【摘要】:發(fā)明創(chuàng)造是直接產生經濟價值乃至社會價值的源泉,是實現(xiàn)產業(yè)及其社會發(fā)展戰(zhàn)略的重要因素。在經濟全球化不斷發(fā)展的今天,發(fā)明創(chuàng)造的地位已不再是只處于個人權利的高度,而是越來越受到國家和單位的高度重視。職務發(fā)明作為發(fā)明創(chuàng)造的重要組成部分,其數量和質量成為衡量一個國家競爭力和創(chuàng)新力的指標。縱觀世界發(fā)達國家,無不在力求實現(xiàn)雇主與發(fā)明人利益均衡的目標下,在職務發(fā)明權利歸屬及經濟補償方面對發(fā)明人施以政策傾斜。本文主要以我國現(xiàn)有法律規(guī)定為依據,分析我國對職務發(fā)明人的權益保障無論在實體方面還是程序方面尚存在許多不足之處,并根據發(fā)達國家的成功經驗,提出適合我國國情的對策,從而使職務發(fā)明制度真正成為催生我國重大自主科技創(chuàng)新,建設創(chuàng)新型國家的催化劑和加速器。 本文除緒論和結論部分以外,共有四個章節(jié):第一部分主要介紹職務發(fā)明人權益保護的理論分析,首先介紹了職務發(fā)明制度的產生;其次,列舉了職務發(fā)明與非職務發(fā)明最主要的區(qū)別;最后,分析了職務發(fā)明包含的兩種利益平衡,包括發(fā)明人利益與公共利益,發(fā)明人利益與單位利益的平衡。第二部分是我國職務發(fā)明制度的相關規(guī)定及存在的問題。主要體現(xiàn)在職務發(fā)明范圍的界定、獎酬的計算、權利的救濟等方面。第三部分介紹了發(fā)達國家和我國部分地區(qū)的規(guī)定。主要介紹了日本、美國、法國。德國的規(guī)定,以及武漢、南京、北京等地的規(guī)定。從中找出可借鑒之處。第四部分,主要是完善制度的建議。包括重新界定職務發(fā)明范圍、侵犯署名權情節(jié)嚴重可要求精神損害賠償、獎酬制度的完善、司法救濟的完善等內容。
[Abstract]:Invention and creation is the source of economic value and social value directly. It is an important factor to realize the industry and its social development strategy. In the continuous development of economic globalization, the position of invention and creation is no longer only in the height of individual rights, but more and more highly valued by the state and unit. An important part of the creation of Ming Dynasty, its quantity and quality become an indicator of the competitiveness and innovation of a country. The legal provisions are based on the analysis of our country's protection of the rights and interests of the post inventor in both substantive and procedural aspects, and according to the successful experience of the developed countries, puts forward the countermeasures suitable for the national conditions of our country, thus making the system of the job invention truly a major independent scientific and technological innovation and an innovative country in China. The catalyst and accelerator of the family.
In addition to the introduction and conclusion part, there are four chapters in this paper. The first part mainly introduces the theoretical analysis of the rights and interests protection of the post inventor. First, it introduces the generation of the system of job invention. Secondly, it enumerates the main differences between the job invention and the non job invention. Finally, it analyzes the two kinds of balance of interests included in the job invention, including the balance of the job inventions. The interests of the inventor and the public interest, the interests of the inventor and the interests of the unit are balanced. The second part is the relevant provisions and existing problems of the system of Duty Invention in our country. It mainly embodies in the definition of the scope of the job invention, the calculation of the reward, the relief of the rights, and so on. The third part introduces the provisions of the developed countries and parts of our country. The provisions of Japan, the United States, France and Germany, as well as the provisions of Wuhan, Nanjing, Beijing and other places are introduced. The fourth part is mainly to improve the system's suggestions, including the redefinition of the scope of the job invention, the serious infringement of the right of signature, the compensation for mental damage, the perfection of the reward system, the perfection of judicial relief, etc. Content.
