【摘要】：隨著科技的進(jìn)步，特別是計算機(jī)技術(shù)的發(fā)展、成熟,圖形用戶界面在市場競爭中起著越來越重要的作用。我國政府及各大企業(yè)也越來越重視圖形用戶界面的法律保護(hù)。本文將對圖形用戶界面進(jìn)行闡述，對比國外圖形用戶界面外觀設(shè)計保護(hù)制度，就我國知識產(chǎn)權(quán)局新出臺的《專利審查指南修改草案》，對我國建立圖形用戶界面外觀設(shè)計保護(hù)制度進(jìn)行研究，并就構(gòu)建我國圖形用戶界面外觀設(shè)計保護(hù)制度進(jìn)行研究。 本文將按以上思路分三個部分進(jìn)行闡述。 第一部分圖形用戶界面外觀設(shè)計專利保護(hù)制度概述。圖形用戶界面是指供用戶使用和操作電子產(chǎn)品的各種媒介，如電腦及手機(jī)上那些承載著某種功能的圖標(biāo)。而圖形用戶界面外觀設(shè)計保護(hù)制度，起源于計算機(jī)技術(shù)發(fā)達(dá)的美國，歐盟、韓國、日本、臺灣等國家和地區(qū)也先后建立了此項(xiàng)制度。 第二部分我國建立圖形用戶界面外觀設(shè)計保護(hù)制度的必要性。我國計算機(jī)技術(shù)起步相對較晚，圖形用戶界面外觀設(shè)計保護(hù)制度對于我國來說有利有弊，但隨著我國計算機(jī)技術(shù)的飛速發(fā)展及與國際的接軌。圖形用戶界面的外觀設(shè)計保護(hù)制度已經(jīng)成為一種必然趨勢。 第三部分構(gòu)建我國圖形用戶界面外觀設(shè)計保護(hù)制度。我國圖形用戶界面外觀設(shè)計保護(hù)制度的建設(shè)才剛剛開始，，許多因素需要考慮。實(shí)務(wù)中對圖形用戶界面的保護(hù)需求也越來越迫切。因此構(gòu)建圖形用戶界面外觀設(shè)計保護(hù)制度是十分必要的。
[Abstract]:With the development of science and technology, especially the development of computer technology, graphical user interface (GUI) plays a more and more important role in market competition. Our government and major enterprises also pay more and more attention to the legal protection of graphical user interface. In this paper, the graphical user interface will be elaborated, compared with the protection system of foreign graphic user interface appearance design, Based on the revised draft of Patent examination Guide issued by China intellectual property Office, the establishment of graphical user interface design protection system in China is studied, and the construction of graphical user interface appearance design protection system in China is also studied. This article will be divided into three parts according to the above ideas. The first part of the graphical user interface design patent protection system overview. Graphical user interface (GUI) is a variety of media for users to use and operate electronic products, such as computer and mobile phone that carry some function of the icon. The graphical user interface design protection system originated in the United States, the European Union, South Korea, Japan, Taiwan and other countries and regions that have established this system. The second part is the necessity of establishing graphical user interface design protection system in China. The computer technology of our country starts relatively late, the protection system of graphic user interface appearance design has advantages and disadvantages for our country, but with the rapid development of computer technology in our country and with the international connection. The design protection system of graphical user interface has become an inevitable trend. The third part constructs our country graphical user interface appearance design protection system. The construction of graphic user interface design protection system in China is just beginning, many factors need to be considered. In practice, the protection of graphical user interface is more and more urgent. Therefore, it is very necessary to construct the graphical user interface design protection system.
