]:With the rapid development of economy and science and technology, the role of intellectual property rights in international competition is becoming increasingly prominent. As an important part of culture, intellectual property culture is an organic whole composed of intellectual property values, ethics, laws and regulations, service and management system and behavior. Intellectual property system culture, intellectual property material culture and intellectual property behavior culture have the value of stimulating innovation consciousness, creating innovation atmosphere and encouraging innovation development. Since the World intellectual property Organization (WIPO) first introduced the concept of "intellectual property culture" in 2003, scholars in China have begun to study the culture of intellectual property. The Seventeenth National Congress of the Communist Party of China put forward the strategic idea of "enhancing the soft power of national culture." in June 2008, the State Council promulgated the outline of the National intellectual property Strategy, which included the cultivation of intellectual property culture as a national strategy. It provides an important policy basis for the cultivation of intellectual property culture in China. Therefore, the study of this topic has theoretical and practical significance for practicing the socialist core value system, creating an innovative atmosphere, promoting the development of science and technology, and promoting the soft power of national culture. In this paper, literature research, empirical research, comparative research and other research methods are used to analyze the results of two national surveys of the State intellectual property Office as the main analysis samples, breaking through the limitations of thinking that intellectual property rights replace intellectual property culture in previous studies. Focusing on the semantic expression of "culture" and the goal of "cultivation", this paper makes a comprehensive and systematic study on the cultivation of intellectual property culture in China. The basic concepts of culture, traditional culture, modern culture, intellectual property rights, cultural soft power and intellectual property culture are introduced in detail. Under the guidance of Marxist cultural theory, drawing lessons from the excellent thoughts of Chinese traditional culture, according to the relevant policies of intellectual property culture cultivation in China, based on the current situation of intellectual property culture cultivation in China, the paper objectively analyzes the achievements made. By analyzing the existing problems and their causes, examining the practice of cultivating intellectual property culture in the United States, Japan, South Korea and Germany from the aspects of history, basic mode and enlightenment, the author abstracts the four carriers of the United States and the three main bodies of Japan to participate in education. The basic mode of foreign intellectual property culture cultivation, such as Korea's five plan strategy leading and Germany's two dimensions coordinated development, is put forward on the basis of establishing the principle, policy and goal of our country's intellectual property culture cultivation, putting forward paying attention to the concept cultivation, perfecting the system construction, and so on. The countermeasures to promote the cultivation of intellectual property culture in China are to consolidate the material state foundation and strengthen the behavior guidance.
