【摘要】：隨著全球經(jīng)濟(jì)一體化過程的推進(jìn)和科學(xué)技術(shù)的進(jìn)步，與國際貿(mào)易相關(guān)的知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)工作越來越重要。加強(qiáng)我國知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)，維護(hù)經(jīng)濟(jì)秩序、保護(hù)進(jìn)出口企業(yè)的合法權(quán)益是當(dāng)前我國海關(guān)的一項(xiàng)重要工作，同時(shí)也要通過知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)，為我所用，化解國際輿論對(duì)我國的誤解和偏見，消除知識(shí)產(chǎn)權(quán)霸權(quán)。 本文選取了我國知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)工作中的程序問題進(jìn)行研究。介紹了我國知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)程序的理論，對(duì)內(nèi)比較了工商行政管理部門知識(shí)產(chǎn)權(quán)保護(hù)的程序，對(duì)外比較分析了美國、我國香港地區(qū)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)的程序。在此基礎(chǔ)上，按照我國知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)程序的先后順序，分別對(duì)備案程序、查扣與調(diào)查程序、處罰及侵權(quán)貨物的處理程序進(jìn)行了論述，分析了法律規(guī)定和現(xiàn)狀，，找出了當(dāng)前存在的問題及原因，并提出完善建議，以期對(duì)改進(jìn)全國海關(guān)知識(shí)產(chǎn)權(quán)保護(hù)工作有借鑒作用。
[Abstract]:With the advancement of global economic integration and the progress of science and technology, customs protection of intellectual property rights related to international trade is becoming more and more important. Strengthening our country's intellectual property customs protection, maintaining economic order, and protecting the legitimate rights and interests of import and export enterprises is an important task for our customs at present. At the same time, it is also necessary to use it for our own use through the protection of intellectual property customs. Resolve the misunderstanding and prejudice of international public opinion to our country, eliminate intellectual property right hegemony. This paper studies the procedure of our country's intellectual property customs protection. This paper introduces the theory of China's intellectual property rights customs protection procedure, compares the intellectual property protection procedures of industrial and commercial administration departments internally, and analyzes the procedures of intellectual property rights customs protection in the United States and Hong Kong. On this basis, according to the sequence of our country's intellectual property rights customs protection procedure, the procedures of filing, seizure and investigation, punishment and infringement of goods are discussed, and the legal provisions and present situation are analyzed. This paper finds out the existing problems and causes, and puts forward some suggestions to improve the protection of national customs intellectual property rights.
