虛擬化技術(shù)專利布局研究

【摘要】:虛擬化技術(shù)是云計算中最關(guān)鍵、最核心的技術(shù)原動力,近年來發(fā)展迅速。為了搶占和鞏固市場,各國高度重視專利,并投入大量財力、物力,在全球范圍內(nèi)申請大量專利實施專利布局,利用專利優(yōu)勢跑馬圈地,構(gòu)筑技術(shù)壁壘。目前我國發(fā)展虛擬化技術(shù)產(chǎn)業(yè)面臨著嚴(yán)峻的考驗,直接影響到我國云計算發(fā)展戰(zhàn)略。 選取1968年至2013年(含2013年)涉及全球81個受理機(jī)構(gòu)的虛擬化技術(shù)專利申請共51316件為研究對象,分析中國發(fā)展虛擬化技術(shù)所面臨的外部環(huán)境和自身內(nèi)部具體優(yōu)劣情況。統(tǒng)計結(jié)果表明虛擬化技術(shù)正處于成長初期,2023年虛擬化技術(shù)將進(jìn)入到成熟期。目前熱度最高的虛擬化技術(shù)市場依次美國、中國、日本、歐盟和韓國,該五國(地區(qū))也是主要市場參與國(地區(qū))。虛擬化技術(shù)領(lǐng)域93%的專利由該五國(地區(qū))的申請人提出,擁有全球93%發(fā)明人員,以及88%的高質(zhì)量專利,全球虛擬化技術(shù)領(lǐng)域規(guī)模排前20和技術(shù)研發(fā)實力排前20的研發(fā)主體都來自于該五國(地區(qū))。分析發(fā)現(xiàn)歐盟最重視美國市場,而其他四國家則最重視本土市場。各國對各個市場的重視程度不一樣,從而導(dǎo)致對專利布局的策略各有不同,在各個市場上的競爭力也不一樣。 中國進(jìn)入虛擬化技術(shù)領(lǐng)域較晚,是在虛擬化技術(shù)發(fā)展初期進(jìn)入該領(lǐng)域。但在2000年以后,各類研發(fā)主體積極涌入虛擬化技術(shù)領(lǐng)域,研發(fā)人員數(shù)量、技術(shù)成果數(shù)量以及專利申請量快速增長。虛擬化技術(shù)產(chǎn)業(yè)在中國迅速發(fā)展,然因起步晚,缺乏核心專利技術(shù),與競爭者相比創(chuàng)新能力弱,僅初步具備了將虛擬化技術(shù)產(chǎn)業(yè)化的能力,但中國虛擬化技術(shù)專利申請量全球第二,,具有規(guī)模上的優(yōu)勢。 要快速發(fā)展中國虛擬化技術(shù)產(chǎn)業(yè),一要采取追隨型技術(shù)發(fā)展策略,通過模仿、引進(jìn)國外先進(jìn)技術(shù)以培養(yǎng)中國企業(yè)的創(chuàng)新能力,發(fā)揮中國國企規(guī)模優(yōu)勢,與國外技術(shù)優(yōu)勢企業(yè)展開合作以提高自身創(chuàng)新能力,打破國外企業(yè)的專利封鎖;二要政府深度介入扶持,打造龍頭企業(yè),在現(xiàn)有的企業(yè)中選取優(yōu)勢企業(yè)進(jìn)行扶持,將有限資源向少數(shù)優(yōu)勢企業(yè)傾斜;三要建立完善高校的專利技術(shù)轉(zhuǎn)移運行機(jī)制,推動創(chuàng)新向企業(yè)聚集;四要鼓勵企業(yè)開展國際技術(shù)并購,并提供適合國情的知識產(chǎn)權(quán)保護(hù)水平,防止知識產(chǎn)濫用。
[Abstract]:Virtualization technology is the most key and core technology driving force in cloud computing, and has developed rapidly in recent years. In order to seize and consolidate the market, many countries attach great importance to the patent, invest a lot of financial and material resources, apply for a large number of patents in the global scope to implement the patent layout, use the patent advantage to run around the field, and build the technical barrier. At present, the development of virtualization technology industry in China is facing a severe test, which has a direct impact on cloud computing development strategy in China. From 1968 to 2013 (including 2013), 51316 patent applications for virtualization technology involving 81 organizations in the world were selected, and the external environment and internal advantages and disadvantages of developing virtualization technology in China were analyzed. The statistical results show that virtualization technology is in the early stage of growth, 2023 virtualization technology will enter the mature period. The most popular virtualization technology markets are the United States, China, Japan, the European Union and South Korea, which are also major market participants. Ninety-three percent of patents in virtualization technology are filed by applicants in these five countries, with 93 percent of the world's inventionists and 88 percent of high-quality patents. Global virtualization technology field scale top 20 and technology R & D strength top 20 R & D from the five countries (regions). The analysis found that the European Union attaches the most importance to the US market, while the other four countries attach the most importance to the domestic market. Different countries pay different attention to each market, which leads to different strategies of patent layout and different competitiveness in each market. China entered the field of virtualization technology late in the early development of virtualization technology into this field. However, since 2000, all kinds of R & D agents have been pouring into the field of virtualization technology, and the number of R & D personnel, the number of technical achievements and the number of patent applications have increased rapidly. The virtualization technology industry has developed rapidly in China, but due to its late start and lack of core patent technology, its innovation ability is weak compared with its competitors, and it only has the ability to industrialize virtualization technology. But China virtualization technology patent application volume is the second in the world, has the scale superiority. In order to develop China's virtualization technology industry rapidly, first, we should adopt the strategy of following technology development, by imitating and introducing advanced technology from abroad to cultivate the innovation ability of Chinese enterprises, and bring into play the advantages of the scale of Chinese state-owned enterprises. Cooperate with foreign technological advantage enterprises in order to improve their own innovation ability, break the patent blockade of foreign enterprises; second, the government should deeply intervene and support, build leading enterprises, select superior enterprises among existing enterprises to support, It is necessary to tilt limited resources to a few superior enterprises; third, to establish and improve the operating mechanism of patent technology transfer in colleges and universities, and to promote innovation to gather in enterprises; fourth, to encourage enterprises to carry out international technology mergers and acquisitions, and to provide intellectual property protection levels suitable for national conditions.
