【摘要】：專利行政保護(hù)制度,是我國專利保護(hù)制度的重要內(nèi)容。我國自專利制度建立時(shí)就確立了行政保護(hù)和司法保護(hù)并行的雙軌制保護(hù)模式。這種保護(hù)模式雖是在我國當(dāng)時(shí)司法資源不足的情況下確立的,但卻是與我國“正處于并將長期處于社會主義初級階段”的基本國情相適應(yīng)的。近年來,專利法律制度逐步完善,民眾知識產(chǎn)權(quán)意識不斷增強(qiáng),專利保護(hù)日益成為專利制度的核心。但是,經(jīng)過多年的實(shí)踐,我國的專利行政保護(hù)制度不斷暴露出一些問題。本文通過對專利行政保護(hù)制度進(jìn)行深入探討,從理論和實(shí)踐兩個(gè)方面分析了專利行政保護(hù)制度存在的重要意義。另外,通過對國外專利保護(hù)體制的研究與思考,結(jié)合我國專利行政保護(hù)制度的成功經(jīng)驗(yàn)和存在的主要問題,提出了完善我國專利行政保護(hù)制度的建議,以期對他人研究此課題有所裨益。為了清楚論述觀點(diǎn),本文分成三個(gè)部分進(jìn)行論述： 第一部分介紹了專利行政保護(hù)的概念、保護(hù)內(nèi)容及其與司法保護(hù)的關(guān)系,并重點(diǎn)對專利行政保護(hù)的理論基礎(chǔ)與現(xiàn)實(shí)意義進(jìn)行了論述,增強(qiáng)了對專利行政保護(hù)在專利保護(hù)制度中的重要性的認(rèn)識。第二部分選取英國、美國、日本、韓國和墨西哥等國家,深入分析他們的專利保護(hù)制度和專利執(zhí)法情況,得到一些重要啟示。譬如：專利行政保護(hù)制度并不是我國獨(dú)有的專利保護(hù)制度、知識產(chǎn)權(quán)行政管理機(jī)構(gòu)宜集中設(shè)置、專利行政管理部門的行政管理和服務(wù)是專利行政保護(hù)的有機(jī)組成部分等等,這對于我國專利行政保護(hù)制度的完善有著很重要的借鑒意義。第三部分是本篇論文的重中之重。通過對我國專利行政保護(hù)制度運(yùn)行過程中積累的經(jīng)驗(yàn)和出現(xiàn)的主要問題進(jìn)行分析,我們發(fā)現(xiàn)我國專利行政保護(hù)制度在立法、管理體制設(shè)置和執(zhí)法實(shí)踐過程中還存在著很多問題。最后,借鑒國外先進(jìn)經(jīng)驗(yàn),結(jié)合我國實(shí)際,從立法、管理體制、運(yùn)行機(jī)制和提高全民知識產(chǎn)權(quán)意識四方面提出了對我國專利行政保護(hù)制度的完善建議,希望能對我國專利制度的改進(jìn)盡到微薄之力。 通過對這一專題的研究,更加深刻地認(rèn)識到專利行政保護(hù)制度對于我國專利保護(hù)的重要意義。希望隨著我國政治、經(jīng)濟(jì)、科技、文化的不斷發(fā)展和進(jìn)步,人們不再糾結(jié)于“知識產(chǎn)權(quán)行政保護(hù)的去留”,給專利行政保護(hù)一個(gè)準(zhǔn)確的職能定位,設(shè)計(jì)更加科學(xué)合理的制度,大力提升我國的自主創(chuàng)新能力和核心競爭力,為創(chuàng)新型國家建設(shè)提供有力支撐。
[Abstract]:Patent administrative protection system is an important content of patent protection system in China. Since the establishment of patent system, China has established a dual-track system of administrative protection and judicial protection. Although this mode of protection was established under the circumstance of insufficient judicial resources at that time in our country, it was adapted to the basic situation of our country that "is in and will be in the primary stage of socialism for a long time". However, after many years of practice, China's patent administrative protection system has exposed some problems. This paper discusses the patent administrative protection system and analyzes the significance of the patent administrative protection system from the aspects of theory and practice. In addition, through the research and thinking of foreign patent protection system, combined with the successful experience and main problems of patent administrative protection system in China, the paper puts forward some suggestions to perfect the patent administrative protection system in China. In order to help others to study this subject. In order to discuss the point of view clearly, this paper is divided into three parts: the first part introduces the concept of patent administrative protection, the content of protection and its relationship with judicial protection. The theoretical basis and practical significance of patent administrative protection are discussed in order to enhance the understanding of the importance of patent administrative protection in patent protection system. The second part selects Britain, the United States, Japan, South Korea and Mexico and other countries, in-depth analysis of their patent protection system and patent enforcement situation, get some important enlightenment. For example, the patent administrative protection system is not a unique patent protection system in China. The intellectual property administrative agencies should be set up centrally, and the administration and service of the patent administration departments are an organic part of the patent administrative protection, and so on. This has very important reference significance for the perfection of patent administrative protection system in our country. The third part is the most important part of this paper. Through the analysis of the experience and main problems in the operation of patent administrative protection system in China, we find that there are still many problems in our patent administrative protection system in the course of legislation, management system setup and law enforcement practice. Finally, drawing lessons from the advanced experience of foreign countries and combining with the reality of our country, this paper puts forward some suggestions on how to perfect the patent administrative protection system of our country from four aspects: legislation, management system, operation mechanism and raising the consciousness of intellectual property right of the whole people. I hope I can do my best to improve the patent system of our country. Through the study of this topic, the importance of patent administrative protection system to patent protection in China is more deeply recognized. It is hoped that with the continuous development and progress of politics, economy, science and technology, and culture in our country, people will no longer dwell on "the administrative protection of intellectual property rights", give the patent administrative protection an accurate functional orientation, and design a more scientific and reasonable system. Improve our country's independent innovation ability and core competitiveness to provide strong support for the construction of innovative country.
